【摘要】：工礦廢棄地復(fù)墾利用是解決我國耕地不足的重要途徑,但該項(xiàng)工作涉及多方利益主體,有來自系統(tǒng)內(nèi)部、外部的各種阻力,同時(shí)也有各項(xiàng)驅(qū)動(dòng)力的共同作用。我國大力推動(dòng)工礦廢棄地的復(fù)墾利用,產(chǎn)生了較好的經(jīng)濟(jì)及社會(huì)效益。本文在對國內(nèi)外工礦廢棄地復(fù)墾利用相關(guān)研究進(jìn)行梳理的基礎(chǔ)上,結(jié)合晉城市工礦廢棄地復(fù)墾利用的現(xiàn)狀和存在的問題,從利益相關(guān)者視角出發(fā),對晉城市工礦廢棄地復(fù)墾利用試點(diǎn)決策及實(shí)施過程中存在的利益沖突和運(yùn)行機(jī)制做了初步探討分析,以期對推進(jìn)我國工礦廢棄地復(fù)墾利用有一定的借鑒意義。研究取得了如下認(rèn)識(shí):1.系統(tǒng)總結(jié)了我國開展工礦廢棄地復(fù)墾利用的情況,認(rèn)為工礦廢棄地復(fù)墾利用是來自系統(tǒng)內(nèi)部和外部的多重阻力和驅(qū)動(dòng)力共同作用向前推進(jìn)的一項(xiàng)工作。利益主體不同,利益訴求不同,勢必產(chǎn)生土地利用沖突和用地矛盾。2.在實(shí)地調(diào)研基礎(chǔ)上,解剖晉城市工礦廢棄地復(fù)墾利用實(shí)踐,系統(tǒng)分析其運(yùn)行機(jī)制。將該項(xiàng)工作視為一個(gè)系統(tǒng),以圖示的方式分析運(yùn)行過程中,各利益主體訴求及相互關(guān)系�？偨Y(jié)提出晉城市工礦廢棄地復(fù)墾的動(dòng)力機(jī)制、控制機(jī)制和保障機(jī)制。3.深刻剖析晉城市工礦廢棄地復(fù)墾利用實(shí)踐存在的問題并提出建議�？偨Y(jié)提出影響廢棄工礦地推進(jìn)的原因是多方面的,但權(quán)屬不清、土地增值后利益分配不明,以及復(fù)墾成本高,回收期長是主要因素,究其原因則是產(chǎn)權(quán)主體模糊、資金投入與后續(xù)收益分配,以及管理中存在各種矛盾造成的,針對這些問題,筆者提出,要從規(guī)劃、產(chǎn)權(quán)、部門協(xié)調(diào)等多方面進(jìn)行解決。比如:編制工礦廢棄地復(fù)墾利用專項(xiàng)規(guī)劃,一一列明建設(shè)用地權(quán)利人、產(chǎn)權(quán)所有人、面積、位置、建筑物及附著物等情況;建立工礦廢棄地復(fù)墾與新增建設(shè)用地掛鉤的市場調(diào)節(jié)機(jī)制;加強(qiáng)發(fā)改、國土、規(guī)劃等部門的溝通合作;將用地指標(biāo)和獎(jiǎng)勵(lì)與復(fù)墾土地質(zhì)量綜合等級(jí)的差異化或階梯型交易價(jià)格的制定相掛鉤等等。通過協(xié)調(diào)各方利益,努力實(shí)現(xiàn)利益最大化,促進(jìn)工礦廢棄地復(fù)墾工作。
[Abstract]:Reclamation and utilization of industrial and mining abandoned land is an important way to solve the shortage of cultivated land in our country, but this work involves multi-benefit main body, various resistance from inside and outside of the system, and the common action of various driving forces at the same time. China promotes the reclamation and utilization of industrial and mining wasteland, which brings about good economic and social benefits. Based on the research on reclamation and utilization of industrial and mining wasteland at home and abroad, this paper combines the present situation and existing problems of reclamation and utilization of industrial and mining wasteland in Jincheng, and sets out from the perspective of stakeholders. This paper makes a preliminary discussion and analysis on the conflict of interest and operation mechanism in the process of pilot decision and implementation of reclamation and utilization of industrial and mining abandoned land in Jincheng, in order to promote the reclamation and utilization of industrial and mining abandoned land in China. The research has obtained the following understanding: 1. The situation of reclamation and utilization of industrial and mining abandoned land in China is summarized systematically. It is considered that reclamation and utilization of industrial and mining abandoned land is a work that is pushed forward by the combined action of multiple resistance and driving force from inside and outside of the system. Different interest main body, interest demand is different, it is bound to produce land use conflict and land use contradiction. 2. On the basis of field investigation, the practice of reclamation and utilization of industrial and mining wasteland in Jincheng is dissected, and its operating mechanism is analyzed systematically. This work is regarded as a system, which analyzes the demands and relationships of the stakeholders in the process of operation graphically. The dynamic mechanism, control mechanism and guarantee mechanism of reclamation of industrial and mining wasteland in Jincheng are summarized and put forward. The problems existing in the practice of reclamation and utilization of industrial and mining wasteland in Jincheng are deeply analyzed and some suggestions are put forward. It is concluded that there are many reasons that affect the advance of abandoned industrial and mining land, but the ownership is not clear, the distribution of benefits after land increment is unclear, and the reclamation cost is high, and the long payback period is the main factor, but the main reason is the ambiguity of the main body of property right. There are various contradictions between capital investment and subsequent income distribution, as well as in management. In view of these problems, the author puts forward that we should solve these problems from the aspects of planning, property rights and coordination of departments and so on. For example, a special plan for reclamation and utilization of abandoned industrial and mining land will be drawn up, listing the owners of construction land, owners of property rights, area, location, buildings and attachments, etc. To establish the market regulation mechanism between reclamation of industrial and mining wasteland and new construction land, to strengthen the communication and cooperation among the departments of development, reform, land and planning, etc. The index and reward of land use are linked with the differentiation of comprehensive grade of land quality or the establishment of ladder transaction price and so on. By coordinating the interests of all parties, we should make great efforts to maximize the benefits and promote the reclamation of industrial and mining wasteland.
