【摘要】：目前,我國(guó)學(xué)術(shù)界,以及各項(xiàng)法律法規(guī)、規(guī)章關(guān)于環(huán)境影響評(píng)價(jià)制度的研究、規(guī)定主要在規(guī)劃和建設(shè)項(xiàng)目方面,主要研究其實(shí)施后可能對(duì)環(huán)境造成的影響,對(duì)于政府決策的環(huán)評(píng)制度研究目前還比較少,并且我國(guó)曾經(jīng)就有忽略對(duì)環(huán)境的影響,結(jié)果制定政策并實(shí)施,最后給環(huán)境造成了嚴(yán)重的破壞,并且破壞力巨大,范圍也很廣泛。本文利用閱讀文獻(xiàn)研究的方法、實(shí)例論證的研究方法和比較論證的研究方法,詳細(xì)的剖析當(dāng)前我構(gòu)建政策環(huán)評(píng)制度還面臨的問題和構(gòu)建所要尋找的有關(guān)解決路徑,綜合分析出來了下面的結(jié)果:1.環(huán)境影響評(píng)價(jià)制度主要目標(biāo)是環(huán)境與經(jīng)濟(jì)同步發(fā)展。根據(jù)目前我國(guó)可持續(xù)發(fā)展的要求,并結(jié)合我國(guó)過去對(duì)于未環(huán)評(píng)而展開的有關(guān)政策方案給環(huán)境帶來的嚴(yán)重影響,從中尋找環(huán)境與經(jīng)濟(jì)同步發(fā)展的主要方法。2.研究美國(guó)、加拿大、歐盟等國(guó)的政策環(huán)評(píng)制度的基本情況。分析得出,我國(guó)在建立政策環(huán)評(píng)制度的時(shí)候,完善法律支撐和制度體系是非常必要的,明確的程序性規(guī)定與后續(xù)的監(jiān)督也是構(gòu)建政策環(huán)評(píng)的重點(diǎn)。3.分析我國(guó)政策環(huán)境影響評(píng)價(jià)的制度現(xiàn)狀,其法律基礎(chǔ),實(shí)踐經(jīng)驗(yàn),存在的問題等,找準(zhǔn)構(gòu)建政策環(huán)評(píng)制度需要注意的關(guān)鍵環(huán)節(jié),最后明確我國(guó)政策環(huán)評(píng)的發(fā)展方向。4.我國(guó)政策環(huán)境影響評(píng)價(jià)制度構(gòu)建的建設(shè)性意見�？偨Y(jié)我國(guó)建立政策環(huán)境影響評(píng)價(jià)制度需要的程序性安排,對(duì)前置性程序的審批,以及構(gòu)建過程中應(yīng)該遵守的原則,最后分析《環(huán)保法》第14條的實(shí)效,針對(duì)政策環(huán)境影響評(píng)價(jià)程序的構(gòu)建,提出建設(shè)性意見。
[Abstract]:At present, the academic circles of our country, as well as various laws, regulations and regulations on the environmental impact assessment system research, mainly in the planning and construction projects, mainly to study the possible impact on the environment after its implementation, The environmental assessment system for government decision-making is still relatively few, and our country has ignored the impact on the environment, resulting in the formulation of policies and implementation, finally caused serious damage to the environment, and the destructive power is huge, and the scope is also very wide. This paper makes use of the methods of reading literature, case study and comparative demonstration to analyze in detail the problems that we are still facing in constructing the policy environmental assessment system and the relevant solutions to be found in the construction. The following results are obtained from the comprehensive analysis: 1. The main goal of the environmental impact assessment system is the simultaneous development of environment and economy. According to the requirements of China's sustainable development at present, and in the light of the serious impact on the environment caused by the relevant policies and schemes carried out in the past for non-EIA in China, the main methods for simultaneous development of environment and economy are sought. 2. To study the basic situation of the policy environmental assessment system in the United States, Canada, European Union and other countries. The analysis shows that it is very necessary to perfect the legal support and the system when establishing the policy EIA system in our country, and the clear procedural provisions and subsequent supervision are also the focal points of the construction of the policy EIA system. 3. This paper analyzes the current situation of China's policy environmental impact assessment system, its legal basis, practical experience, existing problems and so on, finds out the key links to be paid attention to in the construction of the policy environmental impact assessment system, and finally clarifies the development direction of China's policy environmental impact assessment. 4. Constructive suggestions on the construction of China's policy environmental impact assessment system. Summarizing the procedural arrangements required for the establishment of the policy environmental impact assessment system in China, the examination and approval of the pre-procedure and the principles to be observed in the construction process, and finally analyzing the effectiveness of Article 14 of the Environmental Protection Law, In view of the policy environmental impact assessment procedure construction, puts forward the constructive suggestion.
