【摘要】：環(huán)境問(wèn)題,尤其是大氣污染環(huán)境問(wèn)題,隨著近年來(lái)“霧霾”的集中爆發(fā)逐漸進(jìn)入公眾視野,備受社會(huì)各界的關(guān)注。政府作為公權(quán)力的代表,其在大氣污染防治工作中的履責(zé)情況也備受期待和關(guān)注。此外,黨的十八報(bào)告指出,“建設(shè)生態(tài)文明,是關(guān)系人民福祉、關(guān)乎民族未來(lái)的長(zhǎng)遠(yuǎn)大計(jì),”這為新時(shí)期政府職能的轉(zhuǎn)變指明了方向。建立健全的環(huán)境責(zé)任機(jī)制,推進(jìn)政府環(huán)境責(zé)任的履行,是加快政府職能轉(zhuǎn)變、提高政府治理能力、提升政府公信力的重要途徑。當(dāng)前,政府環(huán)境責(zé)任的內(nèi)涵和履行的必要性究竟是什么?我國(guó)地方政府大氣污染防治中存在的問(wèn)題及其原因都有哪些?面對(duì)諸多國(guó)內(nèi)外大氣污染防治的成功經(jīng)驗(yàn),如何根據(jù)國(guó)情遴選出適合在我國(guó)推廣的措施,并構(gòu)建強(qiáng)化我國(guó)大氣污染防治的政府責(zé)任制直接關(guān)系到我國(guó)大氣污染防治工作的成效。作為政府責(zé)任內(nèi)容之一的政府環(huán)境責(zé)任,通常也稱(chēng)作政府生態(tài)責(zé)任,是指法律規(guī)定的政府以公眾環(huán)境利益為指向,在環(huán)境保護(hù)方面應(yīng)盡的義務(wù),以及政府因未履行規(guī)定義務(wù)而造成的否定性后果應(yīng)承擔(dān)的責(zé)任。隨著大氣污染環(huán)境的日益嚴(yán)重、人們對(duì)大氣污染治理的呼聲日益高漲、以及環(huán)境治理的全球化日趨明顯,強(qiáng)化政府在大氣污染防治中的責(zé)任必須受到重視。論文首先從研究大氣污染防治及其政府責(zé)任入手,研究了大氣污染防治中政府責(zé)任的基本概念、理論依據(jù)以及具體內(nèi)容。在反思我國(guó)地方政府大氣污染防治中存在的問(wèn)題及其原因的基礎(chǔ)上,介紹了國(guó)內(nèi)外大氣污染防治的經(jīng)驗(yàn)和啟示,探討了以法律體系、信息公開(kāi)制度、多中心主體模式以及績(jī)效考核機(jī)制為依托的強(qiáng)化政府責(zé)任之策。論文從大氣污染防治法律體系不健全、信息公開(kāi)不透明、防治主體單一以及政府間協(xié)作存在障礙這四個(gè)方面指出了目前我國(guó)地方政府大氣污染防治中存在的問(wèn)題,并以此為線索,對(duì)這些問(wèn)題產(chǎn)生的原因進(jìn)行了追根溯源。在總結(jié)國(guó)內(nèi)外大氣污染防治經(jīng)驗(yàn)的啟示時(shí),著重從立法完善、科技創(chuàng)新、信息公開(kāi)、區(qū)域協(xié)作等方面進(jìn)行了反思。由此,提出了強(qiáng)化大氣污染防治中地方政府責(zé)任的對(duì)策:建立科學(xué)的大氣污染防治法律體系、定型全面的大氣環(huán)境信息公開(kāi)制度、創(chuàng)新多中心的大氣污染防治主體模式以及納入合理的大氣污染防治政績(jī)考核機(jī)制。
[Abstract]:Environmental problems, especially air pollution and environmental problems, have gradually come into public view with the outbreak of "fog and haze" in recent years, and have attracted much attention from all walks of life. It is an important way to speed up the transformation of government functions, improve government governance capacity and enhance government credibility. What is the connotation and the necessity of its implementation? What are the problems and their causes in the prevention and control of local air pollution in China? Faced with many successful experiences in the prevention and control of air pollution at home and abroad, how to select the measures suitable for popularization in China according to the national conditions, and how to construct a direct system of government responsibility to strengthen the prevention and control of air pollution in China? The government's environmental responsibility, as one of the government's responsibilities, is usually called the government's ecological responsibility. It refers to the government's obligations in environmental protection directed by the public environmental interests and the negative consequences caused by the government's failure to fulfill its obligations. With the increasingly serious air pollution environment, people's voice for air pollution control is rising day by day, and the globalization of environmental control is becoming increasingly obvious, strengthening the government's responsibility in the prevention and control of air pollution must be paid attention to. The basic concepts, theoretical basis and specific contents of the responsibility of the central government are introduced. On the basis of reflecting on the existing problems and their causes in the prevention and control of local air pollution in China, the experiences and Enlightenments of the prevention and control of air pollution at home and abroad are introduced. The legal system, information disclosure system, multi-center main body model and performance appraisal mechanism are discussed. In order to strengthen the government's responsibility, this paper points out the problems existing in the air pollution prevention and control of local governments in China from the following four aspects: the imperfect legal system of air pollution prevention and control, the opaque information, the single subject of prevention and control, and the obstacles of intergovernmental cooperation. In summarizing the experience of air pollution prevention and control at home and abroad, this paper mainly reflects on Perfection of legislation, innovation of science and technology, openness of information, regional cooperation and so on. Environmental information disclosure system, innovative multi-center air pollution prevention and control of the main model and into a reasonable performance assessment mechanism for air pollution prevention and control.
