【摘要】：農(nóng)藥是重要的農(nóng)業(yè)生產(chǎn)資料,對防治病蟲害,促進農(nóng)、林、牧業(yè)生產(chǎn)發(fā)揮了重要的作用,但農(nóng)藥的大量使用又可能造成環(huán)境污染,破壞生態(tài)平衡,甚至引發(fā)人畜中毒事故,威脅人身安全。我國作為農(nóng)業(yè)生產(chǎn)第一大國,農(nóng)藥的生產(chǎn)與使用量在世界上都排到了首位,但農(nóng)藥污染防治相關(guān)法律制度與世界上的許多國家還相去甚遠(yuǎn)。在農(nóng)藥污染事件頻發(fā)的今天,《農(nóng)藥管理條例》這部法規(guī)已然很難滿足防治農(nóng)藥污染的需求。所以,為了能有效應(yīng)對農(nóng)藥污染,必須認(rèn)真厘清我國現(xiàn)行的農(nóng)藥污染防治法律制度,分析其存在的不足之處,并借鑒發(fā)達(dá)國家的經(jīng)驗進行完善,使我國的農(nóng)藥污染防治法律制度發(fā)揮出其應(yīng)有的作用。這就是本文主要探究的內(nèi)容,論文大致上由四個部分組成： 第一部分指出了我國農(nóng)藥污染的現(xiàn)狀、危害及其成因。首先概括介紹了我國農(nóng)藥污染的現(xiàn)狀及其危害,包括對大氣、水體、土壤等生態(tài)環(huán)境以及人體健康、生物多樣性的危害,再分析了導(dǎo)致我國農(nóng)藥污染嚴(yán)重的原因。 第二部分介紹了我國農(nóng)藥污染防治法律制度的現(xiàn)狀及其缺陷。先簡要介紹了我國防治農(nóng)藥污染的立法及相關(guān)的法律制度,然后分析了現(xiàn)行農(nóng)藥污染防治法律制度的主要缺陷。 第三部分先后對美國、澳大利亞、英國、印度以及巴西的農(nóng)藥相關(guān)立法及法律制度進行介紹,并指出其可供借鑒之處,使之能夠與我國的基本國情相結(jié)合進而改進我國的相關(guān)法律制度。本部分主要采用了比較分析法和歸納總結(jié)的研究方法。 第四部分是本文的創(chuàng)新點,主要從完善立法,建立制度和強化責(zé)任三個角度,對我國農(nóng)藥污染防治法律制度進行完善。
[Abstract]:Pesticide is an important means of agricultural production, which plays an important role in preventing and controlling diseases and pests, promoting the production of agriculture, forestry and animal husbandry. However, the extensive use of pesticides may cause environmental pollution, destroy ecological balance, and even lead to human and animal poisoning accidents. A threat to personal safety. As the largest agricultural country in China, the production and use of pesticides have been ranked first in the world, but the relevant legal system of pesticide pollution prevention is far from that of many countries in the world. With the frequent occurrence of pesticide pollution, it is difficult to meet the demand of pesticide pollution prevention. Therefore, in order to deal with pesticide pollution effectively, we must carefully clarify the current legal system of pesticide pollution prevention and control in China, analyze its shortcomings, and learn from the experience of developed countries to improve it. So that our country's pesticide pollution prevention and control legal system play its due role. This is the main content of this paper, the paper is composed of four parts: the first part points out the status quo, hazards and causes of pesticide pollution in China. Firstly, the present situation and harm of pesticide pollution in China are introduced, including the harm to the ecological environment, such as atmosphere, water body, soil and so on, as well as the harm of human health and biodiversity, and then the causes of pesticide pollution in China are analyzed. The second part introduces the present situation and defects of pesticide pollution prevention and control legal system in China. This paper briefly introduces the legislation and related legal system of pesticide pollution prevention and control in China, and then analyzes the main defects of the current legal system of pesticide pollution prevention and control. The third part introduces the relevant legislation and legal system of pesticides in the United States, Australia, Britain, India and Brazil, and points out the points that can be used for reference. So that it can be combined with the basic conditions of our country, and then improve the relevant legal system of our country. This part mainly uses the comparative analysis method and the induction summary research method. The fourth part is the innovation of this paper, mainly from the three angles of perfecting the legislation, establishing the system and strengthening the responsibility, to perfect the legal system of the prevention and control of pesticide pollution in our country.
