【摘要】：近年來,我國經(jīng)濟發(fā)展迅速,城市化進程加快,伴隨著城市規(guī)模擴大、人民生活水平提高,“垃圾圍城”已成為我國大中城市面臨的嚴峻問題。如何對垃圾進行管理,尋找一條可持續(xù)發(fā)展的路徑成為政府和民眾關注的焦點。本文擬對城市生活垃圾分類管理的各個環(huán)節(jié)現(xiàn)狀進行分析,在借鑒已有城市專門立法和國外立法經(jīng)驗的基礎上,對我國城市生活垃圾分類管理制度的完善提出合理性建議。本文共分為四大部分:第一部分介紹了城市生活垃圾分類管理的基本原理。分析了城市生活垃圾分類管理的定義、意義、我國分類管理制度的演變及指導原則。通過分析可看出,對城市生活垃圾實行分類管理是循環(huán)經(jīng)濟、可持續(xù)發(fā)展的必然要求,垃圾減量化、資源化和無害化的重要途徑,可解決垃圾處理之窘境,可解決“垃圾圍城”之困。第二部分介紹了我國城市生活垃圾分類投放環(huán)節(jié)。生活垃圾源頭分類投放是垃圾分類有效管理的關鍵前提,本部分通過梳理垃圾分類投放執(zhí)行中的困境,借鑒國外經(jīng)驗、國內(nèi)推廣試點,提出生活垃圾定時定點投放制度、垃圾計量收費等保障機制。第三部分通過對我國城市生活垃圾分類收集、運輸?shù)姆梢?guī)制梳理,發(fā)現(xiàn)在分類收運環(huán)節(jié)中立法的缺位,混合收運嚴重。為了有效實現(xiàn)生活垃圾分類收運,提出分類收運的保障機制,主要包括垃圾分類管理責任人制度、臺賬制度、應急預案制度。第四部分通過對我國城市生活垃圾分類處理環(huán)節(jié)相關內(nèi)容的梳理,主要分析了在此環(huán)節(jié)中存在的“鄰避”現(xiàn)象與垃圾產(chǎn)業(yè)化之路的困境,提出明確政府、企業(yè)、公眾三類主體的權利與義務是上述問題的解決路徑,從政府準確定位、強化企業(yè)責任、完善公正參與的三方面提出了合理性建議。
[Abstract]:In recent years, with the rapid development of economy and the acceleration of urbanization, with the expansion of city scale and the improvement of people's living standard, "garbage besieging" has become a severe problem faced by large and medium-sized cities in our country. How to manage garbage and find a sustainable development path has become the focus of government and people. This paper analyzes the current situation of classified management of municipal solid waste (MSW). Based on the experience of special legislation and foreign legislation, the paper puts forward some reasonable suggestions for the improvement of classified management system of municipal solid waste (MSW) in China. This paper is divided into four parts: the first part introduces the basic principle of municipal solid waste classified management. This paper analyzes the definition and significance of classified management of municipal solid waste, the evolution and guiding principles of classified management system in China. It can be seen from the analysis that the classified management of municipal solid waste is the inevitable requirement of circular economy and sustainable development, and the important ways of waste reduction, resource utilization and innocuity can solve the dilemma of waste disposal. Can solve the "garbage siege" difficulties. The second part introduces the classification and delivery of municipal solid waste in China. Classification and release of domestic garbage source is the key premise for effective management of waste classification. This part puts forward the system of fixed and fixed time delivery of domestic refuse by combing the difficulties in the implementation of classifying and dropping garbage, drawing lessons from foreign experience and popularizing the pilot project at home. Garbage metering and charging guarantee mechanism. In the third part, by sorting the collection of municipal solid waste and the legal regulation of transportation, the author finds that the legislation is absent in the process of classified collection and transportation, and the mixed collection is serious. In order to effectively realize the classified collection and transportation of domestic waste, this paper puts forward the safeguard mechanism of classified collection and transportation, which mainly includes the system of responsible person for classified management of garbage, the system of ledger, and the system of emergency plan. The fourth part analyzes the phenomenon of "adjacent avoidance" and the dilemma of garbage industrialization by combing the related contents of the classification and disposal of municipal solid waste in China, and puts forward a clear definition of the government and enterprises. The rights and obligations of three kinds of public subjects are the ways to solve the above problems. The rational suggestions are put forward from the three aspects of the government's accurate orientation, the strengthening of enterprise responsibility and the perfection of fair participation.
