【摘要】：由于秦嶺的自然地理條件以及人文因素的影響,陜西秦嶺生態(tài)環(huán)境保護需要以各部門的協(xié)調(diào)以及環(huán)境保護執(zhí)法聯(lián)動來促進生態(tài)環(huán)境的可持續(xù)發(fā)展。這樣的模式不僅能夠補充我國環(huán)境執(zhí)法聯(lián)動機制的現(xiàn)存不足,更能促進地方經(jīng)濟的發(fā)展,對于發(fā)展全國其他環(huán)境保護區(qū)的執(zhí)法聯(lián)動也會提供一定的參考價值和借鑒意義。本文梳理了針對陜西秦嶺已經(jīng)頒布的不同效力等級的法律法規(guī)、規(guī)章和規(guī)范性文件,為陜西秦嶺生態(tài)環(huán)境保護執(zhí)法聯(lián)動機制的實施提供了重要的法律依據(jù)。依照相關(guān)法律規(guī)定,陜西秦嶺生態(tài)環(huán)境保護的執(zhí)法管理分為地區(qū)分權(quán)執(zhí)法管理、功能分割執(zhí)法管理以及專業(yè)機構(gòu)的執(zhí)法管理這三種模式。針對陜西秦嶺現(xiàn)有的執(zhí)法管理,本文認為存在如下的問題:部門管理缺乏溝通,協(xié)調(diào)機制存在困頓,為進一步開展生態(tài)環(huán)境保護帶來了一定的困難。在分析當前陜西秦嶺執(zhí)法模式的基礎(chǔ)上,運用協(xié)同論和系統(tǒng)論為陜西秦嶺生態(tài)環(huán)境保護執(zhí)法聯(lián)動機制的構(gòu)建提供理論依據(jù),并借鑒美國、日本和我國常州的模式,探討了環(huán)境保護執(zhí)法聯(lián)動的經(jīng)驗。為了構(gòu)建陜西秦嶺生態(tài)環(huán)境執(zhí)法聯(lián)動機制,文章最終確定為設(shè)立實體型集中管理機構(gòu)、合作統(tǒng)籌協(xié)調(diào)管理機構(gòu)兩種新的機構(gòu)模式,建立聯(lián)席會議制度、環(huán)保聯(lián)絡(luò)員制度、環(huán)境突發(fā)事件聯(lián)防聯(lián)控制度、生態(tài)環(huán)境統(tǒng)一監(jiān)管、日常聯(lián)動管理制度以及生態(tài)環(huán)境綜合規(guī)劃協(xié)調(diào)制度,來實現(xiàn)陜西秦嶺生態(tài)環(huán)境保護執(zhí)法聯(lián)動機制的完善;同時文章以現(xiàn)行的“西安模式”加以印證,闡述了陜西秦嶺環(huán)境保護執(zhí)法聯(lián)動機制的運行,從而構(gòu)建出陜西秦嶺生態(tài)環(huán)境保護執(zhí)法聯(lián)動機制。
[Abstract]:Due to the natural geographical conditions of the Qinling Mountains and the impact of human factors. The ecological environment protection in Qinling Mountain of Shaanxi Province needs to promote the sustainable development of ecological environment by coordination of various departments and the linkage of environmental protection law enforcement. Such a model can not only supplement the existing deficiencies of the linkage mechanism of environmental law enforcement in China. It can promote the development of local economy. For the development of other environmental protection areas of the law enforcement linkage will also provide a certain reference value and significance. Regulations and normative documents provide an important legal basis for the implementation of the law enforcement linkage mechanism of ecological environmental protection in the Qinling Mountains of Shaanxi Province in accordance with relevant legal provisions. The law enforcement management of Qinling ecological environment protection in Shaanxi is divided into three modes: regional decentralized law enforcement management, functionally divided law enforcement management and professional organization law enforcement management, aiming at the existing law enforcement management in Shaanxi Qinling Mountains. This paper points out that the following problems exist: lack of communication in department management and difficulties in coordination mechanism, which bring some difficulties for the further development of ecological environment protection. Based on the analysis of the current law enforcement model in Qinling Mountains, Shaanxi Province. The use of synergy theory and system theory for the Qinling Mountain Shaanxi ecological environment protection law enforcement linkage mechanism to provide theoretical basis and learn from the United States, Japan and China's Changzhou model. This paper discusses the experience of environmental protection law enforcement linkage. In order to construct the ecological environment law enforcement linkage mechanism in Qinling, Shaanxi province, the article finally determines the establishment of entity centralized management organization. Cooperation, coordination and management of two new institutional models, the establishment of a joint meeting system, environmental protection liaison system, environmental emergency joint control system, ecological environment unified supervision. Daily linkage management system and ecological environment comprehensive planning coordination system to achieve the Qinling Mountain Shaanxi ecological environment protection law enforcement linkage mechanism to improve; At the same time, based on the current "Xi'an Model", this paper expounds the operation of the law enforcement linkage mechanism of environmental protection in the Qinling Mountains, Shaanxi Province, and constructs the law enforcement linkage mechanism of the ecological environmental protection in the Qinling Mountains of Shaanxi Province.
