高鐵走出去知識(shí)產(chǎn)權(quán)風(fēng)險(xiǎn)防范

【摘要】:高鐵走出去面臨著被指責(zé)、被起訴、被調(diào)查侵犯別人知識(shí)產(chǎn)權(quán)的風(fēng)險(xiǎn)和自己知識(shí)產(chǎn)權(quán)被侵權(quán)的風(fēng)險(xiǎn)。風(fēng)險(xiǎn)產(chǎn)生原因,客觀上國(guó)際高鐵市場(chǎng)是高新技術(shù)激烈競(jìng)爭(zhēng)的市場(chǎng),容易引發(fā)知識(shí)產(chǎn)權(quán)爭(zhēng)議;而且中國(guó)高鐵技術(shù)是在引進(jìn)的基礎(chǔ)上快速發(fā)展,容易給人造成抄襲的外觀;加之存在海外知識(shí)產(chǎn)權(quán)維權(quán)成本高和專業(yè)法律人才匱乏等因素增加了維權(quán)的難度;主觀上由于中國(guó)高鐵相關(guān)主體沒(méi)有充分認(rèn)識(shí)到海外知識(shí)產(chǎn)權(quán)風(fēng)險(xiǎn)防范的重要性,所以沒(méi)有制定科學(xué)有效的制度規(guī)范,沒(méi)有設(shè)置完善的知識(shí)產(chǎn)權(quán)管理機(jī)構(gòu)和配備充足的人員,也沒(méi)有對(duì)目標(biāo)國(guó)進(jìn)行合理的知識(shí)產(chǎn)權(quán)布局。所以應(yīng)該進(jìn)行以下風(fēng)險(xiǎn)防范:一要喚醒相關(guān)主體風(fēng)險(xiǎn)防范意識(shí);二要設(shè)置專門機(jī)構(gòu)并配備合理人員;三要對(duì)高鐵走出去目標(biāo)國(guó)進(jìn)行合理的知識(shí)產(chǎn)權(quán)布局;四要建立海外高鐵知識(shí)產(chǎn)權(quán)風(fēng)險(xiǎn)防范預(yù)警機(jī)制;五要敢于應(yīng)對(duì)高鐵走出去過(guò)程中的各類知識(shí)產(chǎn)權(quán)責(zé)難;六要積極培養(yǎng)高鐵走出去知識(shí)產(chǎn)權(quán)保護(hù)的專門法律人才。
[Abstract]:High-speed rail faces accusations, prosecutions, and investigations into the risks of infringing other people's intellectual property rights and of infringing their own intellectual property rights. The reason for the risk is that the international high-speed rail market is a highly competitive market for high and new technology, which is liable to lead to intellectual property disputes, and the rapid development of high-speed rail technology in China is based on the introduction of high speed rail technology, and it is easy to create a plagiarized appearance for people. In addition, the high cost of safeguarding intellectual property rights abroad and the lack of professional legal personnel have increased the difficulty of safeguarding their rights; subjectively, the Chinese high-speed rail related bodies have not fully realized the importance of overseas intellectual property rights risk prevention. Therefore, there are no scientific and effective institutional norms, no perfect intellectual property management institutions and adequate personnel, and no reasonable distribution of intellectual property rights to target countries. Therefore, the following risk precautions should be carried out: first, to awaken the awareness of risk prevention of relevant subjects; second, to set up specialized institutions with reasonable personnel; third, to make a reasonable distribution of intellectual property rights for the target countries of high-speed rail; Fourth, it is necessary to establish an early warning mechanism for intellectual property rights risk prevention of overseas high-speed rail; fifthly, it is necessary to dare to deal with all kinds of intellectual property censure in the process of high-speed rail going out; and sixth, it is necessary to actively train specialized legal personnel for the protection of intellectual property rights.
