【摘要】：高速鐵路作為中國高端裝備制造業(yè)的典范,肩負(fù)著中國制造"走出去"的歷史使命。當(dāng)前關(guān)于高鐵技術(shù)的專利爭端成為中國高鐵"走出去"的潛在風(fēng)險(xiǎn)。本文基于短期資金償付能力、長期資金償付能力、需求國意愿、中國意愿、既有專利數(shù)量5項(xiàng)標(biāo)準(zhǔn),將國際高鐵市場劃分為招標(biāo)型、預(yù)期盈利型、遠(yuǎn)期利益型和戰(zhàn)略型,并針對四種類型的市場研究提出進(jìn)攻、防御、調(diào)控等相應(yīng)的專利策略,最后從整體上對中國高鐵的海外專利布局提出建議。
[Abstract]:As a model of high-end equipment manufacturing in China, high-speed railway shoulders the historical mission of "going out".The current patent dispute over high-speed rail technology has become a potential risk for China's high-speed rail industry.Based on the five criteria of short-term capital solvency, long-term capital solvency, the will of the country of demand, China's will and the number of patents, this paper divides the international high-speed rail market into three types: tender, expected profit, forward benefit and strategy.It also puts forward the corresponding patent strategies for four types of market research, such as attack, defense, regulation and control, and finally puts forward some suggestions on the overseas patent layout of high-speed rail in China as a whole.
