【摘要】：隨著我國(guó)社會(huì)、經(jīng)濟(jì)的不斷發(fā)展,我國(guó)農(nóng)村面臨的土地問(wèn)題開(kāi)始日漸突出,以家庭承包責(zé)任制為核心的土地利用制度表現(xiàn)出土地經(jīng)營(yíng)碎片化的特點(diǎn),導(dǎo)致土地收益地下,土地拋荒問(wèn)題嚴(yán)重。為適應(yīng)現(xiàn)代農(nóng)業(yè)的發(fā)展需求,提高農(nóng)村經(jīng)濟(jì)水平,我國(guó)多個(gè)地區(qū)已有土地流轉(zhuǎn)模式的探索。本文寫作的目的在于以理論和實(shí)踐相結(jié)合的方法,探析農(nóng)村土地信托流轉(zhuǎn)制度的特點(diǎn)與風(fēng)險(xiǎn)。全文可分為引言、正文和結(jié)論三大部分。引文部分描述了本文寫作的社會(huì)背景情況,提出了本文需要回答的主要問(wèn)題。正文部分又分為四個(gè)章節(jié),第一章的主要內(nèi)容為土地信托制度的理論基礎(chǔ),包括目前我國(guó)關(guān)于農(nóng)村土地的主要法律規(guī)定以及信托制度的基本理論基礎(chǔ)介紹；第二章的內(nèi)容主要介紹了土地信托流轉(zhuǎn)的實(shí)踐基礎(chǔ),主要是關(guān)于我國(guó)在近年來(lái)對(duì)農(nóng)村土地流轉(zhuǎn)所做的探索的介紹與總結(jié),以及對(duì)其他國(guó)家土地信托流轉(zhuǎn)模式的介紹與參考；第三章的內(nèi)容主要介紹了我國(guó)目前已經(jīng)做出的對(duì)土地信托流轉(zhuǎn)的探索,以較為典型的湖南益陽(yáng)和浙江紹興為例,總結(jié)了以上兩個(gè)地區(qū)土地信托的經(jīng)驗(yàn)與啟示；第四章的內(nèi)容為完善土地信托流轉(zhuǎn)制度的法律思考,并從制度上提出了一些有助于完善土地信托流轉(zhuǎn)的建議。本文的結(jié)論部分總結(jié)了正文部分所做的分析與論證,對(duì)農(nóng)村土地信托制度的未來(lái)發(fā)展表明了態(tài)度,并對(duì)本文研究的不足的地方做了說(shuō)明。
[Abstract]:With the continuous development of our society and economy, the land problems in rural areas of our country begin to stand out day by day. The land use system with the household contract responsibility system as the core shows the characteristics of fragmentation of land management, which leads to the underground land revenue. The problem of land abandonment is serious. In order to meet the development needs of modern agriculture and improve the level of rural economy, land circulation mode has been explored in many areas of our country. The purpose of this paper is to explore the characteristics and risks of rural land trust circulation system by combining theory with practice. The full text can be divided into three parts: introduction, text and conclusion. The citation describes the social background of the writing and puts forward the main questions to be answered. The main content of the first chapter is the theoretical basis of the land trust system, including the main legal provisions on rural land and the basic theoretical basis of the trust system. The second chapter mainly introduces the practical basis of land trust circulation, mainly about the introduction and summary of the rural land circulation in recent years in China, as well as the introduction and reference to other countries' land trust circulation mode. The third chapter mainly introduces the exploration of land trust circulation that our country has made at present, taking Yiyang of Hunan and Shaoxing of Zhejiang Province as examples, summarizes the experience and enlightenment of land trust in the above two areas. The fourth chapter is to perfect the legal thinking of land trust circulation system, and put forward some suggestions from the system to improve the land trust circulation. The conclusion part summarizes the analysis and argumentation made in the main part, shows the attitude to the future development of the rural land trust system, and explains the deficiency of this paper.
