【摘要】：隨著當(dāng)前中國經(jīng)濟(jì)的持續(xù)高速發(fā)展,征用土地而帶來的拆遷問題越來越嚴(yán)重。由于我國《土地管理法》中所規(guī)定的相關(guān)內(nèi)容不夠詳細(xì)與完整,征地拆遷中各種矛盾沖突很復(fù)雜,早已不適應(yīng)現(xiàn)在我國征地拆遷的要求,各地征地拆遷工作都面臨著前所未有的挑戰(zhàn),并不同程度存在著一些急需解決的問題。本文以G市為例,對(duì)該市的征地拆遷情況進(jìn)行了系統(tǒng)的分析,主要分為三個(gè)部分。第一部分：采用文獻(xiàn)法引入信訪和征地拆遷信訪等相關(guān)概念,闡述了信訪的相關(guān)機(jī)制。第二部分：用統(tǒng)計(jì)分析法和案例分析法,總結(jié)出G市征地拆遷信訪的情況,包括分析征地拆遷信訪的現(xiàn)狀,存在的問題及原因,問題主要有五個(gè)方面：土地征用后的保障安置問題；征地補(bǔ)償款分配不均的問題；特殊群體的補(bǔ)償分配問題；征用土地補(bǔ)償不兌現(xiàn)問題；由其他主觀原因引發(fā)的重復(fù)上訪。原因主要有：底層群眾缺乏法制教育；相關(guān)部門重視、配合不夠；網(wǎng)絡(luò)信訪信息不發(fā)達(dá)；管理不科學(xué)缺乏創(chuàng)新。第三部分是全篇的重點(diǎn)：以G市征地拆遷信訪為例,提出了具有實(shí)用性和操作性的G市征地拆遷問題解決對(duì)策：土地征用后要公開透明每一環(huán)節(jié),使保障措施到位；征地補(bǔ)償款分配前要嚴(yán)格制定好標(biāo)準(zhǔn),使被征地人心服口服；特殊群體要特殊對(duì)待,避免產(chǎn)生矛盾沖突；督促及時(shí)發(fā)放補(bǔ)償款,使補(bǔ)償款真正落實(shí)到位；對(duì)已上訪的群眾,要及時(shí)做好回訪避免發(fā)生重復(fù)訪。本文創(chuàng)新性在于以某省G市征地拆遷的情況為切入點(diǎn),研究分析在現(xiàn)階段G市征地拆遷存在問題與解決辦法,以實(shí)際案例為依據(jù),具體詳實(shí),為我國各地化解征地拆遷矛盾提供建議和方法,也為今后國家和各地區(qū)研究征地拆遷政策和制定相關(guān)的法律法規(guī)提供理論參考和幫助。
[Abstract]:With the continuous and rapid development of Chinese economy, the problem of demolition caused by expropriation of land is becoming more and more serious. Because the relevant contents stipulated in the Land Management Law of our country are not detailed and complete enough, all kinds of contradictions and conflicts in land expropriation and demolition are very complicated. It has not been adapted to the requirement of land expropriation and relocation in our country. The work of land requisition and relocation is facing unprecedented challenges, and there are some problems that need to be solved at different levels. This paper takes G city as an example. This paper systematically analyzes the situation of land expropriation and removal in the city, which is divided into three parts. The first part is the introduction of the related concepts of petition and land requisition and removal by using the literature method. The second part: with statistical analysis and case analysis, summarizes the situation of land requisition and removal in G city, including the analysis of the status quo, existing problems and reasons. There are five main problems: the issue of security and resettlement after land expropriation; the uneven distribution of compensation for land requisition; the distribution of compensation for special groups; the problem of dishonour of compensation for expropriation; Repeated petition caused by other subjective reasons. The main reasons are: the lack of legal education for the people at the bottom; the lack of cooperation between the relevant departments; the underdevelopment of the information of letters and visits on the network; The third part is the focal point of the whole article: taking the land requisition and removal of G city as an example, the paper puts forward the practical and operational countermeasures to solve the problem of land requisition and removal in G city: every link should be open and transparent after land expropriation. To ensure that the measures are in place; before the allocation of compensation for land requisition to strictly formulate standards so that the requisitioned people accept; special groups should be treated to avoid contradictions and conflicts; urge the timely release of compensation so that the compensation really put into place; To the people who have already filed a petition, it is necessary to make a timely return visit to avoid repeated visits. The innovation of this paper is to study and analyze the existing problems and solutions of land requisition and removal in G city at the present stage, taking the situation of land requisition and removal in a certain province as the starting point. On the basis of actual cases, it provides suggestions and methods for resolving the contradiction of land expropriation and relocation in various parts of China, and also provides theoretical reference and help for the future study of land expropriation and relocation policy and the formulation of relevant laws and regulations.
