【摘要】：本文從法律角度對(duì)資產(chǎn)證券化這一新興金融工具作了初步的介紹，繼而結(jié)合實(shí)際案例對(duì)參與資產(chǎn)證券化的各個(gè)法律主體及他們之間的法律關(guān)系及法律權(quán)利義務(wù)的的作出分析并對(duì)資產(chǎn)證券化活動(dòng)中各個(gè)環(huán)節(jié)可能產(chǎn)生的法律風(fēng)險(xiǎn)進(jìn)行歸納分析。資產(chǎn)證券化業(yè)務(wù)中需要大量的法律工作，，本文也結(jié)合資產(chǎn)證券化的業(yè)務(wù)流程對(duì)法律工作者在資產(chǎn)證券化業(yè)務(wù)中的實(shí)務(wù)工作作出梳理和歸納。文章的最后，就資產(chǎn)證券化目前在國(guó)內(nèi)的發(fā)展現(xiàn)狀的不足之處做出總結(jié)，并提出作者個(gè)人化的改進(jìn)觀點(diǎn)。
[Abstract]:This paper makes a preliminary introduction to asset securitization, a new financial instrument, from the angle of law. Then, combined with practical cases, the author analyzes the legal relations and legal rights and obligations between the legal subjects involved in asset securitization and the legal risks that may arise in various aspects of asset securitization activities. Asset securitization business requires a large number of legal work. This paper also combines the business process of asset securitization to sort out and summarize the practical work of legal workers in asset securitization business. This paper summarizes the shortcomings of asset securitization in China, and puts forward the author's personal improvement.
