山東省五蓮縣征地問題研究

【摘要】：中國人多地少,隨著經(jīng)濟發(fā)展方式不斷變化土地需求不斷擴大,土地征收卻沒有大的變革,使得征地與社會經(jīng)濟發(fā)展之間的矛盾越來越突出,逐漸暴露出與市場經(jīng)濟不相協(xié)調(diào)的問題,政府每年從農(nóng)民手中征收大量的土地,導致大批的農(nóng)民不得不離開棲息的土地,失地農(nóng)民的數(shù)量急劇增加。因現(xiàn)行征地制度缺陷而引發(fā)的農(nóng)民上訪大有愈演愈烈之勢,形成了土地管理工作乃至經(jīng)濟社會建設(shè)的不和諧因素,因此對征地問題的專門研究具有特殊意義。從理論上,以立足國情為基礎(chǔ),充分借鑒國外先進征地經(jīng)驗,對五蓮縣近年來的征地問題進行研究,提出完善五蓮縣征地的對策,為解決五蓮縣征地問題提供理論依據(jù);在實踐上,對五蓮征地問題的研究順應了國家經(jīng)濟發(fā)展的需要,有利于理順土地征收政策思路,增強社會穩(wěn)定性,確保經(jīng)濟社會快速和諧發(fā)展。通過問卷調(diào)查、案例研究、表格分析等方式對五蓮縣的征地進行了調(diào)查研究。研究發(fā)現(xiàn),五蓮縣在征地實踐中有不少好措施,但仍存在不少問題,比如征地補償矛盾多、征地數(shù)量大導致耕地資源流失嚴重、征地用途分配不合理。通過深入分析,得出五蓮縣征地補償標準偏低、當前征地補償制度不完善,征地過程透明度低,政府征地權(quán)范圍過寬,監(jiān)督監(jiān)管機制不健全,這些是造成五蓮縣征地問題的主要成因。立足于解決五蓮縣實際征地問題,結(jié)合國內(nèi)外征地研究理論和個人征地工作實踐,提出要從不斷完善制度建設(shè)、嚴格限制征地范圍、完善并嚴格履行征地程序、加強監(jiān)督檢查和信息公開、優(yōu)化土地資源配置這五個對策完善征地問題,為五蓮縣征地的發(fā)展獻計獻策。
[Abstract]:With the continuous changes in the mode of economic development, the demand for land continues to expand, but there is no great change in land expropriation, which makes the contradiction between land requisition and social and economic development more and more prominent. Gradually exposed the problem of disharmony with the market economy, the government expropriated a large number of land from the farmers every year, resulting in a large number of farmers had to leave the land, the number of land-lost farmers increased sharply. The peasants' petition caused by the defects of the current land requisition system is becoming more and more intense, forming the disharmonious factors of land management and even economic and social construction, so it is of special significance to study the land requisition problem. Theoretically, based on the national conditions and drawing lessons from foreign advanced land expropriation experience, this paper studies the land requisition in Wulian County in recent years, and puts forward the countermeasures to perfect the land requisition in Wulian County, which provides the theoretical basis for solving the land requisition problem in Wulian County. In practice, the study on the land requisition of Wulian conforms to the need of national economic development, which is helpful to straighten out the policy of land expropriation, strengthen social stability and ensure the rapid and harmonious development of economy and society. Through questionnaire, case study, table analysis and other ways to investigate the land requisition in Wulian County. The study found that there are many good measures in the practice of land expropriation in Wulian County, but there are still many problems, such as the contradiction of compensation for land requisition, the large amount of land requisition, the serious loss of cultivated land resources and the unreasonable allocation of land requisition. Through in-depth analysis, it is concluded that the compensation standard for land expropriation in Wulian County is on the low side, the current compensation system for land requisition is not perfect, the transparency of the land requisition process is low, the scope of the government land expropriation right is too wide, and the supervision and supervision mechanism is not perfect. These are the main causes of land expropriation in Wulian County. Based on solving the actual land requisition problem in Wulian County, combining with the theory of land requisition and the practice of individual land requisition at home and abroad, the paper puts forward that we should constantly perfect the system construction, strictly limit the scope of land expropriation, perfect and strictly perform the land requisition procedure. Strengthen the supervision and inspection and information publicity, optimize the allocation of land resources to improve the five countermeasures of land expropriation, for the development of Wulian County.
