【摘要】：為了實現(xiàn)農(nóng)村土地的規(guī)�；\行,發(fā)揮農(nóng)村土地的市場作用,大陸地區(qū)開始了土地流轉(zhuǎn)工作,并于2016年實施土地“三權分置”,同時開展相應的土地確權工作,以實現(xiàn)土地資源的規(guī)�；稀Ｖ袊伯a(chǎn)黨第十五屆三中全會決議指出:“土地是農(nóng)業(yè)最基本的生產(chǎn)要素,又是農(nóng)民最基本的生活保障”。農(nóng)村土地的市場化有效提高了農(nóng)民的經(jīng)濟收入,提高了土地資源的利用率。但是由于相應法律法規(guī)的缺失、中介服務組織落后等原因,嚴重影響了農(nóng)村土地的流轉(zhuǎn)。在世界范圍內(nèi),瑞士、日本、英國、美國等國家經(jīng)過不斷的土地制度改革,有了一套相對完善的土地交易制度,但是由于歷史、文化、經(jīng)濟等方面的差異性,使得大陸地區(qū)吸收國外土地交易經(jīng)驗時無法做到有效利用。而臺灣與大陸地區(qū)在土地制度改革的初期都以孫中山先生所提倡的“耕者有其田”為改革宗旨,同時由于臺灣地區(qū)在土地制度改革方面較為成功,因此對于大陸地區(qū)而言有著較強的借鑒作用。本文主要運用文獻分析法、訪談法及比較法,通過比較大陸及臺灣地區(qū)土地流轉(zhuǎn)制度的歷程、經(jīng)驗、現(xiàn)狀的比較,借鑒其較為成熟的土地交易經(jīng)驗,同時針對臺灣地區(qū)土地交易制度中出現(xiàn)的不足,提出了臺灣地區(qū)土地交易制度對大陸地區(qū)的一些啟示。全文共分為七個章節(jié):首先通過臺灣及大陸地區(qū)歷次土地制度改革,對兩岸農(nóng)村地區(qū)背景、政策進行了比較,闡述了兩岸在社會背景、政策實施的目的、基礎和內(nèi)容中的異同;其次,分析了兩岸農(nóng)村土地流轉(zhuǎn)的現(xiàn)狀,將兩岸農(nóng)村土地流轉(zhuǎn)制度實施后的成效及其問題進行了陳述;再次,對兩岸農(nóng)村土地流轉(zhuǎn)的經(jīng)驗進行比較,列舉出臺灣土地交易制度較為先進的地方;最后,針對于大陸地區(qū)農(nóng)村土地流轉(zhuǎn)中出現(xiàn)的一些問題,結(jié)合臺灣地區(qū)的相關經(jīng)驗提出相關啟發(fā)意義�？傊�,吸取臺灣地區(qū)農(nóng)村土地交易制度中的相關成功經(jīng)驗,同時也應當看到臺灣地區(qū)農(nóng)村土地交易中出現(xiàn)的不足,取長補短,避免發(fā)生同樣的問題,有利于推進大陸農(nóng)村地區(qū)土地流轉(zhuǎn)的不斷完善,對保護農(nóng)民權益,促進農(nóng)業(yè)發(fā)展,實現(xiàn)“中國夢”有著重要的現(xiàn)實意義。
[Abstract]:In order to realize the large-scale operation of rural land and give play to the market role of rural land, the land circulation in mainland China began, and the land "three rights division" was implemented in 2016, and the corresponding land confirmation work was carried out at the same time. In order to achieve large-scale integration of land resources. The resolution of the third Plenary session of the 15th CPC Central Committee points out: "Land is the most basic factor of production in agriculture and the most basic livelihood of peasants." The marketization of rural land effectively improves farmers' economic income and the utilization rate of land resources. However, due to the lack of relevant laws and regulations, intermediary service organization backward and other reasons, seriously affected the circulation of rural land. All over the world, Switzerland, Japan, the United Kingdom, the United States and other countries have developed a relatively perfect land transaction system through continuous land system reform, but due to differences in history, culture, economy, etc. So that the mainland absorption of foreign land trading experience can not be used effectively. In the early stages of the land system reform in Taiwan and the mainland, the purpose of the reform was "the tiller has his land" advocated by Mr. Sun Zhongshan. At the same time, since the land system reform in Taiwan was relatively successful, Therefore, there is a strong reference for the mainland. This article mainly uses the literature analysis method, the interview method and the comparative method, through compares the mainland and Taiwan area land circulation system history, the experience, the present situation comparison, uses for reference its more mature land transaction experience, At the same time, aiming at the deficiency of the land transaction system in Taiwan, this paper puts forward some enlightenments from the land transaction system in Taiwan to the mainland. The full text is divided into seven chapters: firstly, through the previous land system reform in Taiwan and mainland China, the background and policy of the rural areas of the two sides of the Taiwan Strait are compared, and the similarities and differences in the social background, the purpose, the foundation and the content of the policy implementation are expounded. Secondly, the paper analyzes the current situation of cross-strait rural land transfer, describes the results and problems after the implementation of cross-strait rural land transfer system; thirdly, compares the experience of cross-strait rural land transfer. Finally, aiming at some problems in the circulation of rural land in mainland China, this paper puts forward the relevant enlightening significance combined with the relevant experience of Taiwan. In short, drawing on the relevant successful experiences in the rural land trading system in Taiwan, we should also see the deficiencies in rural land transactions in Taiwan, learn from each other's weaknesses, and avoid the same problems. It is beneficial to promote the continuous improvement of land circulation in rural areas of mainland China, to protect the rights and interests of farmers, to promote the development of agriculture, and to realize "Chinese Dream" of important practical significance.
