【摘要】：黨的十八大報(bào)告提出：“堅(jiān)持走中國(guó)特色新型工業(yè)化、信息化、城鎮(zhèn)化、農(nóng)業(yè)現(xiàn)代化道路,推動(dòng)信息化和工業(yè)化深度融合、工業(yè)化和城鎮(zhèn)化良性互動(dòng)、城鎮(zhèn)化和農(nóng)業(yè)現(xiàn)代化相互協(xié)調(diào),促進(jìn)工業(yè)化、信息化、城鎮(zhèn)化、農(nóng)業(yè)現(xiàn)代化同步發(fā)展”；安徽省秉承十八大精神,也對(duì)城鎮(zhèn)化發(fā)展提出了明確要求,新型城鎮(zhèn)化時(shí)代已經(jīng)到來(lái)。通過(guò)對(duì)我國(guó)城鎮(zhèn)化發(fā)展的回顧與梳理,可以發(fā)現(xiàn),統(tǒng)籌城鄉(xiāng)發(fā)展的難點(diǎn)在農(nóng)村,焦點(diǎn)則在用地,因此土地整理在四化同步建設(shè)中發(fā)揮著至關(guān)重要的作用。而我國(guó)農(nóng)村土地整理工作開(kāi)展的時(shí)間不長(zhǎng),加之我國(guó)土地類(lèi)型復(fù)雜,歷史遺留問(wèn)題多,在土地整理的政策層面和操作層面,都存在著很多的問(wèn)題,亦有很大的完善空間。本文就是在這種背景下,展開(kāi)了對(duì)土地整理折抵指標(biāo)的研究,從管控的角度,對(duì)安徽省現(xiàn)有的土地整理模式和政策作出梳理和剖析,以期為政策的完善提供幫助,為安徽省新型城鎮(zhèn)化建設(shè)做出貢獻(xiàn)。本文首先宏觀介紹了選題的研究背景,從新型城鎮(zhèn)化的發(fā)展需要、國(guó)家土地政策扶持、建設(shè)用地需求大、人地矛盾突出等幾個(gè)方面進(jìn)行了分析。其次,本文對(duì)土地整理活動(dòng)的國(guó)內(nèi)外研究進(jìn)行了梳理和歸納,為土地整理折抵指標(biāo)政策的制定尋求理論依據(jù)。本文的第三部分,總結(jié)了安徽省土地整理折抵指標(biāo)現(xiàn)行管控的實(shí)踐,選取了最具有安徽特色、最能代表安徽土地整理效果的“整村推進(jìn)”模式和“人地掛鉤”模式,分析了土地管控的問(wèn)題,試圖剖析問(wèn)題的癥結(jié)。安徽省現(xiàn)行的土地整理折抵政策主要依循的是2006年安徽省國(guó)土資源廳發(fā)布的《安徽省土地整理新增耕地折抵建設(shè)用地指標(biāo)管理暫行規(guī)定》。規(guī)定內(nèi)要求：“折抵指標(biāo)可以有償調(diào)劑使用。折抵指標(biāo)有償調(diào)出時(shí),其用作耕地占補(bǔ)平衡的補(bǔ)充耕地指標(biāo)同時(shí)調(diào)出。有償調(diào)劑遵循依法自愿,公平公開(kāi),市場(chǎng)運(yùn)作的原則,由省國(guó)土資源主管部門(mén)統(tǒng)一管理。折抵指標(biāo)有償調(diào)劑費(fèi)用,由雙方自行協(xié)商確定”。本文的第四部分就通過(guò)分析安徽省實(shí)行土地整理折抵指標(biāo)管控時(shí)出現(xiàn)的問(wèn)題,借鑒其他省市的經(jīng)驗(yàn),針對(duì)現(xiàn)行土地整理折抵政策在管控方面存在的問(wèn)題提出了相應(yīng)的建議。
[Abstract]:The report of the 18th National Congress of the CPC pointed out: "adhere to the road of new-type industrialization with Chinese characteristics, informatization, urbanization, agricultural modernization, promote the deep integration of informatization and industrialization, and promote benign interaction between industrialization and urbanization," Urbanization and agricultural modernization coordinate with each other to promote the simultaneous development of industrialization, information, urbanization and agricultural modernization "; Anhui Province, in keeping with the spirit of the 18th National Congress of the Communist Party of China, has also put forward clear requirements for the development of urbanization, and a new age of urbanization has arrived. Through reviewing and combing the development of urbanization in China, we can find that the difficulty of urban and rural development is in the countryside, and the focus is on land, so land consolidation plays a vital role in the simultaneous construction of the four modernizations. However, the rural land consolidation in our country has not been carried out for a long time. In addition, there are many problems in the policy level and operational level of land consolidation, and there is also a lot of room for improvement because of the complex types of land in our country and many problems left by history. Under this background, this paper has carried out the research on the index of land consolidation offset, combed and analyzed the existing land consolidation models and policies in Anhui Province from the angle of management and control, in order to provide help for the improvement of the policy. To make contribution to the construction of new urbanization in Anhui Province. This paper first introduces the research background of the topic macroscopically, from the development needs of new urbanization, the national land policy support, the large demand for construction land, the prominent contradiction between man and land, and so on. Secondly, this paper combs and sums up the domestic and international research on land consolidation activities, and seeks theoretical basis for the formulation of land consolidation offset index policy. In the third part of this paper, the author summarizes the practice of the current management and control of the land consolidation offset index in Anhui Province, and selects the "whole village advance" model and the "man and land linkage" model, which have the most Anhui characteristics and best represent the effect of land consolidation in Anhui Province. This paper analyzes the problem of land control and tries to analyze the crux of the problem. The current policy of land consolidation and offset in Anhui Province is mainly based on the interim provisions on the Management of the Indexes of Land consolidation and New cultivated Land offset for Construction in Anhui Province issued in 2006 by the Department of Land and Resources of Anhui Province. Requirements within the provisions: "the offset index may be paid to adjust the use." When the offset index is paid out, it is used as the supplementary cultivated land index in the balance of farmland occupation and compensation. The paid regulation follows the principle of voluntary, fair and open, market operation, and is managed by the department in charge of land and resources. The compensatory adjustment expenses shall be determined through consultation between the two parties themselves. " In the fourth part of this paper, through the analysis of the problems in the implementation of land consolidation offset index control in Anhui Province, using the experience of other provinces and cities for reference, the paper puts forward corresponding suggestions on the existing problems in the management and control aspects of the current land consolidation offset policy.
