地權的分割、轉移及其闡釋——基于傳統(tǒng)中國民間土地市場

【摘要】:引入現(xiàn)代法律特別是物權的概念來闡釋地權,在加深對地權復雜性的認識時,也帶來一些觀念上的繁復和混亂。本文基于傳統(tǒng)中國民間土地市場及其交易習慣,以"地權—地價或地租"這一解釋框架來闡釋地權,提出交易相關方能獲取部分或全部地價或地租,就視為占有部分或全部地權,地權的分割可以是非永久徹底的,不同地權的分割比例等于其地價比。本文還詳細分析了典、押租等不同的地權交易形態(tài)中地權分割和轉移的情況。
[Abstract]:The introduction of modern law, especially the concept of real right, to explain land rights, while deepening the understanding of the complexity of land rights, also brings some complex ideas and confusion. Based on the traditional Chinese folk land market and its trading habits, this paper uses the framework of "land ownership-land price or land rent" to explain land rights, and points out that some or all land price or land rent can be obtained by transaction related parties. As part or all of the land ownership, the division of land rights can not be permanent and thorough, the proportion of different land rights is equal to its land price ratio. This paper also analyzes the division and transfer of land ownership in different land ownership transaction forms.
