【摘要】：一國的土地產(chǎn)權制度是構成其生產(chǎn)關系和一切經(jīng)濟關系最基礎的制度基石。農(nóng)村土地產(chǎn)權制度的合理性安排,不僅關乎到農(nóng)村土地資源的高效配置,同時也影響著農(nóng)業(yè)產(chǎn)出與農(nóng)民收入增長的可持續(xù)性。土地產(chǎn)權即是土地的財產(chǎn)權利,主要包括所有、使用、處置、收益等他項權利。其中,所有權是基礎,使用權是核心,處置、收益權與使用權相互影響、制約。從物權的角度來看,由于各個權利主體在行使各自權利的動態(tài)過程中,相對分離或者多者重疊,但是它們形成的產(chǎn)權集合又共同影響著農(nóng)民收入。因此,本文研究了農(nóng)村土地的四項權利的變遷過程、現(xiàn)狀,并對當前存在的問題進行了主要分析。在對以上問題分析的基礎上,指出當前土地產(chǎn)權制度問題產(chǎn)生的根源正在于多種權利邊界界定不清楚,因此,有必要以確權作為土地產(chǎn)權制度改革的主要路徑。這也正是當前中央政府進行土地改革的一個重要方向�；趪�,文中土地確權是在所有權既定的前提下,以使用權為核心進行的權利確定,從而影響著土地的收益與處置權。對于土地使用權確權具體操作,文章將會結合廣東河源埔前鎮(zhèn)坪圍村的實際案例,從承包經(jīng)營權、宅基地使用權、集體建設用地使用權的三個方向給出建議。例如,對農(nóng)民合法擁有的承包經(jīng)營地、宅基地進行統(tǒng)一測量,保證面積明確,四至清楚,并給予確權、登記、頒發(fā)證書。同時,有必要建立信息化流轉服務平臺,以切實保障流轉交易雙方所簽署合約的法律效力。
[Abstract]:The land property right system of a country is the foundation stone of its production relations and all economic relations. The rational arrangement of rural land property rights system not only relates to the efficient allocation of rural land resources, but also affects the sustainability of agricultural output and farmers' income growth. Land property right is the property right of land, including ownership, use, disposal, income and other rights. Among them, the ownership is the foundation, the right to use is the core, the disposal, the income right and the right of use affect and restrict each other. From the point of view of real right, because of the relative separation or overlap in the dynamic process of each right subject exercising their respective rights, the property right set formed by them affects the farmers' income together. Therefore, this paper studies the change process and present situation of four rights of rural land, and mainly analyzes the existing problems. Based on the analysis of the above problems, it is pointed out that the root of the current land property rights system problem lies in the unclear definition of the boundary of various rights. Therefore, it is necessary to take the affirmative right as the main path of the reform of the land property right system. This is also an important direction for the central government to carry out land reform. Based on the national conditions, the right to confirm the land in this paper is the right to determine the right to use under the premise of the established ownership, thus affecting the income and disposal of the land. For the specific operation of the right to land use, the article will combine with the actual case of Pingwei Village in Pulqian Town, Heyuan, Guangdong Province, and give some suggestions from three directions: the right to contract management, the right to use the homestead, and the right to use the land for collective construction. For example, the farmers legally owned by the contract land, homestead unified measurement, to ensure clear area, four to clear, and given the right to confirm, registration, issuance of certificates. At the same time, it is necessary to establish information transfer service platform to ensure the legal effect of the contract signed by both parties.
