【摘要】：隨著新農(nóng)村建設(shè)如火如荼地進(jìn)行及城鎮(zhèn)化進(jìn)程的加快,統(tǒng)籌城鄉(xiāng)發(fā)展愈發(fā)引起人們的重視,作為其中重要一環(huán)的農(nóng)村土地問(wèn)題尤其是宅基地使用權(quán)流轉(zhuǎn)問(wèn)題,毫無(wú)疑問(wèn)引起了人們普遍的關(guān)注。當(dāng)前,就宅基地使用權(quán)的流轉(zhuǎn)問(wèn)題而言,我國(guó)立法上的基本態(tài)度是反對(duì)的,即嚴(yán)格限制宅基地使用權(quán)的流轉(zhuǎn)。在政策上限制宅基地在本集體經(jīng)濟(jì)組織外進(jìn)行流轉(zhuǎn)亦即允許農(nóng)民可以將宅基地當(dāng)作可流動(dòng)要素進(jìn)行流轉(zhuǎn),但對(duì)流轉(zhuǎn)主體作出了嚴(yán)格的限制。改革開(kāi)放以來(lái),我國(guó)經(jīng)濟(jì)發(fā)生重大變化,當(dāng)前的宅基地使用權(quán)流轉(zhuǎn)制度無(wú)論是從價(jià)值取向而言還是具體制度的設(shè)計(jì)而言,都已不適應(yīng)新農(nóng)村建設(shè)下農(nóng)村經(jīng)濟(jì)發(fā)展的現(xiàn)狀。因此,這篇文章在結(jié)合理論界定和結(jié)合現(xiàn)實(shí)生活中各地及全國(guó)對(duì)宅基地使用權(quán)流轉(zhuǎn)的現(xiàn)狀分析,經(jīng)過(guò)一系列理論和實(shí)踐的探究,不難得出我國(guó)宅基地使用權(quán)流轉(zhuǎn)制度具有極大的必要性及確切的可行性,最終從理論構(gòu)建及具體制度建設(shè)方面對(duì)我國(guó)宅基地使用權(quán)流轉(zhuǎn)制度建立方面提出了相關(guān)建議。
[Abstract]:With the construction of new countryside in full swing and the acceleration of urbanization process, people pay more and more attention to the coordinated development of urban and rural areas, as an important part of the rural land issue, especially the issue of the circulation of the right to use the homestead. There is no doubt that there is widespread concern. At present, as far as the circulation of homestead use right is concerned, the basic attitude of legislation in our country is opposed, that is, strictly restricting the circulation of homestead use right. The policy limits the circulation of the homestead outside the collective economic organization, that is, allowing the peasants to use the homestead as a mobile element, but the subject of the circulation is strictly restricted. Since the reform and opening up, great changes have taken place in the economy of our country. The current circulation system of the right to use the homestead has not adapted to the present situation of the rural economic development under the new rural construction, no matter in terms of the value orientation or the design of the specific system. Therefore, in combination with the theoretical definition and the analysis of the current situation of the circulation of the right to use the homestead in various parts of the country and the whole country in real life, this article has been explored through a series of theories and practices. It is not difficult to get the great necessity and the exact feasibility of the circulation system of the right to use the homestead in our country. Finally, the author puts forward some relevant suggestions on the establishment of the circulation system of the usufruct of the homestead in our country from the aspects of theoretical construction and concrete system construction.
