【摘要】：以"三權分置"地方實踐和相關政策性文件為依據(jù),厘析農(nóng)民(農(nóng)戶)承包權權利屬性的理論爭議,揭示農(nóng)民(農(nóng)戶)承包權的二元屬性,或為成員權,或為物權,并證成"三權分置"有兩類實現(xiàn)形式。以"三權分置"的政策目標要求和土地經(jīng)營權功能定位為起點,論證土地經(jīng)營權物權塑造的必要性,并從物權理論和立法技術兩個方面,證成土地經(jīng)營權物權塑造的可行性。在此基礎上,結合制度演進的一般方法論、規(guī)范調整對象、制度可塑性以及制度變革必要性等因素,進一步揭示"三權分置"制度實現(xiàn)的路徑依賴是立足于既存法制的適度制度創(chuàng)新。而適度創(chuàng)新的內容,則是解釋論語境下的集體成員權細致化表達和立法論視域下的土地經(jīng)營權物權塑造。
[Abstract]:Based on the local practice and relevant policy documents of "three rights division", this paper analyzes the theoretical dispute on the attributes of peasants'(farmers') contractual rights, and reveals the dualistic attributes of peasants'(peasant households) contracting rights, either as members' rights or as real rights. There are two kinds of realization forms of "three rights separate structure". Based on the policy objective and the function orientation of the land management right, this paper demonstrates the necessity of shaping the real right of the land management right, and proves the feasibility of the real right molding of the land management right from the two aspects of real right theory and legislation technology. On this basis, combining with the general methodology of institutional evolution, regulating the adjustment object, institutional plasticity and the necessity of institutional change, etc. It is further revealed that the path dependence of the realization of the system is based on the moderate institutional innovation of the existing legal system. The content of moderate innovation is the detailed expression of collective membership right in the context of interpretation and the creation of real right of land management right in the perspective of legislative theory.
