【摘要】：農(nóng)地配置機制市場化是創(chuàng)新和改革的目標,農(nóng)地所有者集體組織的主體資格有缺陷是現(xiàn)實。本文以此為立論基礎(chǔ)和前提,以黨的政策為指針,提出了農(nóng)地"兩權(quán)市場"的概念,在建立"兩權(quán)市場"過程中要對集體經(jīng)濟組織的法人治理結(jié)構(gòu)進行完善或改造,以落實農(nóng)地產(chǎn)權(quán)使其成為真正的市場主體。同時分析了農(nóng)地行政配置機制的弊端,闡述了市場機制的優(yōu)勢,也提出了建立"兩權(quán)市場’的路徑。肯定了"兩權(quán)市場"和三權(quán)分置是相容的。
[Abstract]:The marketization of farmland allocation mechanism is the goal of innovation and reform. This paper takes this as the basis and premise of the argument, taking the policy of the Party as the guide, puts forward the concept of "two power markets" of farmland, and in the process of establishing "two power markets", it is necessary to perfect or reform the corporate governance structure of collective economic organizations. In order to implement the farmland property right, it becomes the real market main body. At the same time, this paper analyzes the malpractice of the farmland administrative allocation mechanism, expounds the advantages of the market mechanism, and puts forward the way to establish the "two-right market". Affirmed that the "two power market" and the three power division is compatible.
