“三權分置”模式下農(nóng)地經(jīng)營權抵押問題研究

【摘要】:2014年中央一號文件在原有"兩權分離"的基礎上首次提出"三權分置",允許農(nóng)地經(jīng)營權抵押融資。農(nóng)地經(jīng)營權作為政策推動的一種新興事物,相關法律法規(guī)并沒有關于此種權利的規(guī)定,允許其進行抵押融資存在法律障礙和法理障礙。本文通過詳細的論述掃清農(nóng)地經(jīng)營權抵押的法理和法律障礙,使農(nóng)地經(jīng)營權抵押獲得正當性。首先,本文解讀了 "三權分置"改革大背景下有關允許農(nóng)地經(jīng)營權進行抵押的相關政策,農(nóng)地經(jīng)營權是一種隨著時代的發(fā)展應運而生的權利形式,它以土地承包經(jīng)營權為客體,本質(zhì)上是一種權利用益物權,通過此次政策的推動允許其進行抵押貸款,具有很大的現(xiàn)實意義。其次,農(nóng)地經(jīng)營權作為一種具有獨立性的用益物權,其性質(zhì)對推行農(nóng)地經(jīng)營權的發(fā)展具有重要的基礎性作用,所以探究其可抵押性及可發(fā)展性是邁出改革的重要一步,本文分析了農(nóng)地經(jīng)營權抵押與現(xiàn)行法律之間的沖突,即農(nóng)地經(jīng)營權這一物權種類未被法律明確列明,將推動改革政策與法律的發(fā)展相互匹配,是"三權分置"制度下發(fā)展農(nóng)地經(jīng)營權的解決路徑。再次,在剖析農(nóng)地經(jīng)營權抵押實踐中出現(xiàn)的問題的基礎上提出了農(nóng)地經(jīng)營權抵押的設定規(guī)則,即從設定主體到抵押登記方面探討農(nóng)地經(jīng)營權的設定規(guī)則。最后,為了探索農(nóng)地經(jīng)營權的實現(xiàn)途徑,本文從實現(xiàn)抵押權的條件及方式上作了相關闡述。
[Abstract]:On the basis of the original "separation of two rights", the No. 1 document of the Central Committee in 2014 proposed the "three separate rights" for the first time to allow the mortgage financing of agricultural land management rights. Farmland management right is a new thing promoted by policy. There are no regulations on this right in relevant laws and regulations, and there are legal obstacles and legal obstacles to allow it to carry out mortgage financing. In this paper, the legal principle and legal obstacle of farmland management right mortgage are cleared out in detail, so that the farmland management right mortgage can be justified. First of all, this paper interprets the related policies about allowing farmland management right to mortgage under the background of the reform of "three rights separate structure". The farmland management right is a kind of right form that arises at the historic moment with the development of the times. It is a kind of usufruct right, which is the object of the land contract management right. It is of great practical significance to allow it to carry out mortgage loan through the promotion of this policy. Secondly, as an independent usufructuary right, the nature of farmland management right plays an important and fundamental role in the development of farmland management right, so exploring its mortgage and expansibility is an important step of reform. This paper analyzes the conflict between the mortgage of farmland management right and the current law, that is, the kind of real right of farmland management right is not clearly listed by law, which will promote the reform policy and the development of the law to match each other. It is the solution to the development of farmland management right under the system of "three-right separation". Thirdly, on the basis of analyzing the problems existing in the practice of farmland management right mortgage, this paper puts forward the setting rules of farmland management right mortgage, that is, the setting rules of farmland management right from the aspect of setting subject to mortgage registration. Finally, in order to explore the way to realize the right of farmland management, this paper expounds the conditions and ways of realizing the right of mortgage.
