【摘要】：牡丹江作為黑龍江省的重要區(qū)域中心,其農(nóng)業(yè)發(fā)展是這個城市的主要支撐。在牡丹江城市發(fā)展的進程中,農(nóng)村的城市化進程是社會發(fā)展的必然結果,這意味著農(nóng)村土地不斷流轉為城市用地。這一趨勢對于整個地區(qū)的經(jīng)濟有著十分良好的促進作用,但我們不可否認在發(fā)展過程中其弊端也是十分明顯的。由于人口增多,有限供應的土地已不能滿足發(fā)展的需求,因此不斷出現(xiàn)農(nóng)村土地被征收的現(xiàn)象。土地作為農(nóng)民安身立命的根本,土地被征收則直接影響農(nóng)民的切身利益,土地征收補償制度維系著農(nóng)村社會的基本穩(wěn)定,所以理應在政策貫徹執(zhí)行和仲裁監(jiān)管等方面給予明確規(guī)定和保障。但是在農(nóng)村土地流轉的過程中又不可避免的出現(xiàn)了很多問題,其中最本質的問題在于農(nóng)村土地如何進行補償,怎樣的補償機制才能夠真正保障農(nóng)民的權利。土地補償機制主要是指土地征收補償機制,本文以牡丹江地區(qū)農(nóng)村土地征收補償機制為研究對象。共分為五個部分,第一部分為緒論部分,對本研究的背景、意義、國內外文獻綜述、研究的創(chuàng)新之處做了簡要的分析。第二部分為相關概念和基本理論部分,對本研究所要涉及的相關概念和理念進行歸納總結。第三部分為黑龍江省牡丹江市農(nóng)村土地補償機制的現(xiàn)狀分析。利用能夠收集到的年鑒資料以及政策資料對我國農(nóng)村土地補償機制的現(xiàn)狀和牡丹江市市農(nóng)村土地補償機制的現(xiàn)狀做了簡要分析。第四部分為牡丹江農(nóng)村土地補償機制的問題研究,主要分析了牡丹江農(nóng)村土地補償機制中存在的主要問題。包括:土地征用補償標準不夠完善、土地征收補償過程中的糾紛解決機制不夠完善以及征地后的農(nóng)民保障體系建設滯后三個主要問題。第五部分為牡丹江農(nóng)村土地補償機制的完善。是基于第三章以及第四章的討論,提出了相關的啟示和建議,包括建立更加完善的土地征用補償標準、建立土地補償糾紛解決機制,施行最低保護價機制、健全農(nóng)村社會保障體系等建議。以期為后續(xù)學者提供相關經(jīng)驗以及研究啟發(fā)。本文的研究有利于完善和健全當前我國農(nóng)村土地補償制度,促進農(nóng)村土地征收政策趨向合理化、法治化。通過本文的研究,深入的分析了牡丹江農(nóng)村土地征收補償政策存在的問題以及原因,并且針對性的提出了改進的對策和措施,強調應該進一步強化標準的公正性、合法性、公^u性、合理性和可執(zhí)行性;健全糾紛解決的方式、途徑、標準和保障機制;拓寬失地農(nóng)民就業(yè)途徑并完善農(nóng)民社會保障制。
[Abstract]:As an important regional center of Heilongjiang Province, Mudanjiang's agricultural development is the main support of this city. In the process of Mudanjiang's urban development, the process of urbanization in rural areas is the inevitable result of social development. This means that rural land continues to flow into urban land. This trend has a very good impact on the economy of the whole region, but we can't deny that its drawbacks are also very obvious in the process of development. The limited supply of land can no longer meet the needs of development. Therefore, the phenomenon of rural land expropriation is constantly appearing. As the root of farmers' life, land expropriation directly affects the vital interests of farmers. The system of land expropriation and compensation maintains the basic stability of rural society, so it should be clearly stipulated and protected in the aspects of policy implementation and arbitration supervision. However, many problems inevitably arise in the process of rural land circulation. The most essential problem lies in how to compensate rural land and what kind of compensation mechanism can truly protect the rights of farmers. The land compensation mechanism mainly refers to the compensation mechanism of land expropriation. This paper takes the compensation mechanism of rural land expropriation in Mudanjiang area as the research object. It is divided into five parts, the first part is the introduction, the background and significance of this study, the literature review at home and abroad. The innovation of the research is analyzed briefly. The second part is related concepts and basic theory. The third part is the analysis of the current situation of rural land compensation mechanism in Mudanjiang, Heilongjiang Province. The present situation of rural land compensation mechanism in Mudanjiang City and the present situation of rural land compensation mechanism in Mudanjiang City are briefly analyzed. Part 4th is a study on the compensation mechanism of rural land in Mudanjiang City. The main problems in the compensation mechanism of rural land in Mudanjiang are analyzed, including: the compensation standard of land expropriation is not perfect, In the process of land expropriation and compensation, the dispute resolution mechanism is not perfect and the construction of farmers' security system after land requisition lags behind. The 5th part is the perfection of Mudanjiang rural land compensation mechanism. It is based on the third chapter. And the discussion in Chapter IV, Some suggestions are put forward, including establishing more perfect land requisition compensation standard, establishing land compensation dispute resolution mechanism, and implementing the lowest protection price mechanism. The research in this paper is helpful to perfect and perfect the current rural land compensation system in China, and promote the rationalization of rural land expropriation policy. Through the research of this article, the paper analyzes the problems and causes of the rural land expropriation compensation policy in Mudanjiang, and puts forward the countermeasures and measures to improve it, and emphasizes that the fairness of the standard should be further strengthened. Legitimacy, commonality, rationality and enforceability; perfecting the ways, approaches, standards and security mechanisms of dispute resolution; widening the employment path of landless farmers and perfecting the peasant social security system.
