錫林浩特市房屋征收中的國有土地使用權補償問題研究

【摘要】:隨著我國城市化、工業(yè)化進程不斷加快與深化,舊城改造已成為城市化、工業(yè)化進程中的一個重要表現,城市房屋征收活動成為城市化進程中不可逾越的部分。大規(guī)模的舊城改造,項目集中,數量之多,使房屋征收問題成為關系社會穩(wěn)定與發(fā)展的焦點問題,其核心問題體現在補償方面。但由于我國現行的房屋征收補償制度存在著諸多問題,使得被征收人未能得到充分的補償。筆者認為,要想妥善解決好房屋征收補償問題,就要明確房屋征收補償的基本原則、具體范圍、確定標準等內容,對城市房屋征收中土地增值利益進行科學合理的分配,這對于建立一種合理有效的房屋征收補償制度起著基礎性作用。 首先,本文從闡述征收、房屋征收、公共利益、國有土地使用權的含義著手,分析了城市國有土地上房屋征收與補償的實質即國有土地使用權的收回問題。通過實地考察,選取具體案例,分析了錫林浩特市房屋征收管理體制和制度實施的現狀,在此基礎上進行案例分析,針對城市房屋征收補償中存在的問題探究房屋征收補償制度建設中的不足與缺位現象。其次,通過查閱大量文件文獻資料,結合《國有土地上房屋征收與補償條例》在錫林浩特地區(qū)的實施效果,提出房屋征收過程中國有土地使用權補償的理論依據、事實依據等依據。從房屋征收補償原則、補償范圍、補償標準等方面入手,,分析征收補償活動實施與執(zhí)行過程中存在的問題,厘清征收補償中房屋與土地的關系,尋求解決房屋征收補償活動中合理補償、科學分配城市土地增值利益的途徑,探討緩解房屋征收補償中利益沖突的措施,提出構建國有土地上房屋征收補償制度的設想與對策,進而推進城市建設健康發(fā)展,優(yōu)化城市土地利用結構,為城市房屋征收活動提出改進思路。
[Abstract]:With the urbanization of China, the process of industrialization has been accelerated and deepened, the transformation of the old city has become an important manifestation of urbanization, and the collection of urban housing has become an insurmountable part of the process of urbanization. The large-scale old city reconstruction, the project concentration, the quantity many, causes the housing collection question to become the social stability and the development focal point question, its core question manifests in the compensation aspect. However, there are many problems in the current housing expropriation compensation system in China, which makes the expropriated person unable to get adequate compensation. The author believes that in order to properly solve the problem of housing expropriation and compensation, it is necessary to clarify the basic principles, specific scope, determination of standards, and so on, so as to scientifically and reasonably distribute the land value-added benefits in urban housing expropriation. This plays a fundamental role in the establishment of a reasonable and effective housing collection and compensation system. First of all, this paper begins with the meaning of expropriation, housing expropriation, public interest and the right to use state-owned land, and analyzes the essence of the expropriation and compensation of houses on urban state-owned land, that is, the recovery of the right to use state-owned land. Through the field investigation, selected specific cases, analyzed the current situation of the housing collection management system and system implementation in Xilinhaote, on the basis of this case analysis, In view of the problems existing in the collection and compensation of urban housing, this paper probes into the deficiency and absence in the construction of the compensation system for the collection and compensation of housing. Secondly, through consulting a large number of documents and materials, combining with the implementation effect of the regulations on Housing expropriation and compensation on State-owned Land in Xilinhot area, the paper puts forward the theoretical basis for the compensation of the right to use state-owned land in the course of house expropriation. A factual basis, etc. From the aspects of the principle, scope and standard of compensation, this paper analyzes the problems existing in the implementation and implementation of the expropriation and compensation activities, and clarifies the relationship between housing and land in the process of expropriation and compensation. In order to solve the problem of reasonable compensation in housing expropriation and compensation activities, to scientifically distribute the value-added benefits of urban land, to explore the measures to alleviate the conflicts of interest in housing expropriation and compensation, and to put forward some tentative ideas and countermeasures to construct the compensation system for housing expropriation on state-owned land. Furthermore, it promotes the healthy development of urban construction, optimizes the structure of urban land use, and puts forward some improvement ideas for the collection of urban houses.
