行業(yè)協(xié)會承接政府審批職能研究

【摘要】:行政審批對我國社會經(jīng)濟發(fā)展發(fā)揮了重要作用,但是隨著社會發(fā)展,社會經(jīng)濟事務(wù)不斷增多,一直由政府主導的行政審批也出現(xiàn)了很多與經(jīng)濟社會發(fā)展不相適應(yīng)的弊端。 為了改正這些弊端,我國進行了多輪行政審批制度改革。改革的過程仍然存在很多問題。這些問題的解決需要第三方力量參與到行政審批制度改革中。 作為第三方力量,行業(yè)協(xié)會在收集行業(yè)信息、預判行業(yè)發(fā)展趨勢、行業(yè)專業(yè)化程度等方面比政府更有優(yōu)勢。行業(yè)協(xié)會承接行政審批的全部或者部分微觀管理職能,不僅能降低行政成本,而且能提高行政審批服務(wù)的質(zhì)量。 行業(yè)協(xié)會承接行政審批職能能夠?qū)π姓䦟徟贫雀母锲鸬酵苿幼饔,但是我國行業(yè)協(xié)會承接政府行政審批職能的實踐和研究剛剛起步,理論上探討仍不充分,實踐上沒有一套完善的運作模式。這就為行業(yè)協(xié)會承接行政審批制度改革創(chuàng)造了現(xiàn)實要求和理論需求。 從整體布局來看,本文共分為五個部分。第一部分主要是論述行業(yè)協(xié)會的基本概念以及承接行政審批職能的必要性、合理合法性,并且闡述本文的理論基礎(chǔ)。第二部分重點論述我國行業(yè)協(xié)會承接行政審批職能的基本情況,并以此為基礎(chǔ)分析行業(yè)協(xié)會承接政府職能所具有的優(yōu)勢。第三部分是針對阻礙行業(yè)協(xié)會承接行政審批職能達到理想效果的因素進行論述和總結(jié),并針對行業(yè)協(xié)會應(yīng)當發(fā)揮的理想效果進行分析。第四部分以介紹日本行業(yè)協(xié)會承接行政審批職能的管理體制機制為基礎(chǔ),探尋日本在推進行業(yè)協(xié)會承接政府審批職能方面的制度安排和具體機制,,為促進我國行業(yè)協(xié)會承接行政審批職能提供有益的借鑒。第五部分提出推動行業(yè)協(xié)會承接政府行政審批工作的針對性建議:加強行業(yè)協(xié)會自身建設(shè)、加快重點領(lǐng)域行政審批轉(zhuǎn)移政策措施、合理劃分轉(zhuǎn)移項目基本目錄、加快監(jiān)管體制機制建設(shè)、加快行業(yè)協(xié)會的法規(guī)體系建設(shè)等。
[Abstract]:The administrative examination and approval has played an important role in the social and economic development of our country, but with the social development, the social and economic affairs have been increasing, and the administrative examination and approval, which has been led by the government, has also appeared a lot of malpractices which are not suitable for the economic and social development. In order to correct these malpractices, our country has carried on many rounds of administrative examination and approval system reform. There are still many problems in the reform process. The solution of these problems requires the third party to participate in the reform of the administrative examination and approval system. As a third party, the trade association has more advantages than the government in collecting industry information, anticipating the development trend of the industry, and the degree of industry specialization. The trade association undertakes all or part of the micro-management functions of administrative examination and approval, which can not only reduce the administrative cost, but also improve the quality of the administrative examination and approval service. The trade association can promote the reform of the administrative examination and approval system. However, the practice and research of the industry association undertaking the administrative examination and approval function of the government is just beginning, so the theoretical discussion is still insufficient. In practice, there is no perfect operation model. This creates realistic requirements and theoretical requirements for trade associations to undertake the reform of the administrative examination and approval system. From the overall layout, this paper is divided into five parts. The first part mainly discusses the basic concept of the trade association and the necessity of undertaking the administrative examination and approval function, reasonable and legal, and expounds the theoretical basis of this article. The second part focuses on the basic situation of China's trade associations to undertake the administrative examination and approval function, and analyzes the advantages of the trade associations to undertake the functions of the government. The third part is to discuss and summarize the factors that hinder the trade association to undertake the administrative examination and approval function to achieve the ideal effect, and to analyze the ideal effect that the trade association should play. The fourth part is based on the introduction of the administrative examination and approval function of Japan's trade associations, and explores the institutional arrangements and specific mechanisms for Japan to promote the industry associations to undertake the functions of government examination and approval. In order to promote China's industry associations to undertake administrative examination and approval function to provide useful reference. The fifth part puts forward some suggestions to promote the trade association to undertake the administrative examination and approval work of the government: strengthen the construction of the trade association itself, accelerate the policy measures of administrative examination and approval transfer in the key areas, reasonably divide the basic catalogue of the transfer project, We will speed up the construction of the regulatory system and the legal system of trade associations.
