我國工程建設(shè)項(xiàng)目招投標(biāo)程序管理研究

【摘要】:目前,工程施工領(lǐng)域主要實(shí)行招投標(biāo)制,是工程項(xiàng)目主要承包方式之一,國內(nèi)外重大工程項(xiàng)目都是采用這種方式承包建設(shè)的。經(jīng)過多年發(fā)展,招標(biāo)投標(biāo)已成為一種十分成熟的工程項(xiàng)目發(fā)包模式,是工程市場成熟發(fā)展的重要標(biāo)志。它不僅可以為工程業(yè)主選擇最好的施工單位,還可以有效降低施工成本,,提高市場效率。招投標(biāo)制度主要具有公開、公平、公正、自由競爭的基本特征。 2000年《中華人民共和國招投標(biāo)法》實(shí)施以來,招投標(biāo)制度發(fā)揮著越來越積極的作用。實(shí)踐經(jīng)驗(yàn)告訴我們,招投標(biāo)制度是一種高效率的發(fā)包方式,是提高工程市場效率、優(yōu)化配置市場資源的有效手段。 在論文中本人首先介紹了國內(nèi)外招標(biāo)投標(biāo)活動(dòng)的研究現(xiàn)狀;闡述了對(duì)工程建設(shè)項(xiàng)目招標(biāo)投標(biāo)的基本概念;介紹了我國工程建設(shè)項(xiàng)目招標(biāo)投標(biāo)程序管理的現(xiàn)狀,包括我國工程建設(shè)項(xiàng)目招標(biāo)投標(biāo)制度的法律體系建設(shè)情況,在覆蓋范圍方面,改革開放以來,我國開展招投標(biāo)活動(dòng)的范圍不斷地?cái)U(kuò)大,至2004年全國覆蓋范圍達(dá)到95%以上;詳細(xì)介紹了我國工程建設(shè)項(xiàng)目招標(biāo)投標(biāo)的標(biāo)準(zhǔn)程序:招標(biāo)準(zhǔn)備階段、招標(biāo)實(shí)施階段、招標(biāo)定標(biāo)階段等三個(gè)階段的工作。重點(diǎn)剖析了我國工程建設(shè)項(xiàng)目招標(biāo)投標(biāo)程序管理的問題:招投標(biāo)法律體系存在漏洞(法律條文不明確、行政干預(yù)過大、法律建設(shè)滯后、對(duì)違法懲治不力),在執(zhí)行層面存在違法違規(guī)操作的現(xiàn)象(招標(biāo)人規(guī)避招標(biāo)、肢解發(fā)包、串通投標(biāo)、投標(biāo)人非法獲取中標(biāo)、招標(biāo)代理機(jī)構(gòu)不夠完善),招標(biāo)過程中的技術(shù)性問題(缺乏有效的資格預(yù)審方式、評(píng)標(biāo)方法的科學(xué)性、招標(biāo)文件缺乏規(guī)范性),工程建設(shè)項(xiàng)目招標(biāo)投標(biāo)活動(dòng)監(jiān)管缺位(招投標(biāo)監(jiān)督制度存在諸多缺陷與漏洞、對(duì)招投標(biāo)文件的審查不力、投標(biāo)人信用監(jiān)管缺位、評(píng)標(biāo)專家管理監(jiān)督體系不健全、監(jiān)督手段約束力較弱)等。 本文結(jié)合我國工程建設(shè)項(xiàng)目在實(shí)際實(shí)施過程中出現(xiàn)的各方面問題,對(duì)我國工程建設(shè)項(xiàng)目招標(biāo)投標(biāo)各階段程序管理進(jìn)行細(xì)致的分析,提出完善我國工程建設(shè)項(xiàng)目招標(biāo)投標(biāo)程序管理的建議:完善我國工程建設(shè)項(xiàng)目招投標(biāo)相關(guān)法律法規(guī)建設(shè),不斷提高市場信用水平的同時(shí)促進(jìn)法制建設(shè),為市場經(jīng)濟(jì)發(fā)展提供法律和信用支持,加大違法懲治力度;健全和完善招投標(biāo)工作程序,用規(guī)范的流程管理和信用監(jiān)督約束招投標(biāo)雙方的行為;加強(qiáng)對(duì)招標(biāo)代理機(jī)構(gòu)的監(jiān)管力度,提高招標(biāo)代理機(jī)構(gòu)的業(yè)務(wù)水平,用年審制淘汰不合格機(jī)構(gòu);完善投標(biāo)人資格預(yù)審制度,評(píng)審過程公開透明;從評(píng)標(biāo)區(qū)封閉、專家抽取保密、利害關(guān)系人回避、信息化評(píng)標(biāo)等方面加強(qiáng)評(píng)標(biāo)過程管理;健全招投標(biāo)監(jiān)管機(jī)制等。
[Abstract]:At present, the tendering system is mainly carried out in the field of engineering construction. It is one of the main contracting ways of engineering projects. The major projects both at home and abroad are contracted by this way. After years of development, tendering and bidding has become a very mature project package model and an important symbol of the mature development of the engineering market. It is believed that the project owners can choose the best construction units, and can effectively reduce the construction cost and improve the market efficiency. The bidding system has the basic characteristics of open, fair, fair and free competition.
Since the implementation of the bidding law of People's Republic of China in 2000, the bidding system has played a more and more active role. The practice experience tells us that the bidding system is an efficient way of issuing the contract, which is an effective means to improve the efficiency of the engineering market and optimize the allocation of market resources.
In this paper, I first introduced the research status of bidding activities at home and abroad, expounded the basic concepts of tendering and bidding for engineering construction projects, introduced the status of the management of bidding procedures in China's engineering construction projects, including the construction of the legal system of tendering and bidding system for construction projects in China, and covered the scope of the project. Since the reform and opening to the outside world, the scope of our country's bidding activities has been continuously expanded, and the coverage of China has reached more than 95% in 2004. The standard procedures for tendering and bidding for construction projects in China are introduced in detail: the stage of bidding preparation, the stage of bidding implementation, and the bidding stage in three stages. The project focuses on the analysis of China's engineering. The problems in the management of the bidding procedure of the construction project: there are loopholes in the legal system of bidding (the legal provisions are not clear, the administrative intervention is too big, the legal construction is lagging behind, and the illegal punishment is poor). There is a phenomenon of illegal and illegal operation on the level of execution. (the tenderer evade the bidding, dissolves the package, collude the tender, the bidder illegally obtains the winning bid, bidding instead of the bidding. The technical problems in the process of tendering (lack of effective prequalification method, scientific evaluation method, lack of standardization of bidding documents), lack of supervision in the supervision of tendering and bidding activities in construction projects (the supervision system of bidding and bidding exist many defects and leaky holes, poor examination of bidding documents and bidders' credit supervision ". Vacancy, imperfect management and supervision system of bids, weak supervision means, etc.
In the light of the various problems in the actual implementation of the project construction projects in China, this paper makes a detailed analysis of the procedures management of the various stages of the project construction projects in China, and puts forward some suggestions to improve the management of the bidding procedures of the project construction projects in China: to improve the legal construction of the bidding related to the bidding of the project construction projects in China. Set up, continuously improve the market credit level and promote the construction of the legal system, provide legal and credit support for the development of the market economy, increase the punishment of the law, improve the procedures of the bidding work, use the standardized process management and credit supervision to restrain the behavior of the two parties, strengthen the supervision of the bidding agency and improve the recruitment. The business level of the agency of the standard agency is eliminated by the annual trial system; the pre qualification system of the bidder is perfected and the evaluation process is open and transparent; the management of the bid evaluation process is strengthened from the closure of the bid evaluation area, the secrecy of the experts, the avoidance of the interested persons, the evaluation of information and so on, and the supervision mechanism of the bidding and bidding.
