公共采購(gòu)招投標(biāo)背景下利益相關(guān)者倫理行為模式與決策策略研究

【摘要】:招標(biāo)投標(biāo)是市場(chǎng)經(jīng)濟(jì)制度比較完善的國(guó)家在大宗貨物買(mǎi)賣(mài)、工程建設(shè)等領(lǐng)域普遍應(yīng)用的交易方式。招標(biāo)投標(biāo)也在我國(guó)經(jīng)濟(jì)建設(shè)領(lǐng)域內(nèi)逐漸推行,正發(fā)揮著越來(lái)越積極的作用。為了規(guī)范招標(biāo)投標(biāo)活動(dòng),我國(guó)分別于2000年1月1日頒布了《中華人民共和國(guó)招標(biāo)投標(biāo)法》、2012年2月1日頒布了《中華人民共和國(guó)招標(biāo)投標(biāo)法實(shí)施條例》,同時(shí),各部門(mén)及各省相應(yīng)制定了一系列的法規(guī)、標(biāo)準(zhǔn)和實(shí)施辦法,使招標(biāo)投標(biāo)活動(dòng)有章可循,有法可依。在市場(chǎng)競(jìng)爭(zhēng)日趨激烈的今天,招投標(biāo)中各利益相關(guān)者都希望在這場(chǎng)博弈活動(dòng)中獲得最大收益,所以,各方都會(huì)以自己的出發(fā)點(diǎn)和利益目標(biāo)來(lái)進(jìn)行活動(dòng),其行為模式也直接影響著招投標(biāo)各方的決策過(guò)程和效果。在市場(chǎng)許可的條件下,抓住影響招投標(biāo)決策的主要因素,建立和規(guī)范招投標(biāo)的管理機(jī)制,促使招投標(biāo)主體進(jìn)行合法、合規(guī)的市場(chǎng)競(jìng)爭(zhēng),這是本文欲解決的核心問(wèn)題。 本文從招投標(biāo)過(guò)程中利益相關(guān)者的行為過(guò)程入手,首先介紹“招投標(biāo)”、“利益相關(guān)者”、“倫理行為決策”等基本概念,建立起本文的基本理論體系,并提出本文的總體構(gòu)思框架;其次結(jié)合5個(gè)典型案例和訪談研究總結(jié)出各利益相關(guān)者倫理失范的表現(xiàn)形式和影響其倫理行為決策的主要變量,并對(duì)各主要變量的特征、維度及其關(guān)系進(jìn)行了驗(yàn)證;最后,通過(guò)情景實(shí)驗(yàn)的方式驗(yàn)證了構(gòu)恩模型中的主要變量之間的關(guān)系。本文梳理了影響招投標(biāo)過(guò)程的各種因素,探尋影響招投標(biāo)中利益相關(guān)者的主要因素,分析其倫理行為模式,使其在規(guī)范的倫理行為中實(shí)現(xiàn)各自利益和即期目標(biāo)。 本研究無(wú)疑有著重要的社會(huì)意義和現(xiàn)實(shí)意義。通過(guò)科學(xué)的研究結(jié)果,我們辨別出公共采購(gòu)招投標(biāo)活動(dòng)中的主要影響因素,理清了各主要因素之間的相關(guān)關(guān)系,從而進(jìn)一步規(guī)范招標(biāo)投標(biāo)活動(dòng)、維護(hù)公平競(jìng)爭(zhēng)的市場(chǎng)經(jīng)濟(jì)秩序、提高資源利用效率、降低交易成本,預(yù)防和遏制腐敗,具有積極的社會(huì)意義。同時(shí),我們以此為依據(jù),加強(qiáng)對(duì)招投標(biāo)活動(dòng)進(jìn)行有針對(duì)性的制度設(shè)計(jì),協(xié)助各利益相關(guān)者提高自身業(yè)務(wù)素質(zhì),加強(qiáng)自律,幫助企業(yè)提高自身綜合實(shí)力,有著十分現(xiàn)實(shí)的意義。
[Abstract]:Tendering and bidding is a widely used trading method in the fields of bulk goods trading, engineering construction and so on in countries with relatively perfect market economy system. Bidding and bidding is also gradually being carried out in the field of economic construction in our country. Is playing a more and more active role. In order to regulate the bidding activities, China promulgated the Law on bidding and bidding of the people's Republic of China on January 1st 2000 and regulations on the implementation of the Law on bidding and bidding of the people's Republic of China on February 1st 2012. At the same time, various departments and provinces formulated a series of laws and regulations accordingly. Standards and implementation methods, so that the bidding activities have rules to follow, there are laws to follow. In the increasingly fierce market competition today, all stakeholders in bidding hope to get the maximum benefit in this game activity, so, Each party will carry out its activities with its own starting point and interest goal, and its behavior pattern will directly affect the decision-making process and effect of the bidding parties. Under the condition of market permit, the main factors affecting the bidding decision will be grasped. To establish and standardize the management mechanism of bidding and to urge the subject of bidding to compete legally and legally in the market is the core problem to be solved in this paper. Starting with the behavior process of stakeholders in the process of bidding, this paper first introduces the basic concepts of "bidding", "stakeholder", "ethical behavior decision" and so on, establishes the basic theoretical system of this paper, and puts forward the overall conceptual framework of this paper. Secondly, combined with five typical cases and interviews, the paper summarizes the manifestation of ethical anomie of stakeholders and the main variables that affect their ethical behavior decision-making, and verifies the characteristics, dimensions and relationships of the main variables. The paper verifies the relationship between the main variables in the constitutive model by the way of situational experiment. This paper combs the various factors that affect the bidding process, explores the main factors that affect the stakeholders in bidding, and analyzes its ethical behavior model. In order to achieve their own interests and immediate goals in the normative ethical behavior. There is no doubt that this study has important social and practical significance. Through the scientific research results, we identify the main influencing factors in the public procurement bidding activities, and clarify the correlation between the main factors. Therefore, it is of positive social significance to further standardize the bidding activities, maintain the order of fair competition in the market economy, improve the efficiency of resource utilization, reduce transaction costs, prevent and contain corruption, and at the same time, we take this as the basis, It is of great practical significance to strengthen the system design of bidding activities, to assist stakeholders to improve their professional quality, to strengthen self-discipline and to help enterprises improve their comprehensive strength.
