【摘要】：改革開放以來,隨著我國城鎮(zhèn)化進程的逐步推進,地方政府不斷加大對土地的需求,征地拆遷已成為越來越普遍的社會現(xiàn)象。在我國,政府不僅是征地拆遷的執(zhí)行者,也是土地的實際擁有者。既是政策制定者又是參與者。這種現(xiàn)實使得政府在征地拆遷中,容易因為和自己利益相關而導致拆遷決策失誤。因此,政府如何在保護居民基本權益的基礎上,避免社會的各種矛盾、權衡各方的利益,具有非�，F(xiàn)實的意義。 有鑒于此,本課題從政府在征地拆遷中定位角色出發(fā),采取文獻研究、案例分析、規(guī)范性分析等方法,梳理征地拆遷的相關政策,剖析地方政府角色扮演的失范以及政府與被拆遷方之間的利益博弈,并從歷史經(jīng)驗缺乏等方面入手,對政府角色扮演失范的原因進行分析探討。同時,以冀州市和晉江市在城鎮(zhèn)化過程中“和諧拆遷”為例,探討如何從決策機制、補償機制、矛盾化解機制入手,轉變政府行為。最后,提出對策建議。 研究的主要結論如下：通過明確政府的角色定位,確保政府在公益拆遷中的主導地位,在商業(yè)拆遷中充當客觀的監(jiān)管者地位；通過改良集體土地征收機制、保障被拆遷人的補償權力機制、拓寬公眾參與機制等相關制度規(guī)范征地拆遷機制；通過加強公眾參與、程序透明、限制強拆和化解矛盾等方面著手,完善征地拆遷的制度。
[Abstract]:Since the reform and opening up, with the gradual advancement of the urbanization process in China, local governments have been increasing the demand for land, land requisition and demolition has become a more and more common social phenomenon in China. The government is not only the executive of land expropriation and demolition, but also the actual owner of land. It is not only a policy maker but also a participant. Therefore, how to protect the basic rights and interests of residents on the basis of the government, to avoid social contradictions, balance the interests of all parties. Has very realistic significance. In view of this, the subject from the role of the government in the land demolition, the use of literature research, case analysis, normative analysis and other methods, combing the land demolition related policies. This paper analyzes the local government role-playing anomie and the interest game between the government and the removed party, and analyzes the reasons of the government role-playing anomie from the historical experience. At the same time. Taking Jizhou and Jinjiang as an example, this paper discusses how to change government behavior from decision-making mechanism, compensation mechanism and conflict resolution mechanism. Finally, some suggestions are put forward. The main conclusions of the study are as follows: by clarifying the role of the government, to ensure the dominant position of the government in the demolition of public welfare, and to act as an objective regulator in the commercial demolition; Through improving the collective land expropriation mechanism, ensuring the compensation power mechanism of the removed person, widening the public participation mechanism and other relevant systems to standardize the land requisition and removal mechanism; Through strengthening public participation, transparent procedure, limiting forced demolition and resolving contradictions, the system of land requisition and removal is improved.
