【摘要】:隨著互聯(lián)網(wǎng)時(shí)代的快速到來,我國(guó)互聯(lián)網(wǎng)金融企業(yè)得到蓬勃發(fā)展;ヂ(lián)網(wǎng)金融企業(yè)是對(duì)傳統(tǒng)金融行業(yè)的創(chuàng)新,改變了原有金融行業(yè)的生態(tài)環(huán)境。與此同時(shí),互聯(lián)網(wǎng)金融在創(chuàng)新的過程中凸顯出許多問題,這是對(duì)傳統(tǒng)金融業(yè)的挑戰(zhàn),也是對(duì)包括銀行業(yè)、證券、保險(xiǎn)等傳統(tǒng)金融業(yè)的顛覆,不管是最早的余額寶還是現(xiàn)在大熱的P2P,再到最近興起的眾籌或者大數(shù)據(jù)基金,互聯(lián)網(wǎng)金融爆發(fā)式的發(fā)展已經(jīng)影響到了我們的經(jīng)濟(jì)生活;ヂ(lián)網(wǎng)金融風(fēng)險(xiǎn)—旦出現(xiàn)更是比傳統(tǒng)金融風(fēng)險(xiǎn)更為復(fù)雜。據(jù)網(wǎng)貸之家數(shù)據(jù)統(tǒng)計(jì)2016年12月我國(guó)問題平臺(tái)共3429家,新增問題平臺(tái)增長(zhǎng)率58.35%。這已經(jīng)折射出互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)的嚴(yán)重性。我國(guó)對(duì)互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)的監(jiān)管策略遠(yuǎn)落后于互聯(lián)網(wǎng)金融的發(fā)展速度,由此導(dǎo)致互聯(lián)網(wǎng)金融在發(fā)展過程中存在許多潛在性問題,給它的快速發(fā)展埋下隱患,如果不能妥善控制和防范互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)的發(fā)生,不僅影響我國(guó)金融業(yè)的有序發(fā)展,甚至影響國(guó)際市場(chǎng)的經(jīng)濟(jì)秩序。文章主要研究黑龍江省政府如何對(duì)互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)進(jìn)行監(jiān)管,運(yùn)用管理學(xué)、金融學(xué)的有關(guān)理論分析,簡(jiǎn)單介紹了互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)的內(nèi)涵、互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)的種類和互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)的特點(diǎn),著重研究黑龍江省互聯(lián)網(wǎng)金融在網(wǎng)絡(luò)支付、網(wǎng)絡(luò)借貸、眾籌融資和其他網(wǎng)絡(luò)融資等方面的監(jiān)管現(xiàn)狀。文章以互聯(lián)網(wǎng)金融參與者和互聯(lián)網(wǎng)金融消費(fèi)者為主線,挖掘黑龍江省政府在互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)監(jiān)管方面存在的主要問題,主要有地方性法律不健全、政府對(duì)科技風(fēng)險(xiǎn)的監(jiān)管手段落后、政府行業(yè)自律和行業(yè)協(xié)同效率不高和對(duì)消費(fèi)者權(quán)益保護(hù)不到位等問題,并詳細(xì)分析了存在問題的主要原因。通過美國(guó)、英國(guó)和法國(guó)等政府對(duì)互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)的監(jiān)管經(jīng)驗(yàn)借鑒,提出了黑龍江省政府在互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)的監(jiān)管中對(duì)策建議。包括完善黑龍江省地方性法律法規(guī)、構(gòu)建全方位立體的風(fēng)險(xiǎn)監(jiān)管體系、加快推進(jìn)黑龍江省互聯(lián)網(wǎng)金融信息技術(shù)安全建設(shè)、增加監(jiān)管人員的隊(duì)伍建設(shè)和加強(qiáng)互聯(lián)網(wǎng)金融消費(fèi)者的權(quán)益保護(hù)。希望文章的研究成果能為黑龍江省互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)的政府監(jiān)管提供理論依據(jù)及有益參考。
[Abstract]:With the rapid arrival of the Internet era, the Internet financial enterprises in China have been flourishing. Internet financial enterprises are the innovation of the traditional financial industry, which has changed the ecological environment of the original financial industry. Internet finance has highlighted many problems in the process of innovation. This is a challenge to the traditional financial industry, and it is also a subversion of the traditional financial sector, including banking, securities, insurance, and so on. Whether it was Yu'e Bao, the earliest, or P2P, which is now hot, to the recently rising crowdfunding or big data Foundation, The explosive development of Internet finance has affected our economic life. The emergence of Internet financial risk is more complicated than traditional financial risk. According to the data of Internet loan House, in December 2016, there were 3 429 problem platforms in our country. The growth rate of the new problem platform is 58.35. this has already reflected the seriousness of Internet financial risks. China's supervision strategy for Internet financial risks lags far behind the development of Internet finance. As a result, there are many potential problems in the development of Internet finance. If the risks of Internet finance can not be properly controlled and prevented, it will not only affect the orderly development of financial industry in China. Even affecting the economic order of the international market. This paper mainly studies how the Heilongjiang Provincial Government supervises the Internet financial risks, and introduces the connotation of the Internet financial risks by using the relevant theoretical analysis of management and finance. The types of Internet financial risks and the characteristics of Internet financial risks, focusing on the study of Internet finance in Heilongjiang Province in network payment, network lending, The article takes Internet financial participants and Internet financial consumers as the main line to explore the main problems of the Heilongjiang Provincial Government in the supervision of Internet financial risks. The main problems are that the local laws are not perfect, the government's regulatory measures for scientific and technological risks are backward, the government industry self-discipline and industry coordination efficiency is not high, and the protection of consumers' rights and interests is not in place. The main reasons for the problems are analyzed in detail. Through the experience of the governments of the United States, the United Kingdom and France on the supervision of Internet financial risks, The countermeasures and suggestions of Heilongjiang provincial government in the supervision of Internet financial risk are put forward, including perfecting the local laws and regulations of Heilongjiang Province, constructing a comprehensive and three-dimensional risk supervision system, Speed up the construction of Internet financial and information technology security in Heilongjiang Province, It is hoped that the research results of this paper can provide theoretical basis and useful reference for the government supervision of Internet financial risk in Heilongjiang Province.
