【摘要】：當(dāng)前,隨著我國經(jīng)濟(jì)的不斷深入發(fā)展,在全面建成小康社會(huì)大的背景之下,為科學(xué)謀劃好“十三五時(shí)期”扶貧開發(fā)工作,脫貧攻堅(jiān)戰(zhàn)已打響。作為扶貧開發(fā)的重要部分—地方性的扶貧開發(fā)相關(guān)條例備受社會(huì)關(guān)注�！顿F州省扶貧開發(fā)條例》(以下簡稱《條例》),針對貴州省內(nèi)扶貧開發(fā)的行為進(jìn)行法律規(guī)范,目的是加快省內(nèi)貧困區(qū)域的經(jīng)濟(jì)和社會(huì)發(fā)展,讓貧困主體脫貧,不斷縮小城鄉(xiāng)經(jīng)濟(jì)差距。但是,《條例》在實(shí)施過程中存在的問題也愈來愈明顯,政府履職權(quán)利義務(wù)的失衡,項(xiàng)目管理與當(dāng)下市場體系不符,項(xiàng)目資金整合能力有限,《條例》實(shí)施過程中忽視程序正義等等。對于現(xiàn)階段貴州省扶貧開發(fā)面臨的困境,從《條例》實(shí)施效果入手,從執(zhí)法的層面來解讀貴州省扶貧開發(fā)中的一些滯后的法律制度。本研究以黔東南州從江縣為視角,對《條例》實(shí)施以來扶貧開發(fā)的現(xiàn)實(shí)情況進(jìn)行實(shí)地調(diào)查研究以及對調(diào)查的數(shù)據(jù)進(jìn)行統(tǒng)計(jì)分析。通過這樣的方式來發(fā)現(xiàn)貴州省少數(shù)民族地區(qū)在扶貧開發(fā)中存在的問題,為《貴州省大扶貧條例》更好地實(shí)施提供借鑒經(jīng)驗(yàn),使得政府法定職責(zé)的履行、項(xiàng)目管理、資金管理和財(cái)政保障有機(jī)配合落到實(shí)處,從而,推動(dòng)貴州省扶貧開發(fā)工作的順利進(jìn)行,確保貴州省“后發(fā)趕超”的動(dòng)力。本文共分為四個(gè)部分來闡述。第一部分:是本文的引言部分,作者主要通過介紹貴州省扶貧開發(fā)的基本概況、《條例》對扶貧開發(fā)工作的影響與研究意義來分析并進(jìn)行闡述的。分析了我省扶貧開發(fā)與全國優(yōu)秀扶貧開發(fā)省市的差異、現(xiàn)有的我國關(guān)于扶貧開發(fā)的一些法律法規(guī)以及《條例》在實(shí)施過程中存在的問題。第二部分:作者主要介紹了的調(diào)研的情況,以黔東南州從江縣為視角,主要針對調(diào)研的目的、調(diào)研樣本選擇、調(diào)研經(jīng)過以及調(diào)研方法進(jìn)行了簡單的闡述,同時(shí)設(shè)定《條例》實(shí)施效果評(píng)估的目的與衡量實(shí)施效果的主要指標(biāo),保證了本報(bào)告調(diào)研樣本選擇的合理性以及科學(xué)性,使得調(diào)研結(jié)果具備說服力和政策指導(dǎo)力。第三部分:筆者主要概述了調(diào)研的基本情況,對調(diào)研數(shù)材做分析,得出初步的分析結(jié)論。通過對官方數(shù)據(jù)的分析以及實(shí)地調(diào)研數(shù)據(jù)的分析對黔東南州在《條例》實(shí)施過程中存在的問題展開討論,總結(jié)黔東南州扶貧開發(fā)的現(xiàn)狀以及面臨的問題。第四部分:主要是針對《條例》實(shí)施效果問題的反饋,提出推進(jìn)《條例》實(shí)施的幾點(diǎn)思考,在政府職責(zé)、項(xiàng)目管理、資金管理和扶貧程序上做文章,為下一步實(shí)施《貴州省大扶貧條例》提供經(jīng)驗(yàn)借鑒。
[Abstract]:At present, with the deepening development of our country's economy, under the background of building a well-off society in an all-round way, we should plan scientifically the work of poverty alleviation and development during the 13th Five-Year Plan period. As an important part of poverty alleviation and development, local regulations on poverty alleviation and development have attracted the attention of society. The Guizhou Provincial regulations on Poverty Alleviation and Development (hereinafter referred to as "regulations") are aimed at poverty alleviation and development in Guizhou Province. In order to regulate the law, The aim is to speed up the economic and social development of the poverty-stricken areas in the province, to lift the poor main bodies out of poverty, and to continuously narrow the economic gap between urban and rural areas. However, the problems existing in the implementation of the regulations are becoming more and more obvious, and the imbalance between the rights and obligations of the government in discharging its duties and duties has become increasingly evident. The project management is not in accordance with the current market system, the ability of project fund integration is limited, the procedural justice is ignored in the process of implementing the regulations, and so on. From the perspective of law enforcement, this study interprets some lagging legal systems in poverty alleviation and development in Guizhou Province. This study takes Congjiang County, Qiandongnan Prefecture, as a visual angle. Through the field investigation and analysis of the actual situation of poverty alleviation and development since the implementation of the regulations, and the statistical analysis of the survey data, we can find the problems existing in poverty alleviation and development in the minority areas of Guizhou Province through this way. To provide lessons for the better implementation of the "Guizhou Provincial regulations on Poverty Alleviation", so that the implementation of the statutory duties of the government, project management, capital management and financial security can be carried out in an organic manner, thus, To promote the smooth progress of poverty alleviation and development in Guizhou Province, and to ensure the motive force of "catching up and catching up" in Guizhou Province. This paper is divided into four parts to elaborate. The first part is the introduction of this paper. The author analyzes and expounds the basic situation of poverty alleviation and development in Guizhou Province, the influence of regulations on poverty alleviation and development work and the significance of research. The existing laws and regulations on poverty alleviation and development in China and the problems existing in the implementation of the regulations. Part two: the author mainly introduces the situation of the investigation, taking Congjiang County, Qiandongnan Prefecture, as a visual angle, mainly aiming at the purpose of the investigation. The research sample selection, the investigation process and the research method are simply expounded, and the purpose of the evaluation of the implementation effect of the regulations and the main indicators to measure the effect of the implementation are set at the same time. It ensures the rationality and scientific nature of the sample selection in this report, and makes the research results persuasive and policy guiding. The third part: the author mainly summarizes the basic situation of the investigation, and makes an analysis of the data. Through the analysis of official data and field investigation data, the problems existing in the implementation of the regulations in Qiandongnan Prefecture are discussed. Summary of the current situation and problems faced in poverty alleviation and development in Qiandongnan Prefecture. Part 4th: mainly aiming at feedback on the effect of the implementation of the regulations, putting forward some thoughts on how to promote the implementation of the regulations, the responsibilities of the government, and project management, Fund management and poverty alleviation procedures provide experience for the next implementation of Guizhou Provincial regulations on Poverty Alleviation.
