【摘要】：改革開放以來,我國(guó)建設(shè)工程招標(biāo)投標(biāo)事業(yè)發(fā)展迅速,招標(biāo)領(lǐng)域不斷擴(kuò)大,法規(guī)體系日益完善,行政監(jiān)督逐步加強(qiáng),招標(biāo)投標(biāo)已經(jīng)成為建設(shè)工程項(xiàng)目發(fā)承包的主要方式。但是,我們看到在工程建設(shè)領(lǐng)域,尤其在工程招標(biāo)投標(biāo)市場(chǎng)上,圍標(biāo)串標(biāo)、業(yè)績(jī)?cè)旒�、惡意投訴等違規(guī)現(xiàn)象屢見不鮮,嚴(yán)重?cái)_亂了正常的市場(chǎng)交易秩序,侵害了招投標(biāo)雙方的合法權(quán)益,造成國(guó)家和公眾利益的損失。 在國(guó)家大力倡導(dǎo)信息化建設(shè)的背景下,電子招標(biāo)投標(biāo)的應(yīng)用與發(fā)展,為建設(shè)行業(yè)主管部門強(qiáng)化建設(shè)市場(chǎng)監(jiān)管,懲治招標(biāo)投標(biāo)活動(dòng)中的違法違規(guī)行為提供了現(xiàn)代化的手段,是提高招投標(biāo)效率、降低交易成本、治理工程建設(shè)領(lǐng)域突出問題的重要舉措,也是落實(shí)中央懲治和預(yù)防腐敗長(zhǎng)效機(jī)制建設(shè)的一項(xiàng)重要任務(wù)。 本文從招標(biāo)投標(biāo)監(jiān)督管理和行業(yè)發(fā)展的角度,以建設(shè)工程電子招標(biāo)投標(biāo)系統(tǒng)及應(yīng)用為研究對(duì)象,研究了電子招標(biāo)投標(biāo)系統(tǒng)在建設(shè)和應(yīng)用過程中遇到的瓶頸性問題,結(jié)合作者自身參與電子招標(biāo)投標(biāo)系統(tǒng)建設(shè)和赴各地調(diào)研的經(jīng)歷,提出了相應(yīng)的解決措施。主要研究?jī)?nèi)容包括： 首先,介紹了研究背景、發(fā)展現(xiàn)狀及面臨的問題；其次,介紹了電子招標(biāo)投標(biāo)的研究現(xiàn)狀和國(guó)內(nèi)外經(jīng)驗(yàn),以及從經(jīng)驗(yàn)中得到的啟示；再次,在電子招標(biāo)投標(biāo)系統(tǒng)建設(shè)層面上,研究分析了電子招標(biāo)投標(biāo)系統(tǒng)的設(shè)計(jì)原則、技術(shù)構(gòu)架、實(shí)踐模式以及系統(tǒng)構(gòu)成等內(nèi)容；然后,針對(duì)電子招標(biāo)投標(biāo)系統(tǒng)應(yīng)用問題進(jìn)行專題研究,提出對(duì)策措施,并在招標(biāo)投標(biāo)電子化對(duì)市場(chǎng)各方主體的影響、政府在招標(biāo)投標(biāo)電子化過程中的作用、招標(biāo)投標(biāo)全過程電子監(jiān)管體系的構(gòu)建三方面進(jìn)行了重點(diǎn)分析和闡述；最后,對(duì)杭州市建設(shè)工程電子招標(biāo)投標(biāo)系統(tǒng)進(jìn)行實(shí)例研究,分析其系統(tǒng)構(gòu)成、運(yùn)行流程、監(jiān)管體系、做法和成效。
[Abstract]:Since the reform and opening up, bidding for construction projects in China has developed rapidly, the bidding field has been continuously expanded, the legal system has been increasingly improved, and administrative supervision has been gradually strengthened. Bidding and bidding has become the main way to contract construction projects. We see that in the field of engineering construction, especially in the bidding and bidding market for projects, irregularities such as surrounding bid strings, false performance, malicious complaints and so on are common, seriously disrupting the normal order of market transactions. It infringes the legitimate rights and interests of both bidding parties and results in the loss of national and public interests. The application and development of electronic bidding has provided modern means for the construction industry to strengthen the supervision of the construction market and punish the illegal and illegal activities in the bidding activities. It is an important measure to improve the efficiency of bidding, reduce the transaction cost and solve the outstanding problems in the field of engineering construction. It is also an important task for the implementation of the long-term mechanism construction of the central government to punish and prevent corruption. From the point of view of the supervision and management of bidding and the development of the industry, this paper studies the bottleneck problems encountered in the construction and application of the electronic bidding and bidding system in the construction and application of the electronic bidding system. Based on the author's experience of participating in the construction of electronic bidding and bidding system and conducting research in various places, the author puts forward corresponding solutions. The main research contents are as follows:. First, introduced the research background, the development present situation and the question which faces; secondly, introduced the electronic bidding research present situation and the domestic and foreign experience, as well as from the experience obtains enlightenment; again, in the electronic bidding and bidding system construction level, This paper studies and analyzes the design principles, technical framework, practice model and system composition of the electronic bidding and bidding system, and then makes a special study on the application of the electronic tendering and bidding system, and puts forward some countermeasures. And in the electronic bidding on the main market parties, the role of the government in the process of electronic tendering and bidding, the construction of the whole process of electronic supervision system has been analyzed and elaborated. This paper makes an example study on the electronic bidding system of Hangzhou construction project, and analyzes its system composition, operation flow, supervision system, practice and effect.
