【摘要】：隨著我國(guó)經(jīng)濟(jì)的快速發(fā)展,城市規(guī)模的不斷擴(kuò)大,城市基礎(chǔ)設(shè)施的需求越來越大,單純依靠政府已無法滿足需求。政府部門為緩解財(cái)政壓力,加大建設(shè)力度為公眾提供更快更優(yōu)質(zhì)的服務(wù)而引入了PPP模式。近年來,PPP模式在我國(guó)基礎(chǔ)設(shè)施領(lǐng)域得以較快發(fā)展,不僅涉及橋梁、隧道、供水供電等傳統(tǒng)公用事業(yè)領(lǐng)域,還延伸到醫(yī)院、學(xué)校及保障性住房等領(lǐng)域,國(guó)家也出臺(tái)了一系列政策鼓勵(lì)PPP模式的推行。但PPP模式在我國(guó)實(shí)際應(yīng)用與發(fā)展過程中出現(xiàn)了諸多問題,PPP項(xiàng)目失敗的案例屢見不鮮,其中由于PPP項(xiàng)目的準(zhǔn)公共產(chǎn)品性和壟斷性等特性決定其與公眾利益息息相關(guān)并導(dǎo)致公眾利益受到損害的情況發(fā)生,引起公眾不滿,甚至引發(fā)社會(huì)矛盾與沖突,造成極為不好的社會(huì)影響,因此在國(guó)內(nèi)PPP項(xiàng)目的實(shí)施過程中,如何確保項(xiàng)目相關(guān)公眾利益的有效實(shí)現(xiàn)以成為無法回避的關(guān)鍵性問題。該論文分析了PPP模式的概念及特性,結(jié)合公眾利益的概念及特征,得出PPP項(xiàng)目公眾利益的內(nèi)涵,作為研究公眾利益保障的理論依據(jù)。同時(shí)該論文對(duì)PPP項(xiàng)目的合約主體與合約關(guān)系進(jìn)行了研究,使基于合約關(guān)系視角進(jìn)行PPP項(xiàng)目公眾利益保障問題的研究成為可行。該論文通過一些典型PPP項(xiàng)目的案例研究,分析PPP項(xiàng)目公眾利益受到損害的現(xiàn)狀,并從合約主體與合約關(guān)系兩個(gè)視角剖析了該現(xiàn)狀發(fā)生的原因。在此基礎(chǔ)上針對(duì)現(xiàn)狀發(fā)生的原因,提出政府公共部門、私營(yíng)合作伙伴等PPP項(xiàng)目合約主體進(jìn)行公眾利益保障的相關(guān)思路和合約主體在構(gòu)建合約關(guān)系過程中保障公眾利益實(shí)現(xiàn)的對(duì)策與建議。
[Abstract]:With the rapid development of our economy and the expansion of urban scale, the demand for urban infrastructure is increasing, and it is impossible to meet the demand by relying solely on the government. The PPP model was introduced to relieve financial pressure and provide faster and better service to the public. In recent years, the PPP model has developed rapidly in the field of infrastructure in China. It not only involves traditional public utilities such as bridges, tunnels, water supply and power supply, but also extends to hospitals, schools and affordable housing. The country also issued a series of policies to encourage the implementation of the PPP model. However, there are many problems in the application and development of PPP model in China. Due to the quasi-public goods and monopoly characteristics of the PPP project, it is closely related to the public interest and leads to the damage of the public interest, causing public dissatisfaction, and even social contradictions and conflicts. Therefore, how to ensure the effective realization of the public interests of the PPP project is an unavoidable key issue in the implementation of PPP projects in China. This paper analyzes the concept and characteristics of the PPP model, combines the concept and characteristics of the public interest, obtains the connotation of the public interest of PPP project, as the theoretical basis for the research of the public interest protection. At the same time, this paper studies the contract subject and contract relationship of PPP project, which makes it feasible to study the protection of public interest in PPP project from the perspective of contract relationship. Through some typical PPP project case studies, this paper analyzes the current situation of public interest damage in PPP project, and analyzes the causes of the situation from the perspective of contract subject and contract relationship. On this basis, in view of the causes of the current situation, the paper puts forward the government public sector, Private partner and other PPP project contract subjects to protect the public interests of the relevant ideas and contract subjects in the process of building a contract relationship to protect the public interest in the realization of countermeasures and suggestions.
