中國(guó)(上海)自由貿(mào)易試驗(yàn)區(qū)建設(shè)及其跟進(jìn)研究

【摘要】:中國(guó)經(jīng)濟(jì)經(jīng)過(guò)三十多年的高速增長(zhǎng)以后,進(jìn)入了新常態(tài)。與經(jīng)濟(jì)新常態(tài)相適應(yīng),中國(guó)對(duì)外貿(mào)易的體制、結(jié)構(gòu)、模式、格局必須做出相應(yīng)的調(diào)整。為了吸收世界自由貿(mào)易區(qū)建設(shè)的成功經(jīng)驗(yàn),深化中國(guó)外貿(mào)體制改革,探索中國(guó)對(duì)外貿(mào)易的新途徑、新模式,對(duì)新政策進(jìn)行試驗(yàn),經(jīng)中央決定,國(guó)務(wù)院批準(zhǔn),中國(guó)于2013年9月設(shè)立了中國(guó)(上海)自由貿(mào)易試驗(yàn)區(qū)。2014年12月,國(guó)務(wù)院又批準(zhǔn)設(shè)立了三個(gè)新的自貿(mào)試驗(yàn)區(qū)。對(duì)中國(guó)(上海)自由貿(mào)易試驗(yàn)區(qū)及其跟進(jìn)進(jìn)行研究,不僅具有重要的理論意義,而且具有重要的實(shí)踐意義。本文首先對(duì)世界主要自由貿(mào)易區(qū)的基本概況進(jìn)行了分析,包括中國(guó)香港、荷蘭鹿特丹、新加坡等。分析了其設(shè)立的歷史背景、發(fā)展過(guò)程及不同特點(diǎn)。根據(jù)自由貿(mào)易區(qū)功能的不同,自由貿(mào)易區(qū)可劃分為五種類型,即自由港型、出口加工型、貿(mào)工結(jié)合型、保稅倉(cāng)儲(chǔ)型、綜合型。他山之石,可以攻玉。本部分的研究重點(diǎn)是自由貿(mào)易區(qū)設(shè)立的條件及其成功運(yùn)行的經(jīng)驗(yàn)。中國(guó)(上海)自由貿(mào)易試驗(yàn)區(qū)的設(shè)立是一件新生事物,其意義自不待言。本文重點(diǎn)研究了中國(guó)(上海)自由貿(mào)易試驗(yàn)區(qū)所試點(diǎn)的投資管理制度、貿(mào)易監(jiān)管制度、金融創(chuàng)新制度、事中事后監(jiān)管制度。同時(shí),研究了這些制度出臺(tái)的經(jīng)濟(jì)背景及各種因素考量。研究表明,在試驗(yàn)區(qū)采取的管理制度具有三種特性:世界普遍性、國(guó)際先進(jìn)性、中國(guó)創(chuàng)新性。本文的跟進(jìn)研究有兩層含義:一是對(duì)國(guó)家新設(shè)立的三個(gè)自由貿(mào)易試驗(yàn)區(qū)——中國(guó)(廣東)自由貿(mào)易試驗(yàn)區(qū)、中國(guó)(天津)自由貿(mào)易試驗(yàn)區(qū)、中國(guó)(福建)自由貿(mào)易試驗(yàn)區(qū)進(jìn)行研究,本文認(rèn)為,這三個(gè)新設(shè)立的自由貿(mào)易試驗(yàn)區(qū)是對(duì)中國(guó)(上海)自由貿(mào)易試驗(yàn)區(qū)的跟進(jìn),作者把它們稱為第一梯隊(duì);二是對(duì)正在積極申報(bào)自由貿(mào)易試驗(yàn)區(qū)的地區(qū)進(jìn)行了分析,本文認(rèn)為,除了這三個(gè)新設(shè)的自由貿(mào)易試驗(yàn)區(qū),國(guó)家還可能把試驗(yàn)范圍擴(kuò)大,會(huì)批準(zhǔn)新的自由貿(mào)易試驗(yàn)區(qū),作者把它們稱為第二梯隊(duì)。但誰(shuí)會(huì)進(jìn)入第二梯隊(duì),既是全國(guó)注目的焦點(diǎn),也是各省競(jìng)爭(zhēng)的目標(biāo)。第一梯隊(duì)擔(dān)負(fù)著兩大任務(wù),一是面上的擴(kuò)大,二是對(duì)中國(guó)(上海)自由貿(mào)易試驗(yàn)區(qū)的完善、深化與補(bǔ)充。本文分析了第一梯隊(duì)三個(gè)試驗(yàn)區(qū)的試驗(yàn)特點(diǎn)與目標(biāo)指向。本文認(rèn)為,除了試驗(yàn)政策重點(diǎn)不同外,三個(gè)試驗(yàn)區(qū)的目標(biāo)指向也有所不同。中國(guó)(廣東)自由貿(mào)易試驗(yàn)區(qū)的目標(biāo)指向是如何銜接對(duì)港澳貿(mào)易,中國(guó)(天津)自由貿(mào)易試驗(yàn)區(qū)的目標(biāo)指向除了承擔(dān)京津冀協(xié)同發(fā)展戰(zhàn)略外,重點(diǎn)發(fā)展航運(yùn)及有關(guān)的融資租賃業(yè)務(wù)。而中國(guó)(福建)自由貿(mào)易試驗(yàn)區(qū)的目標(biāo)指向是如何銜接對(duì)臺(tái)貿(mào)易。目前進(jìn)入第二梯隊(duì)的是七個(gè)省(直轄市),他們是遼寧、河北、山東、浙江、湖北、重慶、廣西。由于遼寧大連、河北曹妃甸、山東青島、浙江舟山、湖北武漢、重慶兩江新區(qū)、廣西北部灣均有設(shè)立自由貿(mào)易試驗(yàn)區(qū)的條件與優(yōu)勢(shì),這些省(直轄市)正在積極為下一輪的申報(bào)做準(zhǔn)備。作者認(rèn)為,雖然第二梯隊(duì)多達(dá)七個(gè),但全被劃入試驗(yàn)區(qū)的可能性不大。在這七個(gè)中,最有可能劃入試驗(yàn)區(qū)的也就是三到四個(gè)。誰(shuí)將被劃入試驗(yàn)區(qū),既取決于中央政府與地方政府的考量,也取決于中央政府與地方政府的博弈。作者運(yùn)用博弈論的觀點(diǎn),對(duì)中央政府與地方政府在這一議題上的博弈進(jìn)行了分析。得出結(jié)論:下一輪的試驗(yàn)區(qū)最有可能落在山東青島、重慶兩江新區(qū)及廣西北部灣。文章的最后部分是政策建議,分兩個(gè)層次,對(duì)已經(jīng)批準(zhǔn)的試驗(yàn)區(qū),作者的建議是:正確把握自貿(mào)試驗(yàn)區(qū)的戰(zhàn)略定位,完善戰(zhàn)略規(guī)劃;完善管理體制,加強(qiáng)法制建設(shè);完善負(fù)面清單模式;把握好改革與風(fēng)險(xiǎn)的關(guān)系。對(duì)正在申報(bào)的試驗(yàn)區(qū),作者的建議是:推動(dòng)建立完備的自由貿(mào)易試驗(yàn)區(qū)法律體系;推動(dòng)制定優(yōu)惠政策;加快管理體制改革。
[Abstract]:After more than 30 years of high-speed growth, the Chinese economy has entered a new normal state. The system, structure, model and pattern of China's foreign trade must be adjusted accordingly. In order to absorb the successful experience of the construction of the free trade area in the world, to deepen the reform of China's foreign trade system, to explore a new way and a new model of China's foreign trade, to test the new policy, and through the central decision and the approval of the State Council, China established the China (Shanghai) Free Trade Experimental Zone in September 2013. In December 2014, the State Council also approved the establishment of three new self-trade test areas. The study on the free-trade test area of China (Shanghai) and its follow-up, not only has important theoretical significance, but also has important practical significance. This paper first analyses the basic general situation of the world's main free trade area, including Hong Kong, China, Rotterdam, Singapore and so on. The historical background, the development process and the different characteristics of its establishment are analyzed. According to the function of free trade area, free trade area can be divided into five types, namely, free port type, export processing type, trade union type, bonded warehouse type and comprehensive type. The stone of his mountain can be used to attack the jade. The focus of this part is the conditions set up by the Free Trade Area and the experience of its successful operation. The establishment of the free-trade test area in China (Shanghai) is a new thing, and its significance is not to be spoken. This paper focuses on the investment management system, the trade supervision system, the financial innovation system and the post-post supervision system in China (Shanghai) free trade test area. At the same time, the economic background and various factors of these systems are studied. The research shows that the management system adopted in the test area has three characteristics: universal, advanced and innovative in China. The follow-up study of this paper has two meanings: one is to study the free-trade test area of China (Guangdong), the free-trade test area of China (Tianjin), the free-trade test area of China (Fujian) and the free-trade test area of China (Fujian). The three newly established free-trade test areas are follow-up to the free-trade test area of China (Shanghai), and the authors call them the first echelon, and the second is to analyze the region in which the free-trade test area is being actively declared. In addition to the three new free-trade test areas, it is possible for the State to expand the scope of the test and to ratify the new free-trade test area, which the authors call the second echelon. But who will enter the second echelon is not only the focus of the country's attention, but also the goal of the province's competition. The first echelon has two main tasks, one is the expansion of the face, and the second is to improve, deepen and supplement the free-trade test area of China (Shanghai). In this paper, the characteristics of the three experimental areas of the first echelon are analyzed and the target points are pointed out. In this paper, the target orientation of the three experimental areas is different, except that the experimental policy is different. The aim of the free-trade test area in China (Guangdong) is to connect to the trade of Hong Kong and Macao. The goal of the free-trade test area of China (Tianjin) is to focus on the development of shipping and related financing lease business, in addition to the development strategy of Beijing-Tianjin-Hebei. And the goal of the free-trade test area in China (Fujian) is how to connect to the Taiwan trade. At present, the second echelon is seven provinces (municipalities directly under the Central Government). They are Liaoning, Hebei, Shandong, Zhejiang, Hubei, Chongqing and Guangxi. Due to the conditions and advantages of the establishment of free trade test area in Dalian, Hebei, Caofeidian, Qingdao, Zhoushan, Hubei, Wuhan and Chongqing, the Beibu Gulf of Guangxi has the conditions and advantages of establishing free trade test area, and these provinces (municipalities directly under the Central Government) are actively preparing for the next round of declaration. The author holds that, although the second echelon has as many as seven, it is unlikely that the whole area will be classified as a test area. Of these seven, three to four are most likely to be included in the test area. Who will be included in the test area depends on the central government's consideration of the local government, and also on the game between the central government and the local government. The author uses the game theory to analyze the game between the central government and the local government. It is concluded that the next round of test area is most likely to fall in Qingdao, Chongqing, Chongqing and Beibu Gulf of Guangxi. The last part of the article is the policy suggestion, which is divided into two levels. The author's suggestion is to correctly grasp the strategic position of the self-trade test area, to improve the strategic planning, to improve the management system and to strengthen the legal system, and to perfect the negative list mode; Grasp the relationship between the reform and the risk. The author's suggestion is to promote the establishment of a complete legal system of free-trade test area, to promote the development of preferential policies and to accelerate the reform of the management system.
