【摘要】：受到我國城市發(fā)展水平、社會(huì)就業(yè)等多種因素的影響,城市流動(dòng)商販問題一直是我國各大城市在進(jìn)行城市管理過程中所面臨的主要問題這一。城市流動(dòng)商販的管理一方面涉及到城市市容市貌、公共安全、衛(wèi)生與社會(huì)秩序等問題,另一方面也涉及到民生與活躍市場經(jīng)濟(jì)的問題。如何科學(xué)把握城市流動(dòng)商販的“禁與放”問題,成為城市化進(jìn)程中必須考慮的內(nèi)容。本文以泉州市市區(qū)流動(dòng)商販的管理問題為研究對象,首先對國內(nèi)外在流動(dòng)商販管理上的研究現(xiàn)狀進(jìn)行總結(jié)概述,提煉出有益于本文研究的相關(guān)成果。同時(shí),對本文研究中所需要使用到的理論進(jìn)行闡述說明,以為下文的分析提供理論準(zhǔn)備。文章在分析泉州市區(qū)流動(dòng)商販的管理現(xiàn)狀的基礎(chǔ)上,對泉州市區(qū)流動(dòng)商販管理主體、管理模式進(jìn)行了分析,認(rèn)為通過市、區(qū)以及街道等各級政府有關(guān)部門的整治管理后,泉州市區(qū)流動(dòng)商販的隨意占道經(jīng)營行為有了較大改善,造成的各類民事糾紛與刑事案件數(shù)量均明顯下降,群眾的滿意對也有所提升。但目前泉州市區(qū)流動(dòng)商販管理仍然存在你抓我躲,你走我擺的“貓鼠”困境,暴力抗法與暴力執(zhí)法時(shí)有發(fā)生,運(yùn)動(dòng)式執(zhí)法治標(biāo)不治本,社會(huì)輿論同情弱勢群體也讓城市管理者在管理流動(dòng)商販時(shí)處于輿論被動(dòng)。造成泉州市區(qū)流動(dòng)商販管理問題產(chǎn)生的原因在于包括主體因素、客體因素、環(huán)境因素。針對上述問題,本文在總結(jié)國內(nèi)外的城市流動(dòng)商販管理經(jīng)驗(yàn)的基礎(chǔ)上,認(rèn)為促進(jìn)泉州市市區(qū)流動(dòng)商販管理水平的提升,可以從:轉(zhuǎn)變流動(dòng)商販管理理念,完善泉州市流動(dòng)商販管理的法律體系,加強(qiáng)對流動(dòng)商販集聚區(qū)的視頻監(jiān)控,強(qiáng)化公共服務(wù)引導(dǎo)組建自律組織等方面進(jìn)行改進(jìn)。
[Abstract]:Influenced by many factors, such as the level of urban development, social employment and so on, the problem of mobile traders in cities is always the main problem in the process of urban management. On the one hand, the management of urban mobile vendors involves the city appearance, public safety, public health and social order, on the other hand, it also involves the livelihood of the people and the active market economy. How to scientifically grasp the problem of "prohibition and release" of urban mobile traders has become the content that must be considered in the process of urbanization. In this paper, the management of mobile vendors in Quanzhou City as the research object, first of all, at home and abroad in the management of mobile vendors summarized the status quo, extract the relevant results beneficial to this study. At the same time, the theory needed in this study is explained to provide theoretical preparation for the following analysis. Based on the analysis of the current situation of the management of mobile vendors in Quanzhou urban area, this paper analyzes the main body and mode of management of mobile vendors in Quanzhou urban area, and thinks that through the regulation and management of the relevant government departments at all levels, such as city, district and street, etc., The haphazard business behavior of mobile traders in Quanzhou city has been greatly improved, resulting in a significant decline in the number of civil disputes and criminal cases, and the satisfaction of the masses has also been improved. However, at present, there are still mobile vendors in Quanzhou urban area. You take me to hide, you walk through my "cat and mouse" dilemma, violence against the law and violent law enforcement occur from time to time, and sports law enforcement does not cure the symptoms at all. Public opinion sympathizes with the weak groups and makes city managers passive in managing mobile vendors. The causes of the management problems of floating traders in Quanzhou city include subject factor, object factor and environment factor. In view of the above problems, based on the summary of the management experience of mobile vendors at home and abroad, this paper thinks that to promote the management level of mobile vendors in Quanzhou City, we can change the management concept of mobile vendors. Improve the legal system of mobile vendors management in Quanzhou, strengthen the video surveillance of mobile vendors gathering area, strengthen the public service to guide the establishment of self-discipline organizations and so on.
