我國網(wǎng)上銀行被盜案中的責任淺析及改進建議

【摘要】:互聯(lián)網(wǎng)的普及應(yīng)用,觸發(fā)了網(wǎng)上銀行的發(fā)展,網(wǎng)上業(yè)務(wù)的興起促使金融貿(mào)易發(fā)展更加方便、高效,金融服務(wù)向著更加人性化和智能化的方向發(fā)展。我國雖然傳統(tǒng)業(yè)務(wù)發(fā)展已經(jīng)基本與世界同步,但是網(wǎng)上銀行業(yè)務(wù)仍然相對薄弱。經(jīng)過十幾年的發(fā)展,我國的網(wǎng)上銀行業(yè)務(wù)取得了長足進步,但也產(chǎn)生了較多問題,網(wǎng)上銀行被盜即為較嚴重的問題之一。本文通過對目前網(wǎng)上銀行典型案例,分析我國網(wǎng)上銀行被盜而發(fā)生財產(chǎn)損失后,如何在銀行和存款人之間確定權(quán)利義務(wù)界限、分配舉證責任,通過揭示當前我國法律制度的不足,提出完善我國網(wǎng)上銀行案件解決和案件當事人利益均衡分配的一己之見。本文正文由四個部分組成:第一部分導論通過介紹網(wǎng)上銀行發(fā)展背景、發(fā)展現(xiàn)狀引導出本文探討問題及釋義,總結(jié)國外、國內(nèi)立法研究現(xiàn)狀。本文試圖通過對當前網(wǎng)上銀行被盜案件的分析,歸納出此類案件爭議的焦點,進一步剖析當前我國法律針對網(wǎng)上銀行非正常授權(quán)業(yè)務(wù)責任分配的現(xiàn)狀,指出我國當前法律法規(guī)存在內(nèi)容與邏輯上的不足。第二部分案例、問題及其成因首先簡要介紹網(wǎng)上銀行案件事實和存在的法律問題爭議焦點,從案例梳理出現(xiàn)今我國網(wǎng)上銀行被盜案件損失確定和舉證責任分配的現(xiàn)狀,其次細致分析產(chǎn)生該種糾紛現(xiàn)狀的原因,最后再針對存在的爭議焦點分析現(xiàn)行法律制度的不足和盲點。第三部分制度改革與完善的建議通過六個方面、有針對性的對我國網(wǎng)上銀行內(nèi)部控制和法律制度完善提出了較為中肯的建議。闡述現(xiàn)行法律制度框架下重構(gòu)的舉證責任配置,進一步釋明當前網(wǎng)上銀行應(yīng)從保護消費者角度對責任分配進行傾斜分配,并進一步完善充實電子銀行類法律法規(guī)。第四部分擴展性討論在前文論述基礎(chǔ)上,進一步深化擴展,隨著我國金融改革的不斷進行,對法律法規(guī)完善的需求日益增加,為促進電子銀行業(yè)務(wù)有效發(fā)展,我國應(yīng)盡快建立起滿足電子銀行業(yè)務(wù)特點的配套法律法規(guī)。綜上,本文研究發(fā)現(xiàn)我國網(wǎng)上銀行經(jīng)過十幾年的飛速發(fā)展,雖然已經(jīng)開發(fā)了諸多網(wǎng)銀業(yè)務(wù),基本滿足客戶的金融需求,并已經(jīng)初步形成了現(xiàn)代化銀行信息系統(tǒng),但是網(wǎng)上銀行被盜、客戶密碼信息被非法竊取等案件仍然頻繁出現(xiàn),案件發(fā)生后銀行與消費者權(quán)利義務(wù)如何界定、舉證責任如何分配等核心問題,我國現(xiàn)行法律法規(guī)并沒有做出明確規(guī)定;同時法律法規(guī)之間針對同一問題出現(xiàn)矛盾和沖突的情況,這進一步增加了司法適用的難度,不利于消費者權(quán)益保護,也不利于銀行自身風險控制,提高金融服務(wù)水平。本文建議在我國現(xiàn)行法律法規(guī)框架下重構(gòu)銀行與消費者金融業(yè)務(wù)糾紛舉證責任配置,明確雙方權(quán)利義務(wù)界限,從立法層面解決這一難題,同時進一步強化對消費者權(quán)益保護,制定和完善與網(wǎng)上銀行業(yè)務(wù)相關(guān)聯(lián)的其他配套法律法規(guī),充實我國電子銀行類法律制度。
[Abstract]:The popularization and application of the Internet has triggered the development of online banking. The rise of online business has made the development of financial and trade more convenient and efficient, and the financial service has developed towards a more humanized and intelligent direction. Although the development of traditional business in China has basically kept pace with the world, the online banking business is still relatively weak. After more than ten years of development, China's online banking business has made considerable progress, but also produced more problems, online banking theft is one of the more serious problems. This paper analyzes how to define the boundary of rights and obligations between banks and depositors after the property losses caused by the theft of online banks in China, and to distribute the burden of proof. Through revealing the deficiency of our country's legal system at present, the author puts forward his own views on how to perfect the settlement of online banking cases and the balanced distribution of the interests of the parties involved in the cases. The text of this paper is composed of four parts: the first part introduces the background of the development of online banking, the development of the current situation leads to the discussion and interpretation of this article, summed up the foreign and domestic legislative research status. This article attempts to sum up the focus of this kind of cases by analyzing the current cases of online bank theft, and further analyzes the present situation of the distribution of responsibility for the abnormal authorized business of internet bank in our country. It points out that the current laws and regulations of our country are deficient in content and logic. The second part of the case, problems and causes of the first brief introduction of online banking case facts and legal issues of dispute focus, from the case comb out of our country's online bank theft case loss determination and burden of proof distribution of the status quo. Secondly, it analyzes the causes of this kind of disputes, and then analyzes the shortcomings and blind spots of the current legal system. The third part of the system reform and improvement of the recommendations through six aspects, targeted to our country's Internet banking internal control and legal system improvement put forward more pertinent recommendations. This paper expounds the allocation of the burden of proof reconstructing under the framework of the current legal system, further explains that the current online banking should be inclined to distribute the responsibility from the angle of consumer protection, and further consummates and enriches the laws and regulations of electronic banking. The fourth part of the extensive discussion on the basis of the previous discussion, further deepen the expansion, with the ongoing financial reform in China, the demand for the improvement of laws and regulations is increasing, in order to promote the effective development of electronic banking business, Our country should establish as soon as possible to meet the characteristics of electronic banking business supporting laws and regulations. In summary, this paper finds that after more than ten years of rapid development of China's online banking, although it has developed a lot of online banking business, basically to meet the financial needs of customers, and has initially formed a modern banking information system. However, cases such as the theft of online banks and illegal theft of customer password information still occur frequently. How to define the rights and obligations of banks and consumers, how to distribute the burden of proof, and so on, after the cases occur. The current laws and regulations of our country have not made clear provisions; at the same time, there are contradictions and conflicts between laws and regulations aimed at the same problem, which further increases the difficulty of judicial application and is not conducive to the protection of consumers' rights and interests. It is also unfavorable for banks to control their own risks and improve the level of financial services. This paper proposes to reconstruct the allocation of the burden of proof in the disputes between banks and consumers in the framework of current laws and regulations, clarify the limits of rights and obligations of both parties, solve this problem from the legislative level, and further strengthen the protection of consumers' rights and interests. To establish and perfect other supporting laws and regulations related to online banking, and to enrich the legal system of electronic banking in China.
