【摘要】：我國(guó)為保護(hù)稀土等自然資源而采取的出口限制措施,在WTO體制下面臨困境。為滿足國(guó)家利益的剛性需求,我國(guó)應(yīng)跳出利用WTO例外條款進(jìn)行抗辯的法律困局,改變制度依賴路徑,在履行國(guó)際法律義務(wù)的同時(shí)以國(guó)家安全為立法目標(biāo),重構(gòu)出口管制法律體系,包括:制定《出口管制法》,整合出口管制清單、提升其全面性和技術(shù)性,加強(qiáng)促進(jìn)出口管制遵守的制度建設(shè),以及謀求加入多邊出口管制機(jī)制,以推動(dòng)區(qū)域性出口管制機(jī)制的發(fā)展。
[Abstract]:China's export restriction measures to protect natural resources such as rare earths are facing difficulties under the WTO system.In order to meet the rigid demand of national interests, our country should jump out of the legal dilemma of using WTO exception clause to defend, change the path of system dependence, and take national security as the legislative goal while fulfilling the international legal obligations.The restructuring of the export control legal system, including the enactment of the Export Control Act, the consolidation of export control lists, the enhancement of their comprehensiveness and technicality, the strengthening of institutional development to promote compliance with export controls, and the pursuit of accession to multilateral export control mechanisms,To promote the development of regional export control mechanism.
