【摘要】：生物質能源是可再生能源的一種，全球累計消費數(shù)量僅排在傳統(tǒng)化石能源之后，在能源結構中排名四名，它是絕無僅有的能被循環(huán)利用且再造的炭源。生物質能發(fā)電是生物質能開發(fā)利用方式眾多形式中的一種，原理是利用生物質能直接燃燒或氣化后產生的熱量進行發(fā)電。在美國、歐盟、北歐等發(fā)達國家，生物質能發(fā)產業(yè)已經發(fā)展壯大且相當成熟，已經被某些國家視為主要的電熱生產途徑。 作為世界農業(yè)大國，我國的生物質能資源儲量十分可觀，現(xiàn)階段我國的生物質能發(fā)電產業(yè)尚居于開啟時期，這個產業(yè)一旦發(fā)展成熟將深刻地改變我國的社會經濟結構，為現(xiàn)代工業(yè)發(fā)展提供了強有力的推動�！犊稍偕茉捶ā芳捌湫拚福瑸槲覈镔|能發(fā)電行業(yè)創(chuàng)設了一系列法律制度保障。但由于現(xiàn)行的法律制度沒有相對完善，操作性強的配套措施和實施細則，以及生物質發(fā)電行業(yè)實際發(fā)展中面臨著的成本和技術問題沒有強有力的法律制度予以解決，我國的生物質能發(fā)電行業(yè)還面臨著成長中的困境。本文正是從此目的出發(fā)而寫作的。 本文首先對生物質能、生物質能發(fā)電概念做出解釋，全面闡述了利用生物質能發(fā)電在我國社會的必要性和可行性，奠定理論基礎。其次，詳細介紹國外生物質能發(fā)電行業(yè)發(fā)展較早較成熟的國家如美國、德國、北歐等國的先進經驗，重點介紹法律制度方面的先進制度，并總結歸納出具體的五項制度。再次，從我國生物質能發(fā)電行業(yè)發(fā)展現(xiàn)狀出發(fā)，分析我國現(xiàn)行的規(guī)制生物質發(fā)電行業(yè)的法律政策及法律制度。最后，從實際出發(fā)，結合我國有中國特色的具體國情，因地制宜，在我國法律框架及現(xiàn)實狀況下提出對于完善改進我國生物質能發(fā)電行業(yè)法律制度的建議，以期為生物質能發(fā)電行業(yè)的持續(xù)穩(wěn)定健康發(fā)展提供良好的法律土壤。
[Abstract]:Biomass energy is a renewable energy, the global cumulative number ranked only after the traditional fossil energy, ranked four in the energy structure, it is unique can be recycled and recycling the carbon source. The biomass power generation is a way of development and utilization of biomass energy in many forms, the principle is using biomass to generate electricity directly after the heat generated by the combustion or gasification. In the United States, the European Union, the Nordic and other developed countries, biomass industry has grown and matured, has been in some countries as the main production way of electric drive.
As a large agricultural country in the world, China's biomass energy resource reserves is considerable, biomass power generation industry in China at the present stage is living in the opening period, the industry once developed will profoundly change the social economic structure of our country, provides to promote renewable energy law >. < strong and amendment for the modern industrial development. The creation of a series of legal protection for biomass power generation industry in China. But because of the current legal system is not relatively perfect, practical measures and implementation rules, cost and technical problems and the actual development of biomass power generation industry is faced with no strong legal system to solve, biomass power generation industry in China also facing growing difficulties. This article is from the purpose of writing.
This paper firstly explain the concept of biomass energy, biomass power generation, biomass power generation in the use of a comprehensive exposition of the necessity and feasibility of our society, lay the theoretical foundation. Secondly, introduces the foreign development of biomass power generation industry earlier mature countries such as the United States, Germany, the advanced experience of the Nordic countries, focuses on the advanced system of legal system, and summarized five specific system. Again, starting from the current situation of the development of biomass power generation industry in China, analyzes the law policy of China's current regulation of biomass power generation industry and legal system. Finally, starting from the actual conditions and specific conditions, combined with China Chinese characteristics, in our legal framework and in reality put forward for the improvement of the legal system of China's biomass power generation industry recommendations, in order to generate electricity for biomass energy industry continued A stable and healthy development provides a good legal soil.
