【摘要】:房地產(chǎn)是我國經(jīng)濟的重要力量,但是由于我國房地產(chǎn)行業(yè)尚處于起步階段,房地產(chǎn)企業(yè)整體素質(zhì)不高,仍然存在著很多問題,例如市場競爭不充分、合同法律風(fēng)險頻發(fā)等等。就房地產(chǎn)企業(yè)的合同而言,它在房地產(chǎn)企業(yè)工作中居于核心地位,是提高房地產(chǎn)企業(yè)經(jīng)濟效益的法律保障和重要工具。但是由于各個方面的原因,房地產(chǎn)企業(yè)經(jīng)常在合同上出現(xiàn)一些風(fēng)險,影響房地產(chǎn)企業(yè)的經(jīng)營和管理。一般而言,房地產(chǎn)企業(yè)合同的法律風(fēng)險具體表現(xiàn)在:現(xiàn)有法律法規(guī)不完善、合同管理體系和制度建設(shè)未被重視、合同內(nèi)容不合格、合同簽訂過于簡單、應(yīng)對訴訟態(tài)度消極等方面。因此,房地產(chǎn)企業(yè)合同法律風(fēng)險的防范是房地產(chǎn)企業(yè)生存和發(fā)展的核心,合同法律風(fēng)險的處理將直接影響到企業(yè)經(jīng)濟效益,文章通過理論上的分析,全面論述何為房地產(chǎn)企業(yè)的合同法律風(fēng)險,,對于常見的合同法律風(fēng)險進行類型上的劃分,并對合同法律風(fēng)險的防范中常見問題的進行深層次理解和分析,最后提出了解決措施。因為房地產(chǎn)業(yè)對國民經(jīng)濟的發(fā)展具有非常重要的作用,也與人民的生活有著密切的聯(lián)系,所以如何防范房地產(chǎn)業(yè)合同法律風(fēng)險,使房地產(chǎn)業(yè)持續(xù)健康發(fā)展至關(guān)重要。因此,我們有必要采取多種手段,全面防范房地產(chǎn)企業(yè)的合同法律風(fēng)險,為房地產(chǎn)企業(yè)的發(fā)展保駕護航,這不僅關(guān)系到我們國家經(jīng)濟的健康發(fā)展,而且還關(guān)系到每個人的日常生活。

As far as the contract of the real estate enterprise is concerned, it occupies the core position in the real estate enterprise's work, and it is the legal guarantee and the important tool to improve the economic benefit of the real estate enterprise. However, due to various reasons, real estate enterprises often appear some risks in the contract, affecting the management and management of real estate enterprises. Generally speaking, the legal risks of real estate enterprise contracts are: the existing laws and regulations are not perfect, the contract management system and system construction are not paid attention to, the contract content is not qualified, the contract signing is too simple, To deal with the negative aspects of litigation attitude. Therefore, the prevention of the legal risk of the real estate contract is the core of the survival and development of the real estate enterprise, and the treatment of the legal risk of the contract will directly affect the economic benefits of the enterprise. This paper comprehensively discusses what is the contract legal risk of the real estate enterprise, classifies the common contract legal risk on the type, and makes a deep understanding and analysis of the common problems in the prevention of the contract legal risk, and finally puts forward the solving measures. Because the real estate industry plays a very important role in the development of the national economy and is closely related to the people's life, how to prevent the legal risk of the real estate industry contract and make the real estate industry develop healthily and continuously is very important.
