【摘要】:正問(wèn)題某小區(qū)業(yè)主甲與房地產(chǎn)開(kāi)發(fā)商乙簽訂了《車(chē)位使用協(xié)議》,約定小區(qū)內(nèi)第5號(hào)地上停車(chē)位由甲長(zhǎng)期獨(dú)占使用,甲向乙支付了2萬(wàn)元車(chē)位使用費(fèi)。該車(chē)位系經(jīng)規(guī)劃審批建設(shè)的停車(chē)位,鋪裝了植草磚,占地面積按50%計(jì)入綠化面積。后業(yè)委會(huì)主張?jiān)撏\?chē)位為全體業(yè)主共有。請(qǐng)問(wèn):甲乙簽訂的這份車(chē)位使用協(xié)議是否有效?解答一、本案中第5號(hào)停車(chē)位的權(quán)屬性質(zhì)
