[Abstract]:Online shopping is one of the new consumption shopping modes which relies on the network platform to complete the commodity value and currency payment and realizes the commodity transfer and acquisition by express delivery company. Express delivery company is an important link between online shopping consumers and network platform operators. The rights and obligations they enjoy will affect the distribution of the rights and interests corresponding to the above two closely. It even restricts the successful completion of the whole process of shopping transactions. Express delivery company is the product of the traditional trading mode of logistics from offline to electronic commerce. For online shopping, express delivery companies play a vital role. However, the legal status of express delivery companies is not clear, the nature of express service contracts is unclear, and the liability structure of express delivery companies is not clearly defined. And analysis of online courier company's civil liability literature is very few. With the increasing of logistics disputes in online shopping in real life, the legal application of the civil liability of express delivery companies in online shopping is chaotic. Express delivery companies use the format clauses of the maximum compensation limit to limit their liability, resulting in consumers and network platform operators unable to get fair compensation for their losses, and many consumers have no access to claim for compensation. On the one hand, there is no real evidence of who caused the damage, and on the other hand, the application of the law on the related liability of the express delivery company is confused. Therefore, straightening out the liability of express delivery company is of great significance to solve the logistics disputes in online shopping such as the breakage, loss, delay and infringement of express mail, and to promote the development of network market and express delivery industry in our country. This paper attempts to clarify the civil liability of express delivery companies in online shopping by collecting and analyzing the existing documents and using relevant laws such as Consumer Rights Protection Law, contract Law, Tort liability Law and so on. First of all, through the analysis of the legal relationship of express delivery services, the legal status of express delivery companies in online shopping is clear, which is the basic premise to clarify the civil liability of express delivery companies. Express delivery companies should determine their independent legal status in the e-business mode of online shopping, so as to better protect the relevant rights of consumers and clarify the civil liability of express delivery companies when resolving logistics disputes. The legal status determines its civil liability, and the express delivery company belongs to the third benefit contract. Secondly, it is clear that the nature of civil liability of express delivery company in online shopping, not only tort, breach of contract but also exist between the two competing, and further analysis to determine the composition of civil liability of express companies in online shopping, liability restrictions and exemptions, The author hopes to construct the civil liability framework system of express company through the construction of the civil liability framework system of the express company in online shopping, and provide some suggestions to solve the problems existing in the process of undertaking the civil liability of the express company in the online shopping. Providing theoretical basis and effective strategies for disputes in practice with expectation.
