電子商務(wù)中消費(fèi)者后悔權(quán)問題的研究

【摘要】:電子商務(wù)作為一種新的經(jīng)濟(jì)交易方式,對(duì)人們的工作和生活的影響越來越深遠(yuǎn),一方面其具有“三全優(yōu)勢(shì)”即“全方位”、“全天候”和“全球性”的優(yōu)勢(shì),另一方面由于電子商務(wù)具有快捷、方便、高效和成本低的特點(diǎn),因此受到許多消費(fèi)者和商家的喜愛,從而影響著人們的生活和工作。電子商務(wù)與傳統(tǒng)商務(wù)有著本質(zhì)的區(qū)別,電子商務(wù)最大的特點(diǎn)就是具有虛擬性,這使得消費(fèi)者與商家之間不必當(dāng)面進(jìn)行議價(jià)、交易,這也導(dǎo)致了消費(fèi)者對(duì)交易商品的服務(wù)、質(zhì)量等很難有一個(gè)更準(zhǔn)確地把握。所以,在一定程度上,電子商務(wù)的交易模式給消費(fèi)者增加了相應(yīng)的交易風(fēng)險(xiǎn),容易引起消費(fèi)者和商家的糾紛和矛盾。而網(wǎng)上購物具有跨地域消費(fèi)的特點(diǎn),導(dǎo)致消費(fèi)者維權(quán)之困難。縱觀國外先進(jìn)的立法經(jīng)驗(yàn),后悔權(quán)制度是維護(hù)消費(fèi)者權(quán)益的一項(xiàng)重要制度,后悔權(quán)制度的存在,不僅體現(xiàn)了民法的意思自治、公平正義、誠實(shí)信用原則的本質(zhì),也反映了國家對(duì)消費(fèi)者權(quán)益保護(hù)問題的政策傾斜。對(duì)處于弱勢(shì)地位的消費(fèi)者合法權(quán)益的保護(hù),后悔權(quán)制度的出現(xiàn),無疑具有“雪中送炭”的價(jià)值。2014年3月15日新的《消費(fèi)者權(quán)益保護(hù)法》生效后,盡管有條款規(guī)制了消費(fèi)者的后悔權(quán),但該條款太過于原則化,在具體操作與實(shí)際應(yīng)用上還存在諸多問題。為了保障消費(fèi)者后悔權(quán)制度的實(shí)施,筆者認(rèn)為有必要構(gòu)建消費(fèi)者反悔權(quán)制度的具體內(nèi)容。本文明確了后悔權(quán)制度的適用范圍、起算時(shí)間、行使期限等。同時(shí)還借鑒了國外的立法經(jīng)驗(yàn)和司法實(shí)踐,建立了消費(fèi)者專門機(jī)構(gòu)和相應(yīng)的制度來配合協(xié)調(diào),為電子商務(wù)后悔權(quán)制度在我國的完善提供了一定的參考價(jià)值。
[Abstract]:As a new way of economic transaction, E-commerce has more and more far-reaching influence on people's work and life. On the one hand, it has the advantages of "all-around", "all-weather" and "global". On the other hand, because of the characteristics of fast, convenient, efficient and low cost, E-commerce is loved by many consumers and merchants, which affects people's life and work. Electronic commerce and traditional commerce have the essential difference, the biggest characteristic of electronic commerce is that it is fictitious, which makes it unnecessary for consumers and merchants to negotiate and trade in person, which also leads to the service of consumers to traded goods. Quality is difficult to have a more accurate grasp. Therefore, to a certain extent, the transaction mode of electronic commerce increases the corresponding transaction risk to consumers and easily causes disputes and contradictions between consumers and merchants. Online shopping has the characteristics of cross-regional consumption, leading to consumer rights difficulties. Throughout the advanced legislative experience of foreign countries, regret right system is an important system to safeguard the rights and interests of consumers. The existence of regret right system not only embodies the essence of the principle of autonomy of will, fairness and justice of civil law, and the principle of good faith. It also reflects the policy preference of the state on the protection of consumer rights and interests. The protection of the legitimate rights and interests of consumers in a weak position, and the emergence of the right of regret system, undoubtedly have the value of "giving a helping hand in time" .After the new Law on the Protection of Consumer Rights and interests came into effect on March 15, 2014, Although there is a clause that regulates consumers' right of regret, it is too principled, and there are still many problems in concrete operation and practical application. In order to ensure the implementation of consumer right of regret, I think it is necessary to construct the specific content of consumer right of repentance. This paper clarifies the scope of application, starting time, duration of exercise of the right of regret system. At the same time, it also draws lessons from the foreign legislative experience and judicial practice, establishes the consumer specialized organization and the corresponding system to coordinate, has provided the certain reference value for the e-commerce regret right system in our country consummation.
