跨境數(shù)據(jù)流動(dòng)國(guó)際規(guī)制新發(fā)展:困境與前路

【摘要】:跨境數(shù)據(jù)流動(dòng)的國(guó)際規(guī)制已逐漸成為新一輪雙邊、區(qū)域貿(mào)易談判的新議題。美國(guó)極力倡導(dǎo)貿(mào)易數(shù)據(jù)的跨境自由流動(dòng),推動(dòng)TPP成為第一個(gè)在"電子商務(wù)"章中納入具有約束力的規(guī)制跨境數(shù)據(jù)流動(dòng)的自由貿(mào)易協(xié)定,為未來(lái)貿(mào)易談判提供了參考。而跨境數(shù)據(jù)流動(dòng)國(guó)際規(guī)制面臨各國(guó)數(shù)據(jù)本地化要求的障礙,主要表現(xiàn)為通過(guò)國(guó)內(nèi)措施要求數(shù)據(jù)本地化存儲(chǔ)并限制數(shù)據(jù)跨境流動(dòng)。WTO規(guī)則和TPP協(xié)定在識(shí)別數(shù)據(jù)本地化要求中的合法公共政策目標(biāo)和不合理貿(mào)易限制時(shí),存在著適用上的不確定性及適用困難。文章認(rèn)為,全球治理背景下跨境數(shù)據(jù)流動(dòng)國(guó)際規(guī)制的未來(lái)路徑,可以設(shè)計(jì)為在對(duì)數(shù)據(jù)進(jìn)行分類(lèi)的前提下,由各國(guó)通過(guò)談判對(duì)分類(lèi)數(shù)據(jù)加以承諾。中國(guó)則應(yīng)當(dāng)關(guān)注跨境數(shù)據(jù)流動(dòng)國(guó)際規(guī)制的新發(fā)展,完善國(guó)內(nèi)規(guī)制,并積極爭(zhēng)取跨境數(shù)據(jù)流動(dòng)國(guó)際規(guī)制的話語(yǔ)權(quán)。
[Abstract]:International regulation of cross-border data flow has gradually become a new issue in bilateral and regional trade negotiations. The United States strongly advocates the free flow of trade data across borders and promotes TPP to become the first free trade agreement to include binding regulation of cross-border data flows in the chapter of "Electronic Commerce", which provides a reference for future trade negotiations. However, the international regulation of cross-border data flow faces the obstacle of countries' data localization requirements. The main manifestation is that domestic measures require local storage of data and restrict the cross-border flow of data. WTO rules and TPP agreements identify legitimate public policy objectives and unreasonable trade restrictions in data localization requirements. There is uncertainty and difficulty in application. The paper holds that the future path of international regulation of cross-border data flow under the background of global governance can be designed as a commitment to the classified data through negotiation by countries on the premise of classifying the data. China should pay attention to the new development of the international regulation of cross-border data flow, perfect the domestic regulation, and actively strive for the voice of the international regulation of cross-border data flow.
