【摘要】：跨境電子商務(wù)是"一帶一路"共建的重要內(nèi)容,而其共建則需要法治規(guī)則的保障。國(guó)際社會(huì)已基本形成跨境電子商務(wù)多層次法治規(guī)則框架,但在"一帶一路"倡議背景下的相關(guān)法治規(guī)則嚴(yán)重缺乏。自貿(mào)協(xié)議在構(gòu)建跨境電子商務(wù)規(guī)則過(guò)程中發(fā)揮了主要載體作用。我國(guó)應(yīng)當(dāng)依托自貿(mào)協(xié)議構(gòu)建"一帶一路"跨境電子商務(wù)多層次法治規(guī)則體系。在構(gòu)建的過(guò)程中應(yīng)注意自貿(mào)協(xié)議的靈活性、普遍性貿(mào)易規(guī)則的適用性、國(guó)際新規(guī)則的可吸納性及我國(guó)在規(guī)則制定中話語(yǔ)權(quán)的可提升性等。
[Abstract]:Cross-border e-commerce is an important part of "Belt and Road" co-construction, and its co-construction needs the protection of the rule of law. The international community has basically formed a multi-level rule of law rules framework for cross-border electronic commerce. However, the relevant rule of law in the context of Belt and Road's initiative is seriously lacking. Free Trade Agreement (FTA) plays a major role as a carrier in the process of establishing cross-border e-commerce rules. China should rely on the FTA to build "Belt and Road". "A multi-level rule of law system for cross-border electronic commerce. Attention should be paid to the flexibility of free trade agreements in the process of construction. The applicability of the universal trade rules, the acceptability of the new international rules and the promotion of the right to speak in the making of the rules.
