【摘要】：隨著網(wǎng)絡(luò)技術(shù)的迅猛發(fā)展,跨境電子商務(wù)業(yè)務(wù)呈"井噴"之勢,其所涉及的知識產(chǎn)權(quán)問題錯綜復(fù)雜,在治理上也相應(yīng)地出現(xiàn)許多困擾,這既有電子商務(wù)跨境需求與知識產(chǎn)權(quán)地域性保護(hù)之間沖突的根源性原因,又有技術(shù)創(chuàng)新加速與制度滯后、國際協(xié)調(diào)不足之間沖突的現(xiàn)實性原因,也有效率與公平?jīng)_突的理念性原因。為有效突破這種困境,構(gòu)建跨境電子商務(wù)合理的知識產(chǎn)權(quán)治理關(guān)系,需要"多利益相關(guān)者對話",通過政府、跨境電商平臺、知識產(chǎn)權(quán)權(quán)利人、各類民間集體力量四個主要層面從境內(nèi)、境外領(lǐng)域共同參與治理,并加強(qiáng)各治理主體之間的多元相互合作,尤其是跨境電子商務(wù)知識產(chǎn)權(quán)關(guān)系中相對弱勢方應(yīng)積極借助行業(yè)協(xié)會、商會、著作權(quán)集體管理組織等各類民間集體力量提升自身實力。
[Abstract]:With the rapid development of network technology, cross-border e-commerce business has the tendency of "blowout". The intellectual property issues involved in it are complex, and there are many problems in governance. This is not only the root cause of the conflict between the cross-border demand of e-commerce and the regional protection of intellectual property, but also the reality of the conflict between the acceleration of technological innovation and the lag of the system, and the insufficient international coordination. In order to effectively break through this dilemma and build a rational intellectual property governance relationship for cross-border e-commerce, we need a "multi-stakeholder dialogue" through the government and cross-border e-commerce platforms. The owners of intellectual property rights and all kinds of folk collective forces are involved in governance from four main levels, both inside and outside the country, and strengthen the pluralistic and mutual cooperation among the various governing bodies. Especially in the relation of intellectual property rights of cross-border electronic commerce, the relatively weak parties should actively promote their own strength with the help of trade associations, chambers of commerce, copyright collective management organizations and other folk collective forces.
