【摘要】：《電子商務(wù)法》頒布在即,保護(hù)權(quán)益是其核心宗旨之一,電子商務(wù)法中交易主體和交易規(guī)則制度是保護(hù)權(quán)益的前提。大數(shù)據(jù)時代的技術(shù)使得傳統(tǒng)網(wǎng)絡(luò)營銷觀念發(fā)生轉(zhuǎn)變,網(wǎng)絡(luò)用戶自主注冊賬號登錄并參與活動的時代已逐漸被以第三方賬號登錄的方式所替代。新的登錄方式不但造成了各行為主體間法律關(guān)系的模糊,也帶來了用戶協(xié)議適用沖突等相關(guān)問題。從第三方賬號登錄的技術(shù)關(guān)系入手,解構(gòu)第三方賬號登錄活動中的法律關(guān)系,確定交易主體特定行為軌跡的依附規(guī)則,是應(yīng)對這些問題的有效途徑。
[Abstract]:"Electronic commerce law > issued soon, protection of rights and interests is one of the core purpose, the law of electronic commerce in main trading and trading rules system is a prerequisite for protection of rights and interests. The era of big data technology makes the traditional network marketing concept change, the network user independent registered account to log in and participate in the activities of the era has been to third party account login by means of the alternative. The new logon mode not only caused a fuzzy legal relationship between various actors, also brought problems related to user agreement applicable conflict. Starting from the relationship between the third party account login, solution of legal relationship structure third party account login activity, determine the trading rules of behavior dependent trajectories. Is an effective way to deal with these problems.
