當代社會背景下的文化產業(yè)生態(tài)規(guī)制

【摘要】：文化產業(yè)生態(tài)規(guī)制是指解決因產業(yè)外部性給經濟與文化發(fā)展可能帶來的負面影響的法的規(guī)范。文化產業(yè)存在經濟與文化內容領域兩個層面的外部性。各種文化的發(fā)展狀況及其相互關系以及它們與外部自然、社會的關系,即文化生態(tài)。文化生態(tài)具有整體性、動態(tài)性、平衡性、主體性四大特征。文化生態(tài)理論的主要觀點有環(huán)境決定與可能性論、文化生態(tài)及層次論和文化主體結構主義。確認優(yōu)良文化生態(tài)的標準,把準文化生態(tài)失衡的表現(xiàn),重視新媒體下的輿論文化生態(tài)。文化產業(yè)生態(tài)規(guī)制的工具與路徑包括:文化企業(yè)生產經營外部性不經濟的規(guī)制,文化產業(yè)產品內容外部性負面影響的規(guī)制,防止文化資源的掠奪性破壞,克服經濟人假定的負面影響,深化文化供給側改革,正確處理文化沖突。
[Abstract]:The ecological regulation of cultural industry refers to the law that solves the possible negative influence on economic and cultural development caused by the externality of industry. There are two levels of externalities in the cultural industry: economy and cultural content. The development of various cultures and their relationship with external nature and society, namely cultural ecology. Cultural ecology has four characteristics: integrity, dynamics, balance and subjectivity. The main viewpoints of cultural ecology theory include environmental decision and possibility theory, cultural ecology and hierarchy theory and cultural subject structuralism. The standard of fine cultural ecology should be confirmed, and the expression of unbalance of quasi-cultural ecology should be taken into account, and the cultural ecology of public opinion under the new media should be emphasized. The tools and paths of ecological regulation of cultural industry include: the regulation of externality of production and operation of cultural enterprises, the regulation of negative influence of externality of content of cultural industry, and the prevention of predatory destruction of cultural resources. To overcome the negative influence of economic man, deepen the cultural supply-side reform and correctly handle the cultural conflict.
