東北三省新型農(nóng)村社會(huì)養(yǎng)老保險(xiǎn)制度模式研究

【摘要】:農(nóng)業(yè)、農(nóng)村、農(nóng)村居民的相關(guān)問(wèn)題簡(jiǎn)稱“三農(nóng)”問(wèn)題,是我國(guó)急需解決的三大難題。其中的“農(nóng)村居民”問(wèn)題主要是指農(nóng)村居民的社會(huì)保障問(wèn)題,而農(nóng)村居民的養(yǎng)老問(wèn)題則是“三農(nóng)”問(wèn)題中的重中之重,也是解決好“三農(nóng)問(wèn)題”的敲門磚。農(nóng)村居民養(yǎng)老問(wèn)題解決的好壞關(guān)系到“三農(nóng)”問(wèn)題解決的好壞,而且還關(guān)系到整個(gè)農(nóng)村社會(huì)保障體系構(gòu)建的好壞、關(guān)系到整個(gè)社會(huì)的和諧與否。 2009年,根據(jù)中國(guó)共產(chǎn)黨的第十七次全體代表大會(huì)和全國(guó)第十七屆三中的會(huì)議精要,我國(guó)國(guó)務(wù)院制定并頒布實(shí)施了《國(guó)務(wù)院關(guān)于開展新型農(nóng)村社會(huì)養(yǎng)老保險(xiǎn)試點(diǎn)的指導(dǎo)意見》國(guó)發(fā)(2009)32號(hào)。新型農(nóng)村社會(huì)養(yǎng)老保險(xiǎn)制度的實(shí)施是國(guó)家頒布的一項(xiàng)及其關(guān)鍵的社會(huì)養(yǎng)老政策,該項(xiàng)政策的頒布對(duì)于農(nóng)村社會(huì)養(yǎng)老保險(xiǎn)制度來(lái)說(shuō)具有里程碑似地意義。雖然新政策的施行對(duì)以往的養(yǎng)老保險(xiǎn)制度是一次較大的沖擊,也給農(nóng)村居民的養(yǎng)老問(wèn)題的妥善解決帶了希望,但是新制度的施行還未能夠真正的解決所有地區(qū)的養(yǎng)老問(wèn)題。例如東北三省一些農(nóng)村就存在一些這樣的問(wèn)題。眾所周知,東北三省都是農(nóng)業(yè)大省,也是農(nóng)業(yè)人口大省,都地處嚴(yán)寒地帶,氣候條件都及其惡劣,而且農(nóng)村人口占據(jù)各省總?cè)丝诘妮^大比例,農(nóng)村居民的社會(huì)養(yǎng)老問(wèn)題一直以來(lái)就是東北三省地區(qū)非常急切需要解決的重大疑難問(wèn)題之一,也是我國(guó)政府首先需要解決的三農(nóng)問(wèn)題之一。新型農(nóng)村社會(huì)養(yǎng)老保險(xiǎn)的制度模式意義之重大,是不言而喻的。本文就針對(duì)東北三省的實(shí)際情況制定符合地方特色的養(yǎng)老保險(xiǎn)法律制度,以期能夠?yàn)閲?guó)家的養(yǎng)老保險(xiǎn)法律制度提供參考和借鑒。 本文的創(chuàng)新點(diǎn)主要是針對(duì)東北三省的特殊情況,制定符合東北三省實(shí)際情況的新型農(nóng)村養(yǎng)老保險(xiǎn)制度模式。主要有以下幾部分構(gòu)成:第一部分,概述新型農(nóng)村養(yǎng)老保險(xiǎn)制度的相關(guān)理論,從農(nóng)村社會(huì)養(yǎng)老保險(xiǎn)制度的基本狀況、農(nóng)村養(yǎng)老保險(xiǎn)制度建立的必要性和農(nóng)村養(yǎng)老保險(xiǎn)制度建立的理論基礎(chǔ)三方面進(jìn)行論述。第二部分,針對(duì)東北三省的具體情況,分別進(jìn)行分析、討論和研究。第三部分,對(duì)發(fā)達(dá)國(guó)家的養(yǎng)老保險(xiǎn)制度進(jìn)行闡述、分析、比較和借鑒。第四部分,結(jié)合東北三省的具體情況,從制度模式構(gòu)建的基本原則、相關(guān)立法制度的建立等相關(guān)問(wèn)題的解決途徑進(jìn)行可行性的具體分析并對(duì)提出與之有關(guān)的具體措施。
[Abstract]:Agriculture, rural residents of the related problems referred to as "three rural" problem, is urgently needed to solve the three major problems. The problem of "rural residents" mainly refers to the problem of social security of rural residents, while the problem of providing for the aged for rural residents is the most important part of the problem of "agriculture, countryside and farmers", and it is also a stepping stone to solve the problem of "agriculture, countryside and farmers". The quality of solving the problem of providing for the aged for rural residents is related to the good or bad of solving the "three rural" problems, and also to the construction of the whole rural social security system, and to the harmony of the whole society. In 2009, According to the essence of the 17th National Congress of the Communist Party of China and the third session of the 17th National Congress, the State Council of our country formulated and promulgated the "guidance opinions of the State Council on developing the pilot Project of New Rural Social Old-age Insurance" (2009) No. 32. The implementation of the new rural social old-age insurance system is a key social pension policy promulgated by the state. The promulgation of the policy has a landmark significance for the rural social old-age insurance system. Although the implementation of the new policy on the past pension insurance system is a big impact, but also for rural residents to properly solve the pension problem with hope, but the implementation of the new system has not been able to really solve the pension problems in all regions. For example, some rural areas in the three Northeast provinces have some such problems. As we all know, the three northeastern provinces are big agricultural provinces and large agricultural population provinces. They are all located in cold zones, and the climate conditions are extremely bad. Moreover, the rural population accounts for a large proportion of the total population of the provinces. The social old-age problem of rural residents has always been one of the most urgent problems in the three provinces of Northeast China, and it is also one of the three problems that the government of our country needs to solve first. It is self-evident that the system model of new rural social endowment insurance is of great significance. According to the actual situation of the three provinces in Northeast China, this paper formulates the legal system of endowment insurance in accordance with the local characteristics, in order to provide reference and reference for the national legal system of endowment insurance. The innovation of this paper is mainly aimed at the special situation of the three northeastern provinces and the establishment of a new mode of rural old-age insurance system in accordance with the actual situation of the three provinces of Northeast China. The main components are as follows: the first part summarizes the related theories of the new rural old-age insurance system, from the basic status of the rural social endowment insurance system, The necessity of establishing rural endowment insurance system and the theoretical basis of rural endowment insurance system are discussed. The second part analyzes, discusses and studies the specific situation of three provinces in Northeast China. The third part expounds, analyzes, compares and draws lessons from the endowment insurance system of developed countries. The fourth part, combined with the specific situation of the three provinces of Northeast China, from the basic principles of the system model construction, the establishment of relevant legislative system and other relevant solutions to the specific analysis of the feasibility and put forward specific measures related to it.
