【摘要】:誠(chéng)信是一切市場(chǎng)交易行為的基礎(chǔ),在以市場(chǎng)化為核心的現(xiàn)代社會(huì)中,誠(chéng)信越來越受到關(guān)注,與每一個(gè)人的日常生活密不可分,F(xiàn)代社會(huì)解決誠(chéng)信問題的主要方式之一就是通過建立征信體系盡可能消除信息不對(duì)稱現(xiàn)象,這也使得征信體系伴隨著商品經(jīng)濟(jì)的發(fā)展逐漸成為人們社會(huì)生活的重要工具之一。然而以經(jīng)營(yíng)風(fēng)險(xiǎn),銷售承諾為特征的中國(guó)保險(xiǎn)行業(yè)長(zhǎng)期以來卻沒有必要的征信體系,隨著從業(yè)人員規(guī)模和行業(yè)產(chǎn)值的不斷增加,誠(chéng)信問題已經(jīng)成為制約保險(xiǎn)行業(yè)長(zhǎng)期、健康和可持續(xù)發(fā)展的重要因素,嚴(yán)重影響了整個(gè)行業(yè)的社會(huì)形象,阻礙了整個(gè)行業(yè)向精細(xì)化的發(fā)展轉(zhuǎn)型。近年來,行業(yè)內(nèi)外對(duì)于解決保險(xiǎn)誠(chéng)信問題,建立必要的征信體系的呼聲日趨高漲,特別是在黨的十八屆四中全會(huì)將社會(huì)征信建設(shè)列入法制建國(guó)的重要組成部分之后,保險(xiǎn)行業(yè)的誠(chéng)信建設(shè)再次引起了各界的關(guān)注,可以說建立和規(guī)范保險(xiǎn)行業(yè)征信制度已經(jīng)刻不容緩。正是基于上述的背景,本文從理論與實(shí)踐相結(jié)合的角度出發(fā),研究和討論了如何建立中國(guó)保險(xiǎn)行業(yè)的征信體系。一個(gè)行業(yè)征信體系的建立是一個(gè)復(fù)雜的系統(tǒng)性工程,而國(guó)內(nèi)外的成功經(jīng)驗(yàn)為保險(xiǎn)行業(yè)提供了眾多有益的參考。通過對(duì)這些經(jīng)驗(yàn)以及現(xiàn)存問題的研究和分析,我們可以發(fā)現(xiàn)盡管征信體系會(huì)因其所服務(wù)的對(duì)象,所處國(guó)家的政治、法律和社會(huì)背景而體現(xiàn)出一定的差異性,但是也有其特定的規(guī)律可循。首先是建立征信體系必須要有完善的法律制度環(huán)境;其二是完善的基礎(chǔ)數(shù)據(jù)庫是征信體系存在的基礎(chǔ),而要完善數(shù)據(jù)庫則取決于信息的提供者和使用者;其三是征信體系要被置于嚴(yán)格的監(jiān)管框架內(nèi);其四是征信信息要高度規(guī)范化。基于上述的這些結(jié)論,并結(jié)合保險(xiǎn)行業(yè)的實(shí)際情況,本文對(duì)于國(guó)內(nèi)保險(xiǎn)行業(yè)征信體系的建設(shè)給出了具體的規(guī)劃,即要采用綜合型行業(yè)性會(huì)員制的發(fā)展模式,強(qiáng)調(diào)公共機(jī)構(gòu)與市場(chǎng)化機(jī)構(gòu)相結(jié)合,從業(yè)機(jī)構(gòu)、人員信息和客戶信息三者并重的思路。進(jìn)一步,對(duì)于最基礎(chǔ)的行業(yè)征信信息數(shù)據(jù)庫的建設(shè),也在經(jīng)過市場(chǎng)初步實(shí)踐的前提下給出了相應(yīng)的方案,最后從審慎的角度出發(fā)對(duì)建立征信體系可能會(huì)面臨的問題加以了分析并提出了初步的解決思路。
[Abstract]:Honesty is the basis of all market transactions. In the modern society with marketization as the core, honesty and credit are paid more and more attention, which is closely related to the daily life of everyone. One of the main ways to solve the problem of honesty and credit in modern society is to eliminate information asymmetry by establishing credit information system, which makes credit information system gradually become one of the important tools of people's social life with the development of commodity economy. However, China's insurance industry, characterized by business risks and sales commitments, has not had a necessary credit system for a long time. With the continuous increase in the number of employees and the output value of the industry, the issue of good faith has become a long-term constraint on the insurance industry. The important factors of healthy and sustainable development have seriously affected the social image of the whole industry and hindered the whole industry from transforming into fine development. In recent years, there has been a growing demand both inside and outside the industry for solving the problem of insurance honesty and establishing the necessary credit information system, especially after the fourth Plenary session of the 18th CPC Central Committee included social credit information construction as an important part of the founding of the legal system. The honesty construction of insurance industry has aroused the attention of all walks of life again. It can be said that it is urgent to establish and standardize the credit investigation system of insurance industry. Based on the above background, this paper studies and discusses how to establish the credit system of China's insurance industry from the angle of combining theory with practice. The establishment of an industry credit system is a complex systematic project, and the successful experience at home and abroad provides many useful references for the insurance industry. Through the research and analysis of these experiences and the existing problems, we can find that although the credit system can reflect some differences because of the target, the political, legal and social background of the country. But there are certain rules to follow. First of all, the establishment of credit system must have a sound legal system environment, the second is that the perfect basic database is the basis of the credit system, and to improve the database depends on the information provider and user. The third is that the credit information system should be placed in a strict regulatory framework, and the fourth is that the credit information should be highly standardized. Based on the above conclusions, and combined with the actual situation of insurance industry, this paper gives a specific plan for the construction of domestic insurance industry credit system, that is, to adopt the comprehensive industry membership system development model. It emphasizes the combination of public institutions and market-oriented institutions, and the thinking of equal emphasis on employment institutions, personnel information and customer information. Further, for the construction of the most basic industry credit information database, the corresponding scheme is also given under the premise of preliminary market practice. Finally, the paper analyzes the problems that may be faced in the establishment of credit system from a prudent point of view and puts forward a preliminary solution.
