【摘要】：隨著河北省經(jīng)濟(jì)取得快速增長(zhǎng),經(jīng)濟(jì)與環(huán)境的矛盾也逐漸顯現(xiàn)出來,環(huán)境污染情況日益嚴(yán)峻,環(huán)境污染事故頻發(fā),嚴(yán)重危害人民群眾的身體健康。污染事故發(fā)生后遭受損失的受害者往往無法獲得及時(shí)的賠償,容易引發(fā)社會(huì)矛盾,不利于社會(huì)穩(wěn)定。環(huán)境污染責(zé)任保險(xiǎn)是一種有效的環(huán)境保護(hù)手段,能夠有效的分散企業(yè)的風(fēng)險(xiǎn),能夠使環(huán)境污染受害人及時(shí)獲得賠償。我國(guó)環(huán)境污染責(zé)任保險(xiǎn)的發(fā)展起步較晚,各方面發(fā)展還不成熟。河北省開展環(huán)境污染責(zé)任保險(xiǎn)試點(diǎn)工作過程中出現(xiàn)了一些問題,導(dǎo)致其在河北省的發(fā)展較為緩慢。因此,研究河北省環(huán)境污染責(zé)任保險(xiǎn)發(fā)展中的問題并提出相應(yīng)的解決對(duì)策是非常必要的。本文研究了河北省環(huán)境污染責(zé)任保險(xiǎn)發(fā)展過程中出現(xiàn)的問題,通過借鑒國(guó)內(nèi)外環(huán)境污染責(zé)任保險(xiǎn)的發(fā)展經(jīng)驗(yàn),從政府及相關(guān)部門、保險(xiǎn)公司、企業(yè)、多方協(xié)作等方面為促進(jìn)河北省環(huán)境污染責(zé)任保險(xiǎn)的發(fā)展提出建議。全文共分為五大部分:第一部分,首先介紹了本文的研究背景、目的及意義,并通過對(duì)國(guó)內(nèi)外學(xué)者的研究進(jìn)行綜述,對(duì)國(guó)內(nèi)外學(xué)者在該領(lǐng)域的研究有了一定的了解,然后闡述了研究思路和研究方法,最后提出了本文的創(chuàng)新點(diǎn)并說明了不足之處。第二部分,從河北省水污染、大氣污染、固體廢物污染三個(gè)方面分析了河北省環(huán)境污染現(xiàn)狀,并且分析了河北省環(huán)境污染責(zé)任保險(xiǎn)的發(fā)展歷程、運(yùn)作模式、激勵(lì)保障措施及整體運(yùn)行情況。第三部分,分析了河北省環(huán)境污染責(zé)任保險(xiǎn)發(fā)展過程中出現(xiàn)的問題。第四部分,介紹了國(guó)內(nèi)一些省份環(huán)境污染責(zé)任保險(xiǎn)的發(fā)展情況,并且對(duì)國(guó)外環(huán)境污染責(zé)任保險(xiǎn)的發(fā)展情況進(jìn)行分析,總結(jié)可借鑒的經(jīng)驗(yàn)。第五部分,在上述分析的基礎(chǔ)上,根據(jù)河北省的實(shí)際情況,從法律法規(guī)、社會(huì)管理功能、政府激勵(lì)保障措施,保險(xiǎn)公司控制經(jīng)營(yíng)風(fēng)險(xiǎn),企業(yè)增強(qiáng)保險(xiǎn)意識(shí),多方協(xié)作建立第三方評(píng)估機(jī)制、環(huán)境污染責(zé)任保險(xiǎn)專項(xiàng)基金、利用互聯(lián)網(wǎng)技術(shù)建立環(huán)境污染責(zé)任保險(xiǎn)公共信息平臺(tái)、微信服務(wù)號(hào)、加強(qiáng)宣傳力度等方面提出促進(jìn)河北省環(huán)境污染責(zé)任保險(xiǎn)發(fā)展的建議。
[Abstract]:With the rapid growth of economy in Hebei Province, the contradiction between economy and environment has gradually appeared. The environmental pollution situation is becoming more and more serious, and the accidents of environmental pollution occur frequently, which seriously harms the health of the people.The victims who suffer losses after the pollution accident are often unable to get timely compensation, which can easily lead to social conflicts and is not conducive to social stability.Environmental pollution liability insurance is an effective means of environmental protection, which can effectively disperse the risks of enterprises and enable the victims of environmental pollution to get compensation in time.The development of liability insurance for environmental pollution in China started late, and the development of all aspects is not mature.There are some problems in the pilot work of environmental pollution liability insurance in Hebei Province, which leads to its slow development in Hebei Province.Therefore, it is necessary to study the problems in the development of environmental pollution liability insurance in Hebei province and put forward corresponding countermeasures.This paper studies the problems in the development of liability insurance for environmental pollution in Hebei Province. By learning from the development experience of liability insurance for environmental pollution at home and abroad, from the government and related departments, insurance companies, enterprises,Suggestions are put forward to promote the development of environmental pollution liability insurance in Hebei Province.The paper is divided into five parts: the first part introduces the research background, purpose and significance of this paper, and through the review of the domestic and foreign scholars, we have a certain understanding of the domestic and foreign scholars in this field.Then the research ideas and research methods are expounded. Finally, the innovation of this paper is put forward and the shortcomings are explained.The second part, from three aspects of Hebei Province water pollution, air pollution, solid waste pollution analysis of Hebei Province environmental pollution status, and analysis of Hebei Province environmental pollution liability insurance development process, operating mode,Incentive measures and the overall operation of the situation.The third part analyzes the problems in the development of environmental pollution liability insurance in Hebei Province.The fourth part introduces the development of environmental pollution liability insurance in some provinces of China, and analyzes the development of foreign environmental pollution liability insurance, and summarizes the experience that can be used for reference.The fifth part, based on the above analysis, according to the actual situation of Hebei Province, from the laws and regulations, social management functions, government incentives and safeguards, insurance companies to control business risks, enterprises to enhance the awareness of insurance,Multi-party collaboration to establish a third-party assessment mechanism, environmental pollution liability insurance special fund, use of Internet technology to establish environmental pollution liability insurance public information platform, WeChat service number,Strengthen propaganda and other aspects to promote the development of environmental pollution liability insurance in Hebei Province.
