我國(guó)交強(qiáng)險(xiǎn)經(jīng)營(yíng)模式研究

【摘要】:交強(qiáng)險(xiǎn),即機(jī)動(dòng)車輛交通事故責(zé)任強(qiáng)制保險(xiǎn),是我國(guó)車險(xiǎn)市場(chǎng)的重要險(xiǎn)種,也是我國(guó)第一個(gè)國(guó)家立法強(qiáng)制實(shí)施的保險(xiǎn)制度。保監(jiān)會(huì)發(fā)布數(shù)據(jù)顯示,2012年我國(guó)交強(qiáng)險(xiǎn)承保車輛總數(shù)達(dá)到1.3億輛次,保費(fèi)總收入為1114億元,全年承擔(dān)的賠付責(zé)任限額為156187億元,交通事故賠付案共2052萬起,各項(xiàng)賠付共為821億元?梢,交強(qiáng)險(xiǎn)在依法保護(hù)交通事故受害第三人的賠償權(quán),維護(hù)我國(guó)道路交通安全方面發(fā)揮了重要作用。 自2006年7月1日交強(qiáng)險(xiǎn)制度開始施行以來,我國(guó)交強(qiáng)險(xiǎn)市場(chǎng)采取“政府定價(jià),保險(xiǎn)公司自負(fù)盈虧”的經(jīng)營(yíng)模式,這種模式具有雙重含義:一是要求交強(qiáng)險(xiǎn)充分發(fā)揮社會(huì)救助性的職能,遵循“不盈利不虧損”的經(jīng)營(yíng)原則,另一是要求各家保險(xiǎn)公司各顯神通,在沒有任何稅收優(yōu)惠的基礎(chǔ)上,自主經(jīng)營(yíng)交強(qiáng)險(xiǎn)業(yè)務(wù),并且自負(fù)盈虧。這種模式違背了保險(xiǎn)公司的營(yíng)利本質(zhì),其弊端逐漸顯現(xiàn),并已影響了我國(guó)交強(qiáng)險(xiǎn)市場(chǎng)的健康發(fā)展,因此,我國(guó)交強(qiáng)險(xiǎn)經(jīng)營(yíng)模式的改革勢(shì)在必行。 目前國(guó)內(nèi)學(xué)者對(duì)交強(qiáng)險(xiǎn)的研究主要集中在對(duì)其法律制度、費(fèi)率界定、保險(xiǎn)市場(chǎng)現(xiàn)狀的探討上,雖然有部分專家學(xué)者提出對(duì)現(xiàn)行交強(qiáng)險(xiǎn)經(jīng)營(yíng)模式的質(zhì)疑,但缺乏對(duì)我國(guó)交強(qiáng)險(xiǎn)經(jīng)營(yíng)模式的系統(tǒng)研究。因此,系統(tǒng)研究我國(guó)現(xiàn)有交強(qiáng)險(xiǎn)經(jīng)營(yíng)模式的內(nèi)涵、特點(diǎn)及不足,提出適合我國(guó)國(guó)情的交強(qiáng)險(xiǎn)經(jīng)營(yíng)模式,對(duì)我國(guó)交強(qiáng)險(xiǎn)的健康發(fā)展具有重要的理論和現(xiàn)實(shí)意義。 本文在闡述交強(qiáng)險(xiǎn)的概念、特征、功能、與商業(yè)三者險(xiǎn)區(qū)別的基礎(chǔ)上,結(jié)合國(guó)際交強(qiáng)險(xiǎn)市場(chǎng)的發(fā)展現(xiàn)狀,比較了我國(guó)現(xiàn)行交強(qiáng)險(xiǎn)經(jīng)營(yíng)模式模式與國(guó)際上具有代表性的兩種經(jīng)營(yíng)模式(市場(chǎng)模式和代辦模式)的區(qū)別,分析了不同交強(qiáng)險(xiǎn)經(jīng)營(yíng)模式各自的特點(diǎn)、經(jīng)營(yíng)機(jī)制及優(yōu)勢(shì),重點(diǎn)分析了我國(guó)交強(qiáng)險(xiǎn)現(xiàn)有經(jīng)營(yíng)模式的特點(diǎn)及邏輯矛盾。最后,結(jié)合我國(guó)實(shí)際,提出了符合我國(guó)國(guó)情的交強(qiáng)險(xiǎn)經(jīng)營(yíng)模式,即“政府嚴(yán)格監(jiān)管下的商業(yè)保險(xiǎn)公司經(jīng)營(yíng)”模式,,以其實(shí)現(xiàn)我國(guó)交強(qiáng)險(xiǎn)市場(chǎng)的健康發(fā)展提供理論支持。
[Abstract]:Traffic insurance, that is, compulsory liability insurance for motor vehicle traffic accidents, is an important type of insurance in China's auto insurance market. It is also the first national legislation to enforce the insurance system. According to the data released by the Insurance Regulatory Commission, in 2012, the total number of vehicles insured by traffic insurance in China reached 130 million, the total premium income was 111.4 billion yuan, and the compensation liability limit for the whole year was fifteen trillion six hundred and eighteen billion seven hundred million yuan. There are 20.52 million cases of compensation for traffic accidents, and the total compensation payment is 82.1 billion yuan. It can be seen that traffic insurance plays an important role in protecting the compensation rights of the third party who is injured in traffic accidents according to law and in maintaining the road traffic safety in our country. Since the implementation of the traffic insurance system in July 1st 2006, China's traffic insurance market has adopted the business model of "government pricing, insurance companies are responsible for their own profits and losses". This model has two meanings: one is to require the traffic insurance to give full play to the function of social assistance, to follow the "no profit, no loss" operating principle, the other is to require insurance companies to show their own talents, on the basis of no tax preference. This mode violates the profit nature of the insurance company, and its malpractice gradually appears, and has affected the healthy development of the traffic insurance market in our country, therefore, this mode is contrary to the nature of profit of the insurance company, and has affected the healthy development of the traffic insurance market in our country. It is imperative to reform the management mode of traffic insurance in China. At present, the domestic scholars mainly focus on the legal system, the definition of the rate, the current situation of the insurance market, although some experts and scholars have raised doubts about the current operation mode of the traffic insurance. However, there is a lack of systematic research on the management mode of strong traffic insurance in China. Therefore, the connotation, characteristics and shortcomings of the existing traffic insurance management model are systematically studied, and the operating mode of traffic strong insurance suitable for the national conditions of our country is put forward. It has important theoretical and practical significance for the healthy development of traffic insurance in China. On the basis of expounding the concept, characteristics, functions and differences between commercial and commercial insurance, this paper combines the current situation of the development of the international traffic insurance market. This paper compares the difference between the current trade insurance management model of our country and the two representative international business models (market model and agency mode), and analyzes the characteristics, management mechanism and advantages of different trade strong insurance management models. This paper mainly analyzes the characteristics and logical contradiction of the existing management mode of traffic insurance in China. Finally, combined with the reality of our country, this paper puts forward the management mode of traffic strong insurance, that is, "commercial insurance company management under strict supervision by the government", which is in line with the national conditions of our country. To achieve the healthy development of China's traffic insurance market to provide theoretical support.
