【摘要】：隨著我國市場主體日益增多,市場經(jīng)濟(jì)體制逐步確立和成熟,曾經(jīng)在我國計(jì)劃經(jīng)濟(jì)時(shí)代發(fā)揮過重要作用的工商登記制度,已經(jīng)逐步顯現(xiàn)出制約經(jīng)濟(jì)發(fā)展的矛盾,工商登記制度改革成為經(jīng)濟(jì)社會(huì)發(fā)展的必然要求。本文以泉州工商登記制度改革為研究對象,研究了泉州工商登記制度改革的歷史沿革,分析其改革舉措,發(fā)現(xiàn)其存在職能部門定位有待重新確認(rèn),職能部門之間協(xié)作銜接有待加強(qiáng),統(tǒng)一商事立法有待確立,后續(xù)監(jiān)管有待提升等問題。產(chǎn)生上述問題的原因包括工商登記制度發(fā)展歷史影響,權(quán)力部門之間的利益博弈,國家立法支撐尚較薄弱,缺乏成熟的工商登記制度經(jīng)驗(yàn)借鑒等。在此基礎(chǔ)上,本文從國內(nèi)外工商登記制度的先進(jìn)經(jīng)驗(yàn)為基礎(chǔ),結(jié)合本地實(shí)際,提出泉州市工商登記制度改革的深化對策:健全法律審批體系以實(shí)現(xiàn)制度保障,完善職能部門規(guī)劃以明晰政府職責(zé),建立信息共享平臺(tái)以整合部門資源,構(gòu)建社會(huì)信用體系以強(qiáng)化后續(xù)監(jiān)管,發(fā)揮社會(huì)和行業(yè)監(jiān)督以實(shí)現(xiàn)聯(lián)防聯(lián)控,并具體對每一條對策予以細(xì)化分析,希望對于工商登記制度改革涉及的工商、稅務(wù)、質(zhì)監(jiān)等各職能部門的協(xié)作銜接和系統(tǒng)建設(shè),以及政府職能轉(zhuǎn)變、簡政放權(quán),提供借鑒參考。
[Abstract]:With the increasing number of market subjects in our country and the gradual establishment and maturity of the market economic system, the industrial and commercial registration system, which once played an important role in the era of planned economy in our country, has gradually revealed the contradictions that restrict the economic development. The reform of the industrial and commercial registration system has become an inevitable requirement of the economic and social development. This paper takes the reform of the industrial and commercial registration system in Quanzhou as the research object, studies the historical evolution of the reform of the industrial and commercial registration system in Quanzhou, and analyzes its reform measures. It is found that the location of the functional department needs to be reconfirmed, the coordination between the functional departments needs to be strengthened, and the unified commercial legislation needs to be established. The causes of these problems include the historical influence of the development of the industrial and commercial registration system, the interests game between the power departments, and the weak support of the national legislation. Lack of mature business registration system experience, etc. On this basis, this paper based on the advanced experience of domestic and foreign industrial and commercial registration system, combined with the local reality, The paper puts forward the countermeasures of deepening the reform of the industrial and commercial registration system in Quanzhou: perfecting the legal examination and approval system to realize the system guarantee, perfecting the functional department planning to clarify the government's responsibility, establishing the information sharing platform to integrate the departmental resources. To build a social credit system to strengthen the follow-up supervision, to give play to social and industry supervision to achieve joint defense control, and to detail and analyze each countermeasure, hoping that the industry and commerce involved in the reform of the industrial and commercial registration system will be taxed. The coordination and system construction of quality supervision and other functional departments, as well as the transformation of government functions and the simplification of government power, provide reference for reference.
