基于企業(yè)視角的生態(tài)資源資產(chǎn)產(chǎn)權(quán)交易機(jī)制研究

【摘要】:近年來(lái),綠色發(fā)展理念引導(dǎo)我國(guó)生態(tài)建設(shè)不斷向前推進(jìn),生態(tài)要素也越來(lái)越成為重要的生產(chǎn)要素。由于我國(guó)生態(tài)脆弱地區(qū)面積廣泛且與經(jīng)濟(jì)落后地區(qū)高度重合,同時(shí)這些地區(qū)發(fā)展還均受制于開發(fā)和保護(hù)矛盾的約束,實(shí)踐表明,解決這種矛盾問(wèn)題單靠政府財(cái)政資金的投入遠(yuǎn)不能及。因此,在生態(tài)治理實(shí)踐的倒逼下,我國(guó)迫切需要進(jìn)行生態(tài)資源資產(chǎn)的產(chǎn)權(quán)制度改革,并推動(dòng)生態(tài)資源資產(chǎn)產(chǎn)權(quán)交易機(jī)制的建立和完善。從融資角度看,企業(yè)作為社會(huì)資本的主力,具有資金、技術(shù)、人才等巨大優(yōu)勢(shì),一旦其自發(fā)參與生態(tài)資源資產(chǎn)產(chǎn)權(quán)交易的意愿被激發(fā),我國(guó)生態(tài)補(bǔ)償因融資短缺而進(jìn)展緩慢的窘境也必能得到緩解。鑒于此,本文通過(guò)梳理國(guó)內(nèi)外研究成果和實(shí)踐經(jīng)驗(yàn),運(yùn)用生態(tài)資源和產(chǎn)權(quán)等相關(guān)基礎(chǔ)理論,借鑒國(guó)內(nèi)農(nóng)村產(chǎn)權(quán)、公共資源產(chǎn)權(quán)等市場(chǎng)交易機(jī)制構(gòu)建的經(jīng)驗(yàn),擬從企業(yè)視角對(duì)生態(tài)資源資產(chǎn)產(chǎn)權(quán)交易機(jī)制的構(gòu)建展開研究和探討。雖然目前我國(guó)缺乏對(duì)生態(tài)資源資產(chǎn)產(chǎn)權(quán)交易的系統(tǒng)性制度規(guī)制,但各地區(qū)機(jī)構(gòu)已開始結(jié)合自身?xiàng)l件,嘗試對(duì)農(nóng)地資源、水資源等生態(tài)資源資產(chǎn)的產(chǎn)權(quán)交易機(jī)制進(jìn)行建設(shè)和運(yùn)行。本文通過(guò)案例資料分析及運(yùn)行情況梳理,發(fā)現(xiàn)頂層制度及配套細(xì)則缺失、政府角色扮演混亂復(fù)雜、進(jìn)場(chǎng)交易品種單一、專業(yè)性中介機(jī)構(gòu)發(fā)展滯后、產(chǎn)權(quán)交易信息披露不完善是現(xiàn)行各類生態(tài)資源資產(chǎn)產(chǎn)權(quán)交易機(jī)制主要的共性問(wèn)題,其不僅阻礙了生態(tài)資源資產(chǎn)產(chǎn)權(quán)交易發(fā)展的進(jìn)度,還抑制了企業(yè)等社會(huì)資本參與其中的積極性。因此,本文從企業(yè)視角出發(fā),從宏觀和微觀兩個(gè)層面研究生態(tài)資源資產(chǎn)產(chǎn)權(quán)交易機(jī)制,不僅提出頂層制度設(shè)計(jì)時(shí)需要著重考慮的問(wèn)題,還對(duì)包括交易市場(chǎng)、交易規(guī)則等內(nèi)容在內(nèi)的微觀機(jī)制進(jìn)行探討,嘗試構(gòu)建有別于公共資源交易市場(chǎng)、企業(yè)產(chǎn)權(quán)交易市場(chǎng)的新型產(chǎn)權(quán)交易市場(chǎng)——生態(tài)資源資產(chǎn)產(chǎn)權(quán)交易市場(chǎng)。最后,本文從進(jìn)一步完善生態(tài)資源資產(chǎn)產(chǎn)權(quán)制度等三個(gè)方面提出十一項(xiàng)政策建議,以期通過(guò)激發(fā)企業(yè)等社會(huì)資本主力參與意愿,促進(jìn)生態(tài)資源資產(chǎn)產(chǎn)權(quán)交易平臺(tái)構(gòu)建,并加速全國(guó)統(tǒng)一市場(chǎng)的形成,在拓寬橫向生態(tài)補(bǔ)償資金融通渠道的同時(shí),也為解決生態(tài)脆弱地區(qū)亟需生態(tài)修復(fù)而又面臨經(jīng)濟(jì)發(fā)展滯后的矛盾性問(wèn)題提供政策出路。
[Abstract]:In recent years, the concept of green development has led the ecological construction of our country to move forward, and ecological elements have become more and more important factors of production. Because the ecological fragile areas in China are extensive and highly coincide with the economically backward areas. At the same time, the development of these areas are also constrained by the contradiction of development and protection. The practice shows that the solution of this contradiction is far from enough by the investment of government financial funds alone. Therefore, it is forced by the practice of ecological governance. China urgently needs to reform the property right system of ecological resources assets and promote the establishment and improvement of property rights trading mechanism of ecological resources assets. From the perspective of financing, enterprises, as the main force of social capital, have funds. Technology, talent and other huge advantages, once its spontaneous participation in the property rights transaction of ecological resources assets is motivated, our ecological compensation due to the shortage of financing and slow progress will be alleviated. In view of this. Through combing the domestic and foreign research results and practical experience, using the ecological resources and property rights and other related basic theory, using the domestic rural property rights, public resources property rights and other market transaction mechanism construction experience. This paper intends to study and discuss the construction of property rights trading mechanism of ecological resources assets from the perspective of enterprises, although there is a lack of systematic institutional regulation on property rights transactions of ecological resources assets in China at present. However, the regional institutions have begun to combine their own conditions, try to land resources, water resources and other ecological resources assets of property rights trading mechanism construction and operation. Found that the top level of the system and the lack of supporting rules, government role play chaos and complexity, enter the market transactions of a single variety, professional intermediary institutions lag behind. The imperfect disclosure of property rights transaction information is the main common problem in the property right trading mechanism of various kinds of ecological resources assets, which not only hinders the progress of property rights transaction of ecological resources assets. It also inhibits the enthusiasm of enterprises and other social capital to participate in it. Therefore, this paper studies the transaction mechanism of property rights of ecological resources assets from the perspective of enterprises, from the macro and micro levels. Not only put forward the top-level system design need to focus on the issues, but also to the transaction market, trading rules and other aspects of the micro-mechanism, trying to build a different from the public resource trading market. Finally, this paper puts forward eleven policy suggestions from three aspects of further perfecting the property right system of ecological resources assets. In order to stimulate enterprises and other social capital to participate in the main willingness to promote the construction of property rights trading platform for ecological resources assets and accelerate the formation of a unified national market while widening the horizontal channels of ecological compensation funds financing. It also provides a policy outlet for solving the contradiction of ecological restoration in fragile ecological areas and the lag of economic development.
